Минимално ниво(а) на стандарди:

— the bidder of the specialised vehicles should have experience in delivering a minimum of 10 specialised vechicle with the same or similar characteristics, in the last 5 years,

— the bidder of the recording equipment should have experience in the delivery of recording equipment with the same or similar characteristics in the last 3 years,

— the bidder of the specialised vehicles should provide guarantee for technical functionality of the specialised vechicle for a period of not less than 36 months from the date of delivery,

— the bidder of the recording equipment should provide guarantee for the technicall of technical functionality of the recording equipment, for a period of not less than 24 months from the date of delivery,

— the bidder of the specialised vehicles should provide service and spare parts for a period of 5 years after expiry of the guarantee for technical functionality,

— the bidder of recording equipment should provide service and spare parts for a period of 5 years after expiry of the guarantee for technical functionality.

6.3 Legal protection.

6.3.1 Any economic operator that has a legal interest to win the public procurement contract and that suffered or could have suffered damages related to potential breach of the provisions of the Law on Public Procurement, may seek legal protection against the decisions, actions or failure to undertake actions on the part of the contracting authority in a procedure for awarding a public procurement contract.

6.3.1 The complaint shall be submitted within eight days from the day of:

— publication of the advertisement of the public procurement contract award with respect to the data, actions or failure to undertake actions related to the advertisement,

— opening of the bids, with respect to actions or failure to undertake actions with reference to the tender documentation, or the bid opening procedure,

— reception of the decision about an individual right related to the procedure for awarding a procurement contract, with regard to the determination of the capability of the applications for participation or the evaluation of the bids or,

— findings about irregularities in the course of the procedure for awarding a public procurement contract, within one year from the day when the procedure was concluded.

6.3.2 The economic operator that failed to file a complaint with respect to the provisions stipulated in item 6.3.1, shall not have the right to an appeal in a later stage of the procedure for the same legal basis.

6.3.3 The complaint should contain the following elements:

— information about the petitioner of the complaint (first and last name, name of the economic operator, address of stay and headquarters),

— information about the representative or the authorized agent,

— name and headquarters of the contracting authority,

— number and date of the procedure for awarding a public procurement contract and information about the advertisement for the public procurement award,

— number and date of the decision for selection of the most favorable bid, annulment of the procedure or other decisions of the contracting authority,

— information about the actions or failure to take actions on the part of the contracting authority,

— description of the factual situation,

— description and explanation of the irregularities,

— proposed evidence,

— claim of the complaint and/or claim for compensation of costs of the procedure and,

— signature of the authorized person and seal.

6.3.4 The petitioner of the complaint shall be obligated to submit a proof of payment of the fee for implementation of the procedure.

6.3.5 The petitioner of the complaint whose headquarters is not on the territory of the Republic of Macedonia shall be obligated to determine an authorized agent to receive writs.

6.3.6 The complaint shall be lodged with the State Commission. The complaints shall be filed in person or by registered mail to both the contracting authority and the State Commission. The day when the complaint is sent by registered mail shall be deemed as the day the complaint was submitted. In case the complaint is submitted in person, the contracting authority shall be obligated to issue to the economic operator a receipt confirming that the time the complaint was received.

6.3.7 In the procedure before the State Commission, the petitioner of the complaint shall, in addition to the administrative fee, be liable to pay a fee for implementing the procedure depending on the level of the bid, as follows:

— for a bid value of up to the denar equivalent of 20 000 EUR, the fee shall be the denar equivalent of 100 EUR,

— for a bid value of the denar equivalent of…

… 20 000 to 100 000 EUR, the fee shall be the denar equivalent of 200 EUR,

… 100 000 to 200 000 EUR, the fee shall be the denar equivalent of 300 EUR,

… more than 200 000 EUR, the fee shall be the denar equivalent of 400 EUR.

6.3.8 In case when there is no bid, the level of the fee for implementation of the procedure shall be calculated on the basis of the estimated value of the public procurement, and the State Commission shall inform the petitioner of the complaint about the level of the fee and the deadline in which the petitioner needs to submit proof of payment of the fee.

6.3.9 The fee for implementation of the procedure shall be a revenue of the Budget of the Republic of Macedonia.
