… the legal entities that they have not been rendered a penalty temporary or permanent ban for participation in a procedure for public calls, granting contracts for public procurements and contracts for public-private partnership;

… legal entities that it has not been rendered a penalty for temporary or permanent ban for performance of a certain activity;

— certificate that with a final verdict it has not been rendered a misdemeanour sanction – ban for performance of a profession, activity or duty, i.e. temporary ban for performance of a certain activity.

That in the period before the entry into force of the Contract it will provide a legal entity in the field of construction that meets the requirements for technical capability with the legally prescribed conditions for performing the relevant activity required to execute the contract in accordance with the Construction Act stipulated in the Republic of Macedonia or if the economic operator is foreign tenderer then appropriate documents valid for the contractor for construction in the country where it is registered translated by a certified translator and notarized.

The statement is submitted by the private partners who are not registered to perform the activity subject to procurement i.e. if the private partner is not registered to perform the activity subject of the procurement.

Every tenderer that has legal interest for getting the public procurement contract and who suffered or could suffer damage from potential breach of the provisions of this Law, can ask for legal remedy against the decisions, actions and omissions for undertaking actions by the Contracting authorities in the procedure for granting the Public Procurement Contract, in compliance with the conditions and procedure provided with the Public procurement Act. The right to an appeal in a procedure that ends with an auction in terms of determining the capacity of the tenderers and full evaluation of the initial tenders is accomplished after reaching the decision for selection of the most favorable tenderer or annulment of the procedure.
