The contracting authority shall exclude from the procedure for awarding a public procurement contract, any economic operator that:

— within the last 5 years has had a legally effective judgment pronounced against him/her for participation in a criminal organization, corruption, fraud or money laundering,

— has been sentenced with a secondary penalty involving…

… prohibition to participate in public bidding procedures, to be awarded public procurement contracts or contracts for public private partnerships,

… temporary or permanent prohibition to perform a specific activity,

— is subject to a bankruptcy procedure or a liquidation procedure,

— has unpaid taxes, contributions or other public dues,

— has a misdemeanor sanction involving prohibition to perform a profession, activity or duty, or prohibition to perform a specific activity, imposed against him/her and,

— gives false information or fails to submit the data requested by the contracting authority.

To prove his/her personal circumstances, the economic operator shall submit the following documents:

— Statement of the economic operator that, within the last 5 years, he/she has not had any legally effective judgment for participation in a criminal organization, corruption, fraud or money laundering, pronounced against him/her,

— Confirmation that he/she is not subject to a…

… bankruptcy procedure opened by a competent authority,

… liquidation procedure opened by a competent authority,

— Confirmation of paid taxes, contributions and other public dues issued by a competent authority in the country where the economic operator is registered,

— Confirmation from the Registry of penalties for criminal offences committed by legal persons, that there is no secondary penalty imposed against him/her involving…

… prohibition to participate in public bidding procedures, to be awarded public procurement contracts or contracts for public private partnerships,

… temporary or permanent prohibition to perform a specific activity,

— Confirmation that there is no legally effective judgment imposing a misdemeanor sanction involving prohibition to perform a profession, activity or duty, that is, temporary prohibition to perform a specific activity, imposed against him/her.

Економска и финансиска состојба:

— Balance sheet / income statement notarized by a competent authority for the amount of 30 000 000 denars over the past 3 years.

Минимално ниво(а) на стандарди: — Total revenue of 30 000 000 denars over the past 3 years.
Техничка и професионална способност:

— List of major deliveries of the bidders performed over the past 3 years, including values, dates and buyers, from which it may be seen that until now at least 3 years DSNG broadcast vehicles with the same or similar features have been delivered,

— Statement that a warranty for technical functionality for a period of no less than 36 months will provided with the delivery of the DSNG broadcast vehicle,

— Statement that servicing and spare parts for the DSNG broadcast vehicle will be provided for a period of 5 years after the expiration of the warranty.

Минимално ниво(а) на стандарди:

— The bidder shall have previous experience of delivering at least 3 years DSNG broadcast vehicles with same or similar features over the past 3 years,

— The bidder shall provide warranty of technical functionality for the DSNG broadcast vehicle for a period of no less than 36 months from the date of delivery,

— The bidder shall provide servicing and spare parts for a period of 5 years after the expiration of the warranty.

Извршување на договорот
Потребни депозити и гаранции:

— As part of the bid, the economic operator shall provide a bid guarantee (guarantee for participation) in the amount of at least 3 % of the total bid value excluding VAT,

— In order to sign the contract with the selected most favorable economic operator, the successful bidder shall be required to provide a contract performance bank guarantee in the amount of 5 % of the contract value.

Any economic operator that has a legal interest to win the public procurement contract and that suffered or could have suffered damages related to potential breach of the provisions of the Law on Public Procuremet, may seek legal protection against the decisions, actions, or failure to undertake actions on the part of the contracting authority in a procedure for awarding a public procurement contarct.

— The complaint shall be submitted within eight days from the day of,

— Publication of the advertisment of the public procurement contract award with respect to the data, actions or failure to undertake actions related to the advertisment,

— Opening of the bids, with respect to actions or failure to undertake actions with reference to the tender documentation, or the bid opening procedure,

— The deadline for a decision to elect or annul the proceedings under Article 162 paragraph 2 of this law regarding the admission of a decision to elect or annul the proceedings in the relevant period,

— Reception of the decision about an individual right related to the procedure for awarding a procurement contract with regard to the determination of the capability of the application or the evaluation of the bids or,

— Findings about irregularities in the course of the procedure fior awarding a public procurement contract, within one year from the day when the procedure was concluded.
