Subject of the Procurement Contract is construction and reconstruction of facilities within the complex of the Penitentiary-Correctional Institution “IDRIZOVO” (Municipality Gazi Baba, Skopje) as follows:
1. Demolition of existing facilities 10.400 m² - existing gross area.
2. Construction of facilities in the Open Section – male GP 1.5 (building 1.5.1, 1.5.2 и 1.5.3) – 5.550 m²
3. Construction of facilities in the Semi-open Section – male GP 1.6 (building1.6.1 и 1.6.2) – 4.650 m²
4. Reconstruction of the existing Administration building GP 1.8
(building1.8.1) – 1.000 m²
5. Reconstruction of the existing restaurant with a Training Center GP
1.10 (building 1.10.1) – 500 m²
6. Construction of waste water treatment plant 2000 E.I – GP 1.18
7. Construction of linear infrastructure constructions, as follows:
— Water supply infrastructure;
— Sewage waste water (faecal and storm water sewage network);
— Electricity distribution and public lighting;
— Telecommunication infrastructure;
— Hot water infrastructure;
— Transport infrastructure.
8. Setting security fences – prefabricated reinforced concrete walls and wire fences.
9. Geodetic report to mark the designed construction.
10. Preparation of project built.

The deadline for submission of requests to participate is 18.2.2013, until 14:00. The requests for participation shall be submitted to the Ministry of Justice – Directorate for Execution of Sanctions, with headquarters at the following address: St. Yuri Gagarin” No.15 –1000 Skopje. The request to participate that is submitted after the submission deadline shall be rejected as late and will be returned to the economic operator unopened. The request to participate could be submitted only by the economic operators that have picked up the tender documentation from the contracting authority.

To prove its personal standing, the Economic operator shall provide the following documents:

— Statement from the economic operator that he was not subject to final court verdict in the last five years for involvement in criminal organization, corruption, fraud or money laundering;

— Confirmation that no liquidation procedure was opened by relevant authority;

— Confirmation that no bankruptcy procedure was opened against it by competent authority;

— Confirmation on paid taxes, contributions and other public charges from the competent authority in the country of registration of the economic operator;

— Confirmation from the Register of sanctions for criminal acts of legal entities that he was not subject to final court verdict temporary…

… penalty-prohibition to perform acts of public call, awarding public procurement contracts and contracts for public private partnership;

… penalty –interim or permanent prohibition for performing specific activity

— Confirmation that he is not subject to imposed misdemeanor sanction – prohibition from performing of the profession, activity or duty i.e. interim prohibition for performing of specific activity.

In order to qualify as capable for realization of the contract for public procurement from the aspect of his professional activity, the economic operator has to meet the following requirements:

— to be registered for performing the activity related to the subject of the public procurement contract;

— to have License A for constructor for executing construction works of first category, issued by the Ministry of Transport and Communications;

In order to prove his capacity for realization of the professional activity, the economic operator submits the following documents:

— Document for registered activity – DRD form, as proof that he is registered as legal person for performing of the activity related to the subject of the public procurement contract, or proof that he is member of the relevant professional association, in accordance with the regulations of the country of registration. In the Republic of Macedonia the relevant authority to issue this document (DRD form) is the Central Register of Republic of Macedonia;

— Certified copy of License A for constructor for executing construction works of first category issued by the Ministry of Transport and Communications.

In the Republic of Macedonia, a foreign legal entity may perform works of designing, review, construction and supervision prescribed in this Law, if they obtain confirmation for performing the above works by the authorized body of the state administration responsible for carrying out activities in the field of spatial organization. www.mtc.gov.mk

Економска и финансиска состојба:

To qualify capable to execute the subject of the public procurement contract from its economic and financial capacity, the economic operator shall meet the following minimum conditions:

— A minimum annual turnover of financial assets of the economic operator of at least 25 million EUR in Denars equivalent in the last three years (2009, 2010 and 2011), expressed for each year separately.

— A positive financial work (profit) in the last three years (2009, 2010 and 2011), expressed for each year separately.

— A minimum amount of liquid assets and/or assets from credit to be 1,000,000.00 EUR.

The economic operator proves that he meets the requirements by providing:

— Balance sheets certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance sheet is required under the law of the country where the economic operator is registered for the last three years (2009, 2010, 2011) expressed for each year separately.

— Bank statement for the overall turnover (data from the income statement issued by the competent authority, i.e. audited balance sheet) for the last three financial years (2009, 2010 and 2011), expressed for each year separately.

— Statement for the balance sheets and data from the income statement issued by the competent authority, for the last three financial years (2009, 2010 and 2011), expressed for each year separately, as prove to meet the requirement;

— Confirmation from the bank for credit and/or statement of account, as prove to meet the requirement.

Техничка и професионална способност:

To be qualified capable of performing the referred public procurement contract from the aspect of its technical and professional capability, the Economic Operator should meet the following minimum conditions:

Minimum three contracts realized in the last 5 years of construction works of buildings of high construction, out of which at least one contract realized of specific construction experience in prison construction, that comply with EU standards, and are currently in full operation, which individual value is not less than 10 million EUR;

The economic operator shall have at least 300 employees of which at least 8 engineers from architectural, civil, electrical and mechanical profile;

To have professionals in the adequate fields with Authorization A for construction of buildings that will be engaged in the realization of the construction;

To have technical equipment and construction machinery for demolition, building and production of prefabricated reinforced concrete façade, partition walls, sanitary cabins etc.

The Economic Operator shall prove the fulfillment of minimum conditions stipulated by submitting:

Reference list of the constructed buildings of buildings of high construction in the last five years, with indication of works, subject and number of contract, name and address of the investor, duration, date of realization and contract value;

At least three contracts for construction of buildings in the last five years, out of which at least one contract realized of specific construction experience in prison construction, that comply with EU standards, and are currently in full operation with individual value no less than 10.000 000 EUR;

At least three references of successful implementation issued by the investors for whom construction of works of buildings of high construction were performed in the last five years and at least one reference of successful implementation of contract in prison construction, that comply with EU standards, and are currently in full operation, for appropriate, timely and quality performance of the work by the bidder, with individual value no less than 10.000 000 EUR;

Appropriate evidence from the Employment Agency of the Republic of Macedonia that the economic operator has at least 300 (three hundred) employees, or other appropriate evidence if the bidder is from abroad;

М1/М2 forms for at least eight engineers from architectural, civil, electrical and mechanical profile (evidence form by which the economic operators proves that has employed the required engineers if the bidder is from abroad);

List of professional team of experts who will be engaged in the construction, as follows:

1. Manager of architectural/construction profile, minimum 1 person, authorization A for construction of buildings;

2. Engineer of architectural profile, minimum 2 persons, with authorization A for construction of buildings;

3. Civil Engineer (construction, hydrotechnics, road) at lest one person from each (a total of 3 people), authorization A for construction of buildings;

4. Engineer of mechanical engineering, at least one person with Authorization A for construction of buildings;

5. Electrical engineer, at least one person with Authorization A for construction of buildings.

Certified copies of the economic operator of Authorization A for construction of buildings for the professionals that will be engaged in the construction, or other appropriate evidence if the bidder is from abroad;

CV of professional team of experts who will be engaged in the construction;

Verified statement of an authorized economic operator for the list of professional team of experts in the relevant fields who will be engaged in the construction;

Verified statement of an authorized person from the economic operator for the qualification structure, years of service and professional ability of the facility manager that will be responsible for the duration of the contract;

List of minimum equipment required for demolition, construction and production of prefabricated reinforced concrete façade, partition walls, sanitary cabins etc;

Verified statement of a authorized person from the economic operator for engaging minimum required equipment for demolition, construction and production of prefabricated reinforced concrete façade, partition walls, sanitary cabins etc, which will be used for the procurement;

Verified statement of an authorized person from the economic operator showing the existence of a laboratory or to attach a contract with authorized laboratory for testing the quality of the built-in materials.

A foreign physical entity that has authorization from another country may perform works of designing, review, construction and supervision of constructions in the Republic of Macedonia if the authorization is approved by the Chamber of authorized architects and engineers. If the foreign physical entity fails to have some form of evidence for construction, the entity is required to provide the following documents to the Chamber of authorized architects and engineers such as:

— Proof for completed higher education in the appropriate technical field,

— Proof on previous working experience at least for the last 5 years for construction works from the first category,

— Proof for participation in the construction activities of at least 3 construction works from the first category, confirmed from the legal entity who conducted the construction works.

Quality systems standards

To qualify as capable for executing the contract for public procurement in terms of quality systems, the economic operator shall have the following standard:

ISO 9001:2008

The economic operator proves the fulfillment of the standard by submitting:

Verified copy of the economic operator of Certificate ISO 9001:2008.

Environmental management standards.

In order to qualify as capable of performing the contract for public procurement in terms of environmental management standards, the economic operator shall have the following standard:

— ISO 14001:2004

— a certified copy of the economic operator of the Certificate ISO 14001:2004.

Извршување на договорот
Потребни депозити и гаранции:

As part of the bid, the economic operator compulsory provides bid guarantee in the amount of at least 200.000,00 EUR. The guarantee shall be submitted in the second phase of the procedure. The manner, deadline and form of the guarantee will be explained in the second phase of the restricted procedure. The condition for signing the contract with the most favorable economic operator is the provision of the guarantee by the selected best bidder for quality realization of the contract in the amount of 10 % of the contract value.
