1.3.2 Short description of the carousel.
Traditional, one floor, oval.
Construction: steel, zinc plated.
Dimensions: Diameter of the platform: min 7 m (meters).
Decorative floor made of PVC.
Decorative wreath: fiber glass panels, mirrors and lights, hand painted decorations selected by the buyer - design service by the producer.
Floor of the rotating platform and the stairs: wooden, protected with the fire resistant paint resistant to friction.
Number of figures: minimum 20.
Number of seats: minimum 29.
Design service for the figures on the proposal of the producer and chosen by the buyer.
Shape of figures, proposed by the contracting authority:
— horses: minimum 17 x 1 seat,
— carriages: minimum 2 x 4 seats,
— rotating cups: minimum 2 x 2 seats.
Horses:
— swaying: minimum 2, swaying +/- 120 mm with inner spring,
— moving on bars up-down with AC motor: minimum 10 horses, movement +/- 300 mm.
Time of driving: should be regulated.
Speed of rotation: should be regulated with potentiometer.
Driving control: with security control system, AC controller and hand control. Main electric panels should be located in control room.
Rotation: 360 degrees in direction of clock hands.
Bearings: made by world known producer.
Electric motors: made by world known producer.
Drive: gearbox with rubber wheel.
Power, also subject of dialogue.
Tension: AC 220/380 V +/- 5 %.
Frequency: 50 Hz +/- 5 %.
Lightening: basic package.
The product should be made according to the European standards EN 13814.

2.2 Personal status.
2.2.1 The contracting authority shall exclude every economical operator from the procedure for awarding a contract on public procurement if:
— an effective verdict for participation in maleficent organization, corruption, fraud or money laundering was pronounced in the past 5 years,
— a minor penalty – ban on participation in public call procedures, awarding contracts on public procurement and contracts on public-private partnership is pronounced,
— a minor penalty – temporary or permanent ban on the performance of particular action is pronounced,
— the economical operator is in bankruptcy or liquidation procedure,
— the economical operator has unsettled taxes, contributions and other public duties,
— a misdemeanour sanction is pronounced – ban on performance of profession, action or responsibility, i.e. temporary ban on the performance of particular action, and,
— the economical operator gives false data or fails to submit the data requested by the contracting authority.
2.2.2 For the purpose of proving its personal status the economical operator submits the following documents:
— statement from the economical operator that no effective verdict for participation in maleficent organization, corruption, fraud or money laundering was pronounced in the past 5 years,
— confirmation from a competent authority that no…
… bankruptcy procedure was initiated,
… liquidation procedure was initiated,
— confirmation for settled taxes, contributions and other public duties from a competent authority from the country where the economical operator is registered,
— confirmation from the Register of penalties for criminal acts committed by legal persons stating that no minor penalty –…
… ban on participation in public call procedures, awarding contracts on public procurement and contracts on public-private partnership has been pronounced,
… temporary or permanent ban on the performance of particular action has been pronounced,
— confirmation that no misdemeanour sanction – ban on performance of profession, action or responsibility, i.e. temporary ban on the performance of particular action, has been pronounced with the effective verdict.
2.2.3 The statement from indent 1 sub item 2.2.2 is prepared and signed by the economical operator and it must not be verified by the competent authority.
2.2.4 The confirmations stating that no bankruptcy and liquidation procedure has been initiated, as well as the confirmations from the Register of penalties for criminal acts committed by legal persons from indents 5 and 6 from sub item 2.2.2 are issued by the competent authorities in the country where the economical operator is registered. In the Republic of Macedonia the competent authority for issuance of these confirmations is the Central Register of the Republic of Macedonia.

2.2.5 The confirmation for settled taxes, contributions and other public duties is issued by the competent authority from the country where the economical operator is registered. In the Republic of Macedonia the competent authority for issuance of this confirmation is the Public Revenue Office.

2.2.6 The confirmation from indent 7 sub item 2.2.2 is issued by the competent authority in the country where the economical operator is registered. In the Republic of Macedonia the competent authority for issuance of this confirmation is the Central Register of the Republic of Macedonia.

2.2.7 The documents from sub item 2.2.2 must not be older than 6 (six) months calculated from the final deadline for submission of the application for participations calculated backwards.
2.2.8 If the country where the economical operator is registered does not issue the documents specified in sub item 2.2.2 or if they do not encompass all aforementioned cases, the economical operator can submit a statement verified at the competent authority (Notary Public).

2.4.1 If the economic operator proves his technical or professional ability invocating the support by other subject, he is obliged to prove the support by declaration given by the supporter as a proof that the bidder disposes the appropriate technical and professional resources.

2.4.2 The technical and professional ability of the economic operator must be supported by another subject, regardless of the legal links between the economic operator and that subject (article 154 of the Law on Public procurement).
2.4.3 The supporter shall submit declaration that no final court decision was issued against him for taking part in criminal organization, corruption, fraud or money laundering in the last 5 years.

6.1 Every economic operator that has a legal interest on obtaining the public procurement contract and who suffered or could suffer damage from possible breach of the provisions from the Law on Public Procurement, can ask for legal protection against the decisions, actions or failure to take actions by the contracting authority in the procedure on awarding a public procurement contract.

6.2. The appeal shall be notified within eight days from the day of:
— publication of the announcement on awarding a public procurement contract in terms of data, actions or failures to undertake actions from the announcement,
— opening of the application for participations in relation to actions or failures to undertake actions related to the tender documentation, i.e. the procedure on the public opening of application for participations,
— admission of the decision that determines the individual right on the procedure on awarding public procurement contract, in terms of determining the ability of applications for participation or evaluation of the application for participations and the decision or,

— knowledge of the unlawful conduction of the procedure on awarding a public procurement contract, at latest one year from the completion day of the conducted procedure.
6.3 The economic operator, who failed to submit an appeal, in respect of the provisions of sub-item 7.2, has no right of appeal in the later stage of the procedure for the same legal grounds.
6.4 The appeal should contain the following elements:
— data on the appeal (name, name of operator, address of residence and address of head office),
— data for the representative or the proxy,
— name and address of the contracting authority,
— number and date of the procedure on awarding public procurement contract and information regarding the announcement on awarding public procurement contract,
— number and date of the decision for selection of the most favorable application for participation, the annulment of the procedure or other decisions of the contracting authority,
— Information regarding to actions or failure to take actions by the contracting authority,
— description of the actual situation,
— description of the irregularities and explanation of the irregularities,
— proposal of evidences,
— appeal request and/or request for reimbursement for the cost on the procedure and,
— Signature of authorized person and official stamp.
6.5 The appellant shall submit an evidence of payment of compensation for conducting the procedure.
6.6 The appellant, who has not established head-office in the territory of the Republic of Macedonia, is obliged to appoint a proxy in order to receive notifications in written.
6.7 The appeal is submitted to the State Commission. The appeal shall be submitted personally or by registered mail to both the contracting authority and the State Commission. The day of submitting the appeal by registered mail is considered as the day of submission. In the case of a personal submission of the appeal, the contracting authority is obliged to issue a certificate to the applicant for the time of admission.

6.8 In the procedure in front of the State Commission the appellant, in addition to administrative fees, shall pay compensation for the procedure depending on the amount of the application for participation, i.e. as follows:
— up to 20 000 EUR in a Denar counter value, a compensation of 100 EUR in a Denar counter value,
— from 20 000 to 100 000 EUR in a Denar counter value, a compensation of 200 EUR in a Denar counter value,
— from 100 000 to 200 000 EUR in a Denar counter value a compensation of 300 EUR in a Denar counter value or,
— over 200 000 EUR in a Denar counter value, a compensation of 400 EUR in a Denar counter value.
6.9. In case of non-existence of application for participation, the amount of the compensation on conducting the procedure is calculated based on the estimated value of the public procurement contract, whereas the State Commission shall notify the appellant for the amount of the compensation and the deadline to submit an evidence of his payment.

6.10 The compensation on conducting the procedure is income in the State Budget.
