- Certificate from the Register of penalties for committed criminal acts of legal entities that a minor penalty…

… ban on participation in procedures for public announcements, awarding of public procurement contracts and contracts for public private partnership has not been imposed;

… temporary or permanent ban on performing certain activity has not been imposed;

- Certificate that it is being announced sanction for misdemeanor with an effective court decision, resulting in prohibition for pursuing professional activity or duty, i.e. temporary prohibition for performing professional activity;

- Document for registered professional activity.

Економска и финансиска состојба:

- Balance sheets certified by a competent authority i.e. audited balance sheets, or extracts from the balance sheet where publication of the balance sheets is required under the Law of the country in which the economic operator is established; (for the last 3 years);

- Statements regarding the overall turnover of the company (information from the profit and loss account issued by a competent authority i.e. audited profit and loss account) and where applicable, regarding the turnover in the field of activity covered by the public procurement contract, for the last three fiscal years as the most for which such information is available, depending on the date on which the company was established or started operating, and depending on the availability of such information; (for the last three years).

- Auditors reports for the Foreign Tenderer, which should be positive and should be issued by foreign well known institution, registered for performing audit. Auditor reports should contain data for the overall economic operation of the Foreign Tenderer; (for the last 3 years).

- Minimal annual revenue of 2 000 000 EUR/year calculated as total amount certified payments received from contracts in progress or completed (construction works), within the last 3 years.

- The tenderer must demonstrate financial abilities to satisfy the minimum necessary flow of cash assets in amount of 500 000 EUR, needed for continuous performance of the works until the payment of the Interim payment certificates for executed works. (as acceptable document will be considered Letter of intent or credit line confirmed by a Bank that work under commercial terms).

Техничка и професионална способност:

- List of works executed in the last 5 (five) years by enclosing statements for good performance according to the tender documentation;

- Educational and professional qualifications of the economic operator, or to its professional personnel, especially of the persons in charge of executing the respective works according to the requirements in the tender documentation;

- Technical equipment and plants available to the economic operator for execution of the respective works according to the requirements in the tender documentation;

- Statement of the economic operator about the average annual number of employees and the number of the technical personnel for the last 3 years

- Statement for engaged technical personnel and technical bodies, especially for those responsible for control of the quality, regardless if they directly belong to the economic operator (according to the requirements in the Tender Documentation)

- copy of license (A) for contractor for carrying out works from first (I) category issued by the competent authority in the country, according to the Law on construction (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12 and 144/12); valid for each member of the group if the Tender is submitted from a group of economic operators (JV);

- copy of authorization (A) for the Civil Engineers for construction of civil works, issued by competent authorities in the country;

- Information about the elements of the contract that the economic operator intends to sub-contract.

a) General experience

- Time period as Contractor on civil engineering area minimum five (5) years;

- The Tenderer should posses license (A) for contractor for carrying out works from first (I) category issued by the competent authority in the country according to the Law on construction (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12 and 144/12); valid for each member of the group if the Tender is submitted as a group of economic operators (JV) – copy of license (A) for contractor for carrying out works from first (I) category.

- Persons proposed as key personnel for construction of the structure in subject should possess authorization (A) for Civil Engineers for construction of civil works, issued by competent authorities according to the Law on construction (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12 and 144/12) – proof-copy of authorizations (A) for Civil Engineers for construction of civil works;

- For foreign natural and legal persons according to the Law on construction, article 42 (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12 and 144/12).

b) Specific construction experience

(i) Necessary number of performed similar contracts: Successful experience in at least one (1) contract for construction, reconstruction or rehabilitation of state roads, at main (national) streets and boulevards in populated areas and airports in the period of the past five (5) years with a minimal value of 1 000 000 EUR.

- Minimum 70 employees (to enclose M1 and M2 forms for employment as evidence or appropriate form issued by competent institution in the resident country of the Economic Operator).

c) Personnel: The key personnel for carrying out the works must meet the following minimum requirements (with indicated structures):

(i) Project manager – Responsible engineer (1 graduated civil engineer) should have at least 10 years working experience in the civil engineering area, at least 7 year experience at similar works, 3 years as Project manager for structures;

(ii) Assistant for earth and concrete works (1 graduated civil engineer): should have at least 7 years working experience in the civil engineering area, 3 year experience at similar projects;

(iii) Assistant for asphalt works (1 graduated civil engineer) should have at least 7 years working experience in the civil engineering area, 3 year experience at similar projects;

(iv) Surveyor: should have at least 5 years working experience in the civil engineering area and experience in road projects;

d) Equipment: The Tenderer shall have the equipment in his ownership or he shall have ensured access to (through rental, lease, contract for purchase or similar) key equipment listed below, in full working condition, and must demonstrate that based on the known commitments it will be available during the realization of the proposed contract. Also the Tenderer should indicate the remaining equipment which he will use for realization of the contract. For the equipment which is not tenderer ownership, the Tenderer will submit valid evidence (contracts, agreements, approvals), that this equipment and capacities are available during the duration of the Contract.

The Tenderer should possess or to have ensured access to the following key equipment (list of evidence for ownership):

(i) Machines for earth excavation (excavators and smaller bulldozers) with total capacity not less than 200m3/ day, and not older than 15 years;

(ii) Asphalt plant/s with total production capacity not less than 80t/hour, at maximum distance (range) from the structure of 150km;

(iii) Paver for asphalt placing no.1, not older than 10 years;

(iv) Asphalt scrapping machine no.1 (of 1 000-2 000 mm);

(v) Rollers (2 pieces rubber and 2 pieces steel), not older than 15 years);

(vi) Transportation vehicles, graders, loader;

(vii) Asphalt laboratory completely equipped (list of equipment) for entire quality control of the works according to the technical specifications.
