2.1.1 The economical operator should compulsorily submit the accompanying documentation with the offer for the purpose of proving:

— the personal status,

— competence for performing professional action,

— economical and financial status,

— technical or professional competence,

— quality system standards.

2.1.2 The required documentation is submitted in original or copy verified by the economical operator with the seal and signature of the responsible person, with the mark "True to the original".

2.1.3 During the check of the completeness and validity of the documentation for establishing the competence of the economical operator and during the offer evaluation, the committee can request clarification and amendment of the documents by the economical operators, if there are no significant deviations from the required documentation.

2.1.4 The economical operator submits the required clarification in writing and within the deadline determined by the contracting body.

2.1.5 No modifications in the offer, with the exception of arithmetical errors, can be requested, offered or allowed by the committee or by the economical operator.

2.2 Personal status

2.2.1 The contracting body shall exclude every economical operator from the procedure for awarding a contract on public procurement if:

— an effective verdict for participation in maleficent organization, corruption, fraud or money laundering was pronounced in the past 5 years,

— a minor penalty – ban on participation in public call procedures, awarding contracts on public procurement and contracts on public-private partnership is pronounced,

— a minor penalty – temporary or permanent ban on the performance of particular action is pronounced,

— the economical operator is in bankruptcy or liquidation procedure,

— the economical operator has unsettled taxes, contributions and other public duties,

— a misdemeanour sanction is pronounced – ban on performance of profession, action or responsibility, i.e. temporary ban on the performance of particular action, and,

— the economical operator gives false data or fails to submit the data requested by the contracting body.

2.2.2 For the purpose of proving its personal status the economical operator submits the following documents:

— statement from the economical operator that no effective verdict for participation in maleficent organization, corruption, fraud or money laundering was pronounced in the past 5 years,

— confirmation from a competent authority that no…

… bankruptcy procedure was initiated,

… liquidation procedure was initiated,

— confirmation for settled taxes, contributions and other public duties from a competent authority from the country where the economical operator is registered,

— confirmation from the Register of penalties for criminal acts committed by legal persons stating that no minor penalty –…

… ban on participation in public call procedures, awarding contracts on public procurement and contracts on public-private partnership has been pronounced,

… temporary or permanent ban on the performance of particular action has been pronounced,

— confirmation that no misdemeanour sanction – ban on performance of profession, action or responsibility, i.e. temporary ban on the performance of particular action, has been pronounced with the effective verdict.

2.2.3 The statement from indent 1 sub item 2.2.2 is prepared and signed by the economical operator and it must not be verified by the competent authority.

2.2.4 The confirmations stating that no bankruptcy and liquidation procedure has been initiated, as well as the confirmations from the Register of penalties for criminal acts committed by legal persons from indents 5 and 6 from sub item 2.2.2 are issued by the competent authorities in the country where the economical operator is registered. In the Republic of Macedonia the competent authority for issuance of these confirmations is the Central Register of the Republic of Macedonia.

2.2.5 The confirmation for settled taxes, contributions and other public duties is issued by the competent authority from the country where the economical operator is registered. In the Republic of Macedonia the competent authority for issuance of this confirmation is the Public Revenue Office.

2.2.6 The confirmation from indent 7 sub item 2.2.2 is issued by the competent authority in the country where the economical operator is registered. In the Republic of Macedonia the competent authority for issuance of this confirmation is the Central Register of the Republic of Macedonia.

2.2.7 The documents from sub item 2.2.2 must not be older than 6 (six) months calculated from the final deadline for submission of the offers calculated backwards.

2.2.8 If the country where the economical operator is registered does not issue the documents specified in sub item 2.2.2 or if they do not encompass all aforementioned cases, the economical operator can submit a statement verified at the competent authority (Notary Public).

Економска и финансиска состојба:

2.3 Competence for performing professional action

2.3.1 In order to prove the competence for performance of professional action, the economical operator should submit a document for registered activity as a proof that the economical operator is registered as physical person or legal entity for performance of the action related to the subject of the contract on public procurement, or proof that the economical operator belongs to an appropriate professional association in accordance with the regulations of the country where the economical operator is registered.

Минимално ниво(а) на стандарди:

2.4.1 The economical operator should meet the following minimal terms in order to qualify itself as competent for performance of the concerned contract on public procurement from the aspect of its economical and financial status.

— Revised balance sheet and profit and loss account.

2.4.2 If the economical operator performs the action in a period less than 3 years, the minimal term for establishing the economical and financial status is the economical operator to have fulfilled the term from sub item 2.4.1 in the years for which data exist.

2.4.3 The economical operator proves the fulfilment of the minimal term from sub item 2.4.1 or 2.4.2 by submitting the following documents:

— balance sheet report verified by the competent authority, i.e. revised balance sheet or extracts from the balance sheet report in cases when the publishing of the balance sheet is prescribed by law in the country where the economical operator is registered,

— statement from the overall operation of the enterprise (datum from the profit and loss account issued by the competent authority, i.e. revised profit and loss account), and where appropriate, from the operation in the area covered with the contract on public procurement for the last 3 financial years for which such information is available depending on the date when the enterprise was founded or started to operate and depending on the availability of such information.

2.4.4 If the balance sheet and the profit and loss account were subject to commercial revision, the economical operator can submit them as a proof that the economical operator fulfils the minimal term for establishing the economical and financial status, without being additionally verified by the competent authority.

2.4.5 If the balance sheet and the profit and loss account were not a subject to commercial revision, the economical operator shall submit them after being verified, i.e. issued by a competent authority as a proof that the economical operator fulfils the minimal term for establishing the economical and financial status. In the Republic of Macedonia the competent authority is the Central Register of the Republic of Macedonia.

2.4.6 The economical and financial competence of the economical operator can be supported by another entity, regardless of the legal connections between the economical operator and that entity. If the economical operator proves its economical and financial competence referring to the support from another entity, the economical operator is obliged to prove such support with valid proof that the entity shall put at disposal the appropriate financial funds to the economical operator. No effective verdict for participation in a criminal organization, corruption, fraud or money laundering should be pronounced against the entity providing the financial support.

2.4.7 If the economical operators submit an offer as a group of economical operators, the economical and financial status shall be proved by considering the resources of all members of the group. If the group of economical operators acts with the financial support of third entity, the economical and financial status shall be established in accordance with the aforementioned.

Техничка и професионална способност:

2.5.1 The economical operator should meet the following minimal terms in order to qualify itself as competent for performance of the concerned contract on public procurement from the aspect of its technical or professional competence:

— 1. The economical operator is obliged to have minimum 5 deliveries of goods from the same or similar type with the concerned procurement in the previous years,

— 2. The economical operator is obliged to have at disposal technical equipment, tools and laboratory for examination of the quality of the built-in equipment,

— 3. The economical operator is obliged to have technical staff and technical bodies for delivery and installation of the concerned procurement at disposal,

— 4. The economical operator is obliged to submit a proof for quality control with recognized competence, for testing the suitability of the products which was clearly established with the references to the specifications and standards,

— 5. The economical operator is obliged to provide training of the employees for handling the material,

— 6. Statement for technical and professional competence signed by authorised person,

— 7. Description and photographs of products, subject to delivery, whose credibility should be confirmed by the economical operator, if that is requested by the contracting body.

2.5.2 The economical operator proves the fulfilment of the minimal terms from sub item 2.5.1 by submitting the following documents:

— 1. List of main deliveries of goods from the same or similar type in the previous years, verified and signed by the responsible person, by enclosing minimum 5 confirmations for high-quality and timely delivery,

— 2. List of equipment and tool at the disposal of the economical operator and proof for the quality of the built-in equipment,

— 3. Statement with which the economical operator confirms the disposal of technical staff and personnel, by enclosing the list of engaged persons with data, qualifications, professional and technical competence, who shall be responsible for realization of the procurement,

— 4. The economical operator is obliged to submit certificates issued by competent authorities for quality control with recognized competence, for testing the suitability of the products which was clearly established with the references to the specifications and standards,

— 5. Statement that the economical operator will provide training of the employees for use of the equipment.

2.5.3 The documents from item 2.5.2 are prepared and signed by the economical operator without the need of verification by a competent authority.

2.5.4 The technical and professional competence of the economical operator can be supported by another entity, regardless of the legal connections between the economical operator and that entity. If the economical operator proves its technical and professional competence referring to the support from another entity, the economical operator is obliged to prove such support with valid proof that the entity shall put at disposal the appropriate technical and professional resources to the economical operator. No effective verdict for participation in a criminal organization, corruption, fraud or money laundering should be pronounced against the entity providing the technical or professional support.

2.5.5 If the economical operators submit an offer as a group of economical operators, the technical and professional competence shall be proved by considering the resources of all members of the group. If the group of economical operators acts with the technical and professional support from a third entity, or third entity, the technical and professional competence shall be established according to the aforementioned.

2.6 Quality system standards

2.6.1 The economical operator should meet the following standards in order to qualify itself as competent for performance of the concerned contract on public procurement from the aspect of the quality system standards:

Security requirements.

— Quality system ISO 9001-2000,

— Statement for manufacturer's compliance with EN,

— Submission of certificates which confirm the quality and security of the installed equipment and materials: CE quality mark, accompanied with EC statement from the manufacturer,

— Meeting the security requirements, according to the valid regulation of the Republic of Macedonia and the EN 13814 standard,

— Technical check before putting into use.

Manufacturer’s certificates for:

— electromotor,

— electrical lighting equipment,

— electrical management equipment,

— built-in security equipment,

— built-in construction material,

— welded joints,

— for the used colour.

Other important elements.

— Security marks,

— Instructions (manual) for product use,

— Maintenance instructions,

— Installation, certificates for the installers,

— Training of the staff for handling and acting in case of incidents,

— Providing service and spare parts.

2.6.2 The economical operator proves the fulfilment of the standards from sub item 2.6.1 by submitting the following documents:

— Certificate CE quality mark, accompanied with EC statement from the manufacturer and EN 13814 standard.

Потребни депозити и гаранции:

4.6 Guarantee of the offer

4.6.1 As a part of the offer, the economic operator is obliged to provide a guarantee of the offer (guarantee of participation) in the amount of at least 3.00 % of the total value of the offer without VAT.

4.6.2 The guarantee is in the form of bank guarantee, issued by a reputable banking institution chosen by the economic operator. All the banks are acceptable for the contracting authority.

4.6.3 The guarantee should be submitted in the original form. The copies are not accepted. The guarantee has to be valid for at least 14 days from the expiry date of the offer. Every offer that does not contain a guarantee of the offer, or contains guarantee of the offer which is not in accordance with the conditions of the tender documentation, will be rejected by the contracting authority as unacceptable.

4.6.4 The guarantee of the offer of the unsuccessful economic operators is returned within 7 days after signing the contract with the most favorable economic operator.

4.6.5 The guarantee of the offer may be settled, if the economic operator has withdrawn the offer before the expiration period of the validity, does not accept the correction of arithmetical errors by the Commission, does not sign the contract on public procurement and does not provide a guarantee for high quality performance of the contract.

7.4 Advance payment

7.4.1 To perform the public contract in accordance with PPL karosel provided an advance payment of up to 20 % of the value of the signed agreement.

7.4.2 Prior to the advance payment of item 7.4.1 require a bank guarantee from the contractor the agreed advance.

7.5 Guarantee for high quality performance of the contract

Condition for signing the contract with the selected most favorable bidder is providing a guarantee by the selected most favorable bidder for high quality performance of the contract in the amount of 5.00 % of the contract value.

7.5.1 The guarantee from item 1.1 is delivered in writing in the form of bank guarantee. The guarantee should be submitted in the original form. Copies are not accepted.

7.5.2 The guarantee of high quality performance of the contract will be valid until the full implementation of the contract. The contracting authority after the selection of the most favorable bidder, additionally shall establish the final date of validity of the guarantee.

7.5.3 The bank guarantee of high quality performance of the contract will be in the currency, in which the contract is stated.

7.5.4 The guarantee of high quality performance of the contract should be issued by a bank acceptable to the contracting authority pursuant to item 4.6.2 of the tender documentation.

7.5.5 The guarantee of high quality performance of the contract, the selected most favorable bidder shall submit with the signing of the contract pursuant to item 6.4.2 of the tender documentation.

7.5.6 The guarantee of high quality performance of the contract shall be submitted within the specified period together with the signed and certified contract, as follows: by mail.

7.5.7 The guarantee of high quality performance of the contract will be settled, if the holder of the procurement does not meet some of the obligations of the public procurement contract within the due date.

7.5.8 In case of non completion of some of the contract obligations as agreed, the contracting authority shall notify in writing the holder of the procurement that shall settle the bank guarantee of high quality performance of the contract.

7.5.9 If the contract is fully implemented as agreed, the contracting authority shall return the bank guarantee of high quality performance of the contract to the holder of the procurement within 14 days of the complete implementation of the contract.

7.5.10 The guarantee of high quality performance of the contract the contracting authority shall return to the holder to procurement by mail, personally at the headquarters of the economic operator or personally in the head office of the contracting authority.

— publication of the announcement on awarding a public procurement contract in terms of data, actions or failures to undertake actions from the announcement,

— opening of the offers in relation to actions or failures to undertake actions related to the tender documentation, i.e. the procedure on the public opening of offers,

— admission of the decision that determines the individual right on the procedure on awarding public procurement contract, in terms of determining the ability of applications for participation or evaluation of the offers and the decision or,

— knowledge of the unlawful conduction of the procedure on awarding a public procurement contract, at latest 1 year from the completion day of the conducted procedure.
