- Statement by the economic operator that it has not been announced, in the last 5 years, effective court decision for participation in criminal organization, corruption, fraud or money laundering;

- Certificate that it is not subject to bankruptcy procedure issued by competent authority;

- Certificate that it is not subject to liquidation procedure issued by competent authority;

- Certificate for paid taxes, contributions and other public duties by the competent authority in the country where that economic operator is established;

- Certificate from the Register of penalties for committed criminal acts of legal entities that a minor penalty…

… temporary or permanent ban on performing certain activity has not been imposed.

- Certificate that it is being announced sanction for misdemeanor with an effective court decision, resulting in prohibition for pursuing professional activity or duty, i.e. temporary prohibition for performing professional activity.

- For the purpose of proving the suitability for pursing professional activity, the economic operator shall present relevant document for registered activity in order to prove it is registered as natural or legal person to carry out the activity related to the subject-matter of the public contract.

Економска и финансиска состојба:

- Balance sheets certified by a competent authority i.e. audited balance sheets, or extracts from the balance sheet, where publication of the balance sheets is required under the Law of the country in which the economic operator is established; (for the last three years);

- Statements regarding the overall turnover of the undertaking (information from the profit and loss account issued by a competent authority i.e. audited profit and loss account) and where applicable, regarding the turnover in the field of activity covered by the public procurement contract, for the last 3 fiscal years as the most for which such information is available, depending on the date on which the undertaking was established or started operating, and depending on the availability of such information; (for the last 3 years);

- Auditors reports for the Foreign Tenderer, which shall be positive and shall be issued by foreign well known institution, registered for performing audit. Auditor reports should contain data for the overall economic operation of the Foreign Tenderer; (for the last 3 years);

- Minimal annual revenue of 1 000 000 EUR/year, calculated as total certified payments received from contracts in progress or completed (construction works), within the last three (3) years.

Техничка и професионална способност:

- List of works executed in the past 5 (five) years by enclosing statement for good performance according to the tender documentation;

- Educational and professional qualifications of the economic operator, or to its management personnel, especially of the persons in charge of executing the respective works according to the tender documentation;

- Technical equipment and plants available to the economic operator for execution of the respective works according to the tender documentation;

- Statement by the Economic operator for average annual number of employs and for number of technical personal in the past 3 (three) years;

- Statement by the Economic operator for engage technical persons, especially for quality check, not taken into consideration whether the persons under the authority of the economic operator according to the tender documentation;

- copy of license (A) for contractor for carrying out works from first (I) category issued by the competent authority in the country according to the Law on construction (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12 and 144/12); valid for each member of the group if the offer is submitted from a group of economic operators (JV);

- copy of authorization (A) for Civil Engineers for construction of civil works, the Surveyor should posses authorization for surveying, issued by a competent authority in the country;

- Information about the elements of the contract that the economic operator intends to leave at sub-contractor;

a) General construction experience

- Time period as Contractor on construction works minimum (5) years;

- The Tenderer should posses license (A) for contractor for carrying out works from first (I) category issued by the competent authority in the country according to the Law on construction (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12 and 144/12); valid for each member of the group if the offer is submitted from a group of economic operators (JV);

- Persons proposed as key personnel for construction of the works should posses authorization (A) for Civil Engineers for construction of civil works, the Surveyor should posses authorization for surveying, issued by a competent authority in the country according to the Law on construction (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11 13/12 and 144/12);

- For foreign natural and legal persons according to the Law on construction, article 42 (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11 13/12 and 144/12).

b) Specific construction experience

- Necessary number of completed similar contracts: Successful experience in at least one (1) project for construction or reconstruction of state roads, of main (national) streets and boulevards in settlements and airports in the past 5 (five) years, which include construction of bridge, viaduct or overpass with length of min. 30m. with a minimal value of 1 000 000 EUR;

- Minimum 50 employs (present M1 and M2 forms which prove or appropriate form issued by a competent Authority in the country of domicil of economic operator).

c. Personnel: The key personnel for carrying out the works must meet the following minimum requirements (with indicated projects):

(i) Project manager - main engineer (1 grad. civil eng.) with at least 10 years working experience in the civil engineering area and at least 7 years experience at similar works, experience in construction of bridges, viaducts or overpasses;

(ii) Assistant for earth and concrete works: (1 grad. civil eng.) with at least 7 years working experience in the civil engineering area and at least 4 years experience at similar works;

(iii) Assistant for asphalt works: (1 grad. civil eng.) with at least 7 years working experience in the civil engineering area and at least 4 years experience at similar works;

(iv) Surveyor: (1 grad. geodetic eng.) with at least 5 years working experience in the civil engineering area;

d. Equipment: The Tenderer shall have the equipment in his ownership or he shall have ensured access (through rental, lease, contract for purchase) key equipment listed bellow, in full working condition and must demonstrate that based on the known commitments it will be available during construction. Also the Tenderer should indicate the remaining equipment which will be used for realization of the contract. For the equipment which is not tenderer ownership will submit valid evidence (contracts, agreements and approvals), that this kind of equipment and capacities are available during the time period of the Contract.

The tendrer should posses or to have ensured access to the following key equipment (list of evidence for ownership):

(i) Equipment for earth excavation with total capacity not less than 500m3/day

(ii) Asphalt plant with total production capacity not less than 50t/hour, at maximum distance from the construction site of 150 km.

(iii) Concrete plant/s with total production capacity not less than 30m3/hour.

(iv) Paver for asphalt layers – 1 pcs.

(v) Transportation vehicles, motograders, compacters (for earth and asphalt works), loaders.
