Any bidder shall be excluded from the procedure for awarding a PPP contract by the Public Partner if it (he):

— in the last 5 years has been rendered a final decision for participation in a criminal organization, corruption, fraud or money laundering,

— is in the process of bankruptcy or liquidation proceedings,

— has unpaid taxes, contributions and other duties,

— has been sentenced sanction - ban on performing profession, activity or duty, i.e. temporary prohibition for performing certain activities,

— has been sentenced additional punishment - ban on participation in procedures for public announcement, the award of public supply contracts and public private partnership,

— has been sentenced additional temporary or permanent prohibition to perform certain activities; and,

— gives false information or does not submit the data required by the public partner.

In order to prove its (his) standing, the bidder (legal entity) shall submit the following documents:

— Bidder's statement that in the last 5 years it was pronounced verdict for participation in a criminal organization, corruption, fraud or money laundering,

— Confirmation that there is no bankruptcy proceedings by the competent authority,

— Confirmation that there is no procedure for liquidation by a competent authority,

— Certificate for paid taxes, contributions and other public duties by the competent authority,

— Confirmation that it was not sentenced the sanction – ban to perform professional activity or duty, i.e. temporary prohibition for performing certain activity,

— Certificate of the Register of penalties for criminal acts committed by legal entities that has been imposed minor penalty…

… ban for participation in procedures for public announcement, the award of public supply contracts and public private partnership,

… temporary or permanent prohibition of certain activities.

If the bidder is an individual, he must proof his personal statement submitting documents in line 1, 4 and 5 of paragraph 1 of this sub-item.

The statement in line 1 of item 16.2.2. shall be prepared and signed by the bidder and it need not be certified by a competent authority.

If the bidder is an individual, the statement has to be notarized.

Confirmation that there is no bankruptcy procedure initiated, as well as certificates from the register of penalties for criminal acts issued by the competent authorities in the country the bidder is registered in. In the Republic of Macedonia, the competent authority for issuing these certificates is the Central Register of the Republic of Macedonia.

Confirmation of paid taxes, contributions and other public duties, issued by a competent authority in the country the bidder is registered in. In the Republic of Macedonia, the competent authority for issuing such certificates is the public revenue administration.

Certificates from line 5, 6 and 7 of sub-item 16.2.2. issued by the competent authority in the country the bidder is registered in. In the Republic of Macedonia, the competent authority for issuing these certificates is the Central Register of the Republic of Macedonia.

The documents stipulated in item 16.2.2. must not be older than 6 (six) months from the deadline for submission of bids.

If the country the bidder is registered in does not issue the documents referred to in item 16.2.2 or if they do not include all the above cases, the bidder may submit a statement certified by a competent authority.

Економска и финансиска состојба:

The bids of the bidders which in any of the last 3 years showed loss or did not realize the minimal total turnover per annum for each year separately shall be considered unacceptable and will not be evaluated.

If the bidder performs activities for a period less than 3 years, the minimum requirement of proof of economic and financial statement is the economic operator has achieved the requirement of sub-item in the years for which data are available.

To prove the economic and financial statement, the bidder (legal entity) shall submit:

— Report on the balance sheet and income statement for the last 3 years. (2008, 2009 and 2010), certified by a competent authority, i.e. audited balance sheet and income statement, or extracts from the balance sheet and income statement in cases where publication of balance sheet and income statement is prescribed by law in the country the economic operator is registered in.

If the balance sheet and income statement have been subject to commercial audit, the bidder may submit them as proof that it meets the requirement for determining the economic and financial capability without having to be further verified by the competent authority.

… standing, the bidder (legal entity) may refer to the ability of other entities, including the ability of members of a joint tender (consortium of bidders), regardless of the legal nature of the relationships with them.

… capacity, the bidder (individual) must refer to the ability of another party (legal entity).

Economic and financial capacity of the bidder may be supported by another entity, regardless of the legal relations between the bidder and that entity. If the bidder proves its economic and financial capacity referring to support from another entity, it is obliged to prove the support with a valid proof that the entity will make available to the bidder's relevant financial assets. The entity providing the financial support must not be rendered verdict for participation in a criminal organization, corruption, fraud or money laundering.

If bidders submit a bid as a group of bidders (consortium), the economic and financial ability is proven by taking into account the resources of all the members of the consortium. If you participate in a consortium with financial support from a third party, the economic and financial standing are determined according to the foregoing.

Минимално ниво(а) на стандарди:

To qualify as able to perform the contract for public/private partnership in terms of its economic and financial statement, the bidder must prove that in the last 3 (three) years (2008.2009 and 2010) it did not show loss from operation and each year individually achieved total turnover in the minimum amount of 12 000 000,00 EUR. (exchange of denars into euros shall be made in accordance with the official exchange rate of the National Bank of Macedonia, and the exchange rates are those that were applicable 14 days before the deadline for submission of the bids).

Техничка и професионална способност:

The bidder shall prove the fulfillment of minimum requirements by submission of:

— A certified copy of the license B for performance of construction,

— A certified copy of the license B for design,

— Reference list of completed works in last 5 years in construction (higher education) and,

— Reference list of services rendered in the last 3 years in the domain of design of construction.

In case the bidder is a consortium, the technical and professional ability shall be proven by taking into account the resources of all members of the consortium.

If the bidder (legal entity or natural person) is not licensed for designing/building, it should submit contracts with one or more legal entities that have a license for designing / building, as a proof that that/ those legal entities will perform designing services, i.e. that will perform construction works subject to the PPP project as a subcontractor(s).

Минимално ниво(а) на стандарди:

In order to be qualified as capable for performing the contract in terms of its technical and professional ability, the bidder (legal entity) must:

— be licensed to perform construction,

— be licensed to design buildings and,

— have adequate experience in designing and performance of buildings.

Note: if the bidder is not registered for performing activities in the field of construction or designing of buildings, technical and professional ability will be proven with the support of other entities, i.e. with engagement of contractors that are licensed to perform the activity in these areas, according to Item 6 of the tender documentation.

Bid bond 2 % of the estimated value or 253 026,00 EUR and guarantee of timely and quality execution of the contract-performance bond 2.5 % of the estimated value or 316 281,00 EUR.

The Public Private Partnership shall be realized with joint construction of an administrative commercial facility and an underground parking space of item 1 of this open call, where the Municipality of Gjorce Petrov shall acquire title on the administrative premises being 40 % or 2/5 ideal portion with gross area of 6,000 m

In return for the invested financial assets, the private partner acquires property benefit, or it shall acquire title on an ideal portion of the construction facility with gross area of 9 000 m

The financing and the construction of the administrative-commercial facility and the underground parking space area of item 1 of this open call shall be on the account and risk of the private partner.

The tender documentation can be picked up at the reception office of the Municipality of Gjorce Petrov, Gjorce Petrov Str. b.b., 1060 Skopje, Republic of Macedonia, every working day.
