The offer can be posted, delivered at the Archive of the Ministry of Justice, Directorate for Executing of Sanctions, str. Dimitrie Chupovski no.9, Skopje, Republic of Macedonia or submitted to the Committee of Public Procurement, at the same day and hour defined as Tender opening event. Offers could be submitted only by the vendors that have picked up the tender documentation from the contracting authority. The offer is to be submitted in one original sample, that should be sealed and signed (each page) by the economic operator. Note: The economic operator that picked up tender documentation, can visit the location – at least 6 days before the deadline of tender submission. The term of location visit will be agreed additionally with the Directorate for Executing the Sanctions.

For proving personal status, the economic operator should provide following documents:

— statement of the economic operator that he was not subject to court verdict in effect in the last five years for involvement in criminal organization, corruption, fraud or money laundering,

— confirmation that no liquidation procedure was opened by relevant authority,

— confirmation that he is not subject to bankruptcy or liquidation procedure,

— confirmation for clearance regarding paid taxes, contributions and other public duties issued by the relevant authority in the country where the economic operator is registered,

— confirmation from the register of sanctions for criminal acts of legal entities that he was not subject to court verdict temporary penalty -…

… prohibition for performing acts of public call, awarding public procurement contracts and contracts for public private partnership,

… interim or permanent prohibition for performing of specific activity,

— confirmation that he is not subject to imposed misdemeanor sanction – prohibition from performing the profession, activity or duty i.e. interim prohibition for performing specific activity.

In order to qualify as capable for realization of the contract for public procurement from the aspect of his professional activity, the economic operator have to meet the following requirements:

— to be registered for performing the activity related to the subject of the public procurement contract,

— to have licence A for constructor for executing construction works of first category, issued by the Ministry of Transport and Communication.

In order to prove his capacity for realization of the professional activity, the economic operator submits the following documents:

— document for registered activity – DRD form, as proof that he is registered as legal entity for performing the activity related to the subject of the public procurement contract, or proof that he is member of the relevant professional association, in accordance with the regulations of the country of registration. In the Republic of Macedonia the relevant authority to issue this document (DRD form) is the Central Register of Republic of Macedonia,

— certified copy of licence A for constructor for executing construction works of first category issued by the Ministry of Transport and Communication.

Економска и финансиска состојба:

In order to qualify as capable for realization of the subject of the public procurement contract, from the aspect of his economic and financial status, the economic operator has to meet the following conditions:

— at least 150 000 000,00 MKD total turnover of funds in 2007, 2008 and 2009, in the area related to the subject of the public procurement contract.

The economic operator proves that he meets the above mentioned requirement by providing:

— statement for realized total turnover of funds in: 2007, 2008 and 2009.

Техничка и професионална способност:

1. In order to qualify as capable for realization of the contract for public procurement from the aspect of his technical capacity, the economic operator has to meet the following requirements:

— reference list of executed works at facilities of building construction in 2008, 2009 and 2010 with the subject and the number of the contract, name and address of the investor, duration, date of realization and the contract value,

— to provide at least two certificates for facilities from the reference list for satisfactory construction of building construction in 2008, 2009 and 2010 issued by the investors. the certificates are issued for timely, qualitative and according the law executed work by the offerer, which unit price is not less than 20 000 000,00 MKD,

— to have professional team of experts from the appropriate branches, i.e. minimum employed experienced staff consisted of:

— one chief site engineer (architectural or civil profession) with licence A,

— one engineer with architectural vocation with licence A,

— one engineer from civil engineering with licence A,

— one electrical engineer with licence A,

— one mechanical engineer with licence A,

— one geodesic engineer or geometer with at least five years working experience in operative department,

— to have at least seventy (70) employed persons from the constructing branch, with full working time,

— the economic operator should have technical equipment and construction machinery for executing the construction works,

— the economic operator to dispose with laboratory for testing the quality of the built-in materials, according the technical norms and standards.

2. The economic operator proves the realization of the conditions from item 1 by providing:

— reference list of executed works at facilities of building construction in 2008, 2009 and 2010, noted subject and number of the contract, name and address of the investor, duration, date of realization and the contract value,

— certificates for two facilities from the reference list for satisfactory construction of building construction issued by the investors. The certificates are issued for timely, qualitative and according the law executed work by the offerer,

— copies of the licenses for the professional staff that is engaged in the construction,

— statement from the economic operator for the engaged professional team of professionals from the appropriate branches, that will be responsible for realization of the procurement,

— statement for the number and the qualification structure of the persons that will be included in the realization of the procurement,

— submit a list of the available technical equipment and construction machinery that will be available during the duration of the Contract in a case the Contract to be awarded to him,

— statement that the economic operator has laboratory or to submit Contract with authorized Laboratory for testing the quality of the built-in materials.

3. The technical and professional capacity of the economic operator can be supported by other entity, regardless of the business relations and the legal links between the economic operator and that entity. If the economic operator is proving his technical and professional capacity by referring to support by another entity, he is obliged to prove the support with valid proof that that entity will make available to the economic operator the necessary technical and professional resources. The entity that expresses the technical or professional support must not be subject to legal verdict in effect for involvement in criminal organization, corruption fraud or prevention of money laundering.
