2.1.1 The economical operator should compulsorily submit the accompanying documentation with the offer for the purpose of proving:
— the personal status,
— competence for performing professional action,
— economical and financial status,
— technical or professional competence,
— quality system standards.
2.1.2 The required documentation is submitted in original or copy verified by the economical operator with the seal and signature of the responsible person, with the mark “True to the original”.
2.1.3 During the check of the completeness and validity of the documentation for establishing the competence of the economical operator and during the offer evaluation, the committee can request clarification and amendment of the documents by the economical operators, if there are no significant deviations from the required documentation.

2.2 Personal status
2.2.1 The contracting body shall exclude every economical operator from the procedure for awarding a contract on public procurement if:
— an effective verdict for participation in maleficent organization, corruption, fraud or money laundering was pronounced in the past 5 years,
— a minor penalty – ban on participation in public call procedures, awarding contracts on public procurement and contracts on public-private partnership is pronounced,
— a minor penalty – temporary or permanent ban on the performance of particular action is pronounced,
— the economical operator is in bankruptcy or liquidation procedure,
— the economical operator has unsettled taxes, contributions and other public duties,
— a misdemeanour sanction is pronounced – ban on performance of profession, action or responsibility, i.e. temporary ban on the performance of particular action, and,
— the economical operator gives false data or fails to submit the data requested by the contracting body.
2.2.2 For the purpose of proving its personal status the economical operator submits the following documents:
— statement from the economical operator that no effective verdict for participation in maleficent organization, corruption, fraud or money laundering was pronounced in the past 5 years,
— confirmation from a competent authority that no…

2.2.3 The statement from indent 1 sub item 2.2.2 is prepared and signed by the economical operator and it must not be verified by the competent authority.
2.2.4 The confirmations stating that no bankruptcy and liquidation procedure has been initiated, as well as the confirmations from the register of penalties for criminal acts committed by legal persons from indents 5 and 6 from sub item 2.2.2 are issued by the competent authorities in the country where the economical operator is registered. — 3. The economical operator is obliged to have technical staff and technical bodies for delivery and installation of the concerned procurement at disposal,
— 4. The economical operator is obliged to submit a proof for quality control with recognized competence, for testing the suitability of the products which was clearly established with the references to the specifications and standards,
— 5. The economical operator is obliged to provide training of the employees for handling the material,
— 6. Statement for technical and professional competence signed by authorised person,
— 7. Description and photographs of products, subject to delivery, whose credibility should be confirmed by the economical operator, if that is requested by the contracting body.
2.5.2 The economical operator proves the fulfilment of the minimal terms from sub item 2.5.1 by submitting the following documents:
— 1. List of main deliveries of goods from the same or similar type in the previous years, verified and signed by the responsible person, by enclosing minimum 5 confirmations for high-quality and timely delivery,
— 2. List of equipment and tool at the disposal of the economical operator and proof for the quality of the built-in equipment,
— 3. Statement with which the economical operator confirms the disposal of technical staff and personnel, by enclosing the list of engaged persons with data, qualifications, professional and technical competence, who shall be responsible for realization of the procurement,

No effective verdict for participation in a criminal organization, corruption, fraud or money laundering should be pronounced against the entity providing the technical or professional support (ar.154 of LPP).

2.6.1 The economical operator should meet the following standards in order to qualify itself as competent for performance of the concerned contract on public procurement from the aspect of the quality system standards:
Security requirements.
— Quality system ISO 9001-2000,
— Statement for manufacturer's compliance with EN,
— Submission of certificates which confirm the quality and security of the installed equipment and materials: CE quality mark, accompanied with EC statement from the manufacturer,
— Meeting the security requirements, according to the valid regulation of the Republic of Macedonia and the EN 13814 standard,
— Technical check before putting into use.
Manufacturer’s certificates for:
— electromotor,
— electrical lighting equipment,
— electrical management equipment,
— built-in security equipment,
— built-in construction material,
— welded joints,
— for the used colour.
Other important elements.
— Security marks,
— Instructions (manual) for product use,
— Maintenance instructions,
— Installation, certificates for the installers,
— Training of the staff for handling and acting in case of incidents,
— Providing service and spare parts.
2.6.2 The economical operator proves the fulfilment of the standards from sub item 2.6.1 by submitting the following documents:
— Certificate CE quality mark, accompanied with EC statement from the manufacturer and EN 13814 standard.

4.6.1 As a part of the offer, the economic operator is obliged to provide a guarantee of the offer (guarantee of participation) in the amount of at least 3.00 % of the total value of the offer without VAT.
4.6.2 The guarantee is in the form of bank guarantee, issued by a reputable banking institution chosen by the economic operator. All the banks are acceptable for the contracting authority.
4.6.3 The guarantee should be submitted in the original form. The copies are not accepted. The guarantee has to be valid for at least 14 days from the expiry date of the offer. Every offer that does not contain a guarantee of the offer, or contains guarantee of the offer which is not in accordance with the conditions of the tender documentation, will be rejected by the contracting authority as unacceptable.
4.6.3 The guarantee should be submitted in the original form. The copies are not accepted. The guarantee has to be valid for at least 14 days from the expiry date of the offer. Every offer that does not contain a guarantee of the offer, or contains guarantee of the offer which is not in accordance with the conditions of the tender documentation, will be rejected by the contracting authority as unacceptable.
4.6.4 The guarantee of the offer of the unsuccessful economic operators is returned within 7 days after signing the contract with the most favorable economic operator.
4.6.5 The guarantee of the offer may be settled, if the economic operator has withdrawn the offer before the expiration period of the validity, does not accept the correction of arithmetical errors by the Commission, does not sign the contract on public procurement and does not provide a guarantee for high quality performance of the contract.

7.5 Guarantee for high quality performance of the contract.
Condition for signing the contract with the selected most favorable bidder is providing a guarantee by the selected most favorable bidder for high quality performance of the contract in the amount of 5.00 %of the contract value.
7.5.1 The guarantee from item 1.1 is delivered in writing in the form of bank guarantee. The guarantee should be submitted in the original form. Copies are not accepted.
7.5.2 The guarantee of high quality performance of the contract will be valid until the full implementation of the contract. The contracting authority after the selection of the most favorable bidder, additionally shall establish the final date of validity of the guarantee.

7.5.6 The guarantee of high quality performance of the contract shall be submitted within the specified period together with the signed and certified contract, as follows: by mail.
7.5.7 The guarantee of high quality performance of the contract will be settled, if the holder of the procurement does not meet some of the obligations of the public procurement contract within the due date.
7.5.8 In case of non completion of some of the contract obligations as agreed, the contracting authority shall notify in writing the holder of the procurement that shall settle the bank guarantee of high quality performance of the contract.
7.5.9 If the contract is fully implemented as agreed, the contracting authority shall return the bank guarantee of high quality performance of the contract to the holder of the procurement within 14 days of the complete implementation of the contract.

6.3.1 Every economic operator that has a legal interest on obtaining the public procurement contract and who suffered or could suffer damage from possible breach of the provisions from the Law on Public Procurement, can ask for legal protection against the decisions, actions or failure to take actions by the contracting authority in the procedure on awarding a public procurement contract.

— admission of the decision that determines the individual right on the procedure on awarding public procurement contract, in terms of determining the ability of applications for participation or evaluation of the offers and the decision or,
— knowledge of the unlawful conduction of the procedure on awarding a public procurement contract, at latest one year from the completion day of the conducted procedure.
6.3.2 The economic operator, who failed to submit an appeal, in respect of the provisions of sub-item 6.3.1, has no right of appeal in the later stage of the procedure for the same legal grounds.
6.3.3 The appeal should contain the following elements:
— data on the appeal (name, name of operator, address of residence and address of head office),
— data for the representative or the proxy,
— name and address of the contracting authority,
— number and date of the procedure on awarding public procurement contract and information regarding the announcement on awarding public procurement contract,
— number and date of the decision for selection of the most favorable offer, the annulment of the procedure or other decisions of the contracting authority,
— Information regarding to actions or failure to take actions by the contracting authority,
— description of the actual situation,
— description of the irregularities and explanation of the irregularities,
— proposal of evidences,
— appeal request and/or request for reimbursement for the cost on the procedure and,
— Signature of authorized person and official stamp.
6.3.4 The appellant shall submit an evidence of payment of compensation for conducting the procedure.
6.3.5 The appellant, who has not established head-office in the territory of the Republic of Macedonia, is obliged to appoint a proxy in order to receive notifications in written.
6.3.6 The appeal is submitted to the State Commission. The appeal shall be submitted personally or by registered mail to both the contracting authority and the State Commission. The day of submitting the appeal by registered mail is considered as the day of submission. In the case of a personal submission of the appeal, the contracting authority is obliged to issue a certificate to the applicant for the time of admission.
6.3.6 The appeal is submitted to the State Commission. The appeal shall be submitted personally or by registered mail to both the contracting authority and the State Commission. The day of submitting the appeal by registered mail is considered as the day of submission. In the case of a personal submission of the appeal, the contracting authority is obliged to issue a certificate to the applicant for the time of admission.
6.3.7 In the procedure in front of the state commission the appellant, in addition to administrative fees, shall pay compensation for the procedure depending on the amount of the offer, i.e. as follows:
— up to 20 000 EUR in a denar counter value, a compensation of 100 Euros in a Denar counter value,
— from 20 000 to 100 000 EUR in a denar counter value, a compensation of 200 EUR in a Denar counter value,
— from 100 000 to 200 000 EUR in a denar counter value a compensation of 300 EUR in a denar counter value or,
— over 200 000 EUR in a denar counter value, a compensation of 400 EUR in a denar counter value.
6.3.8 In case of non-existence of offer, the amount of the compensation on conducting the procedure is calculated based on the estimated value of the public procurement contract, whereas the State Commission shall notify the appellant for the amount of the compensation and the deadline to submit an evidence of his payment.

6.3.9 The compensation on conducting the procedure is income in the state budget.
