2.1 Capability Proofing Method

2.1.1 Together with the offer, the economic operator or the group of bidders (JB) must submit

the supporting documents by which it shall prove:

— the personal condition;

— the capability to perform the professional activity ;

— economic and financial condition ;

— technical or professional activity ;

2.1.2 The required documents shall be submitted in original copies or in copies that shall be certified by the economic operator with a stamp and signature of the responsible person, marked as " True to the original ."

2.1.3 Upon checking the completeness and validity of documents for determining the capability of the economic operator and the evaluation of the tender, the Commission may require from the economic operators to clarify or supplement the documents, if there are no significant deviations from the required documents.

2.1.4 The economic operator shall submit the required explanation in writing within the period determined by the contracting authority.

2.1.5 The commission or the economic operator may not request, offer or allow changes in the offer, except correction of arithmetic errors.

2.1.6 In the case of a group of economic operators, all members of the group should individually demonstrate their personal condition and capability to pursue the professional activity.

2.2 Personal standing

2.2.1 The contracting authority shall exclude every economic operator or a group of bidders (JB) from the procedure for awarding a public procurement contract, in the following cases:

— the economic operator to whom a valid final decision was pronounced for participation in a criminal organization, corruption, fraud or money laundering in the past 5 years;

— the economic operator to whom a minor penalty was pronounced for banning participation in procedures of public tenders, awarding contracts and agreements for public procurements and contracts for private partnerships ;

— the economic operator to whom minor penalty for temporary or permanent prohibition of a specific activity is pronounced;

— economic operator in a bankruptcy or liquidation proceedings;

— economic operator with unpaid taxes and other public duties;

— economic operator to whom sanctions - prohibition for performing professional activity or duty is imposed, i.e. temporary prohibition for performing professional activity; and

— economic operator that provides false information or fails to submit the information requested by the contracting authority.

2.2.2 In order to prove his personal condition, the economic operator or the group of bidders (JB) shall submit the following documents:

— a declaration by the economic operator that a valid final decision was not pronounced for participation in a criminal organization, corruption, fraud or money laundering in the past 5 years;

— a confirmation that no bankruptcy proceedings are opened by the competent authority;

— a confirmation that no liquidation procedure is opened by the competent authority;

— a confirmation for paid taxes, contributions and other public duties, issued by the competent authority of the country where the economic operator is established;

— a certificate from the Registry of penalties for crimes committed by legal persons that no…

… penalties or prohibitions for participation in public tender procedures, awarding contracts for public procurements and agreements for public-private partnership have been pronounced;

… minor penalties for temporary or permanent prohibition of professional activities have been pronounced.

— a confirmation that final sentence for a penalty sanction - prohibition of professional activity, activity or duty, i.e. temporary prohibition for performing professional activity has not been pronounced.

2.2.3 The declaration set forth in item 1 of sub-item 2.2.2 shall be prepared and signed by the economic operator, and it does not have to be certified by a competent authority.

2.2.4 The confirmation that no bankruptcy proceedings and liquidation proceedings are opened, as well as the certificates from the Registry of penalties for criminal acts set forth in lines 5 and 6 of sub-item 2.2.2, shall be issued by the competent authorities in the country in which the economic operator is registered. In the Republic of Macedonia, the body responsible for issuing of these certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The certificate for paid taxes, contributions and other duties shall be issued by a competent authority of the country where the economic operator is registered. In the Republic of Macedonia, the authority that is competent to issue such certificates is the Public Revenue Office.

2.2.6 The confirmation set forth in line 7 of sub-item 2.2.2 shall be issued by the competent authority in the country where the economic operator is registered. In the Republic of Macedonia, the authority that is competent to issue this certificate is the Central Registry of the Republic of Macedonia.

2.2.7 The documents referred to in sub-item 2.2.2 must not be older than six (6) months, counted from the deadline for submission of bids.

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2, or if they do not cover all the above stated cases, the economic operator may submit a statement certified by a competent authority.

2.2.9 If the economic operators submit a bid as a group of economic operators (JB), personal condition is proved by taking into consideration the documents submitted individually by each member (company) of the group.

2.3 Capability to perform the professional activity

2.3.1 In order to demonstrate the ability to perform professional activity, the economic operator should submit a document for the registered activity (DRD form) as a proof that it is registered as a physical or legal entity for conducting activities related to the subject of the contract for public procurements or evidence that it belongs to the adequate professional association in accordance with the regulations of the country in which it is registered.

The following is also required:

— The bidder should own a contactor license (B) for performing constructions of a second (II) category, that is issued by the competent authority of the state, in accordance with the Law on Constructing ( Official Gazette of RM nr.130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12 and 25/13) this applies to each member of the group if they offer a bid as a group of economic operators (JB) ( proof - copy of the contractor license (A) for performing constructions of the first (I) category, issued by the competent authority in the country, according to the Law on Constructing (Official Gazette of RM br.130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12 and 25/13) ;

2.3.2 If economic operators submit a bid as a group of economic operators (JB), the capability to perform professional activity is proved by taking into account the documents submitted separately for each member (company) of the group.

2.4.1 In order to qualify as capable of performing the contract for procurement in terms of its economic and financial situation, the economic operator must meet the following conditions :

— Minimum annual income of 500,000 EUR / year, in the past three years (separately for 2010, 2011 and 2012) (evidence on the Balance sheet and data in the income statement for 2010, 2011 and 2012, certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets, where publication of the balance sheet is required under the law of the country where the economic operator is registered.

Audit reports for foreign bidders, that should be positive and to be issued by a reputable foreign institution that is registered for auditing. The audit reports should contain data on the overall economic performance of the foreign bidder (for the past last three years).

2.4.2 If the economic operators submit a bid as a group of economic operators (JB), the economic and financial situation shall be proved by considering the resources of all group members.

2.4.3 The economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and the entity. If the economic operator proves its economic and financial capability referring to the support of another entity, it is required to demonstrate that support with a valid evidence that the entity will make available to the economic operator the adequate financing. The entity that provides financial support must not be subject to a pronounced verdict for participation in a criminal organization, corruption, fraud or money laundering.

— Minimum annual income of 500,000 EUR / year, in the past three years (separately for 2010, 2011 and 2012) (evidence on the Balance sheet and data in the income statement for 2010, 2011 and 2012, certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets, where publication of the balance sheet is required under the law of the country where the economic operator is registered.

Audit reports for foreign bidders, that should be positive and to be issued by a reputable foreign institution that is registered for auditing. The audit reports should contain data on the overall economic performance of the foreign bidder (for the past last three years).

2.5 Technical and professional capability

2.5.1 In order to qualify as capable for performing the contract for procurement in terms of its technical and professional capability, the economic operator must meet the following conditions:

a) General construction experience

— Timeline as a contractor in the construction industry, a minimum of five ( 5 ) years (proof - List of works completed in the last five (5) years, by providing certificates of satisfactory performance in accordance with the requirements of the tender documents);

— A minimum of 50 (fifty) employees (proof - a copy of M1 and M2 forms for employment or appropriate form issued by a competent authority in the domicile state of the economic operator);

— Educational and professional qualifications of the economic operator or its managerial staff, and especially the people who are responsible for carrying out specific tasks, according to the requirements in the tender documentation; \

— Statement of the technical staff and technical authorities, especially those responsible for quality control of works, regardless of the fact whether they belong to the economic operator (in accordance with the requirements of the tender documentation);

— Report on the elements of the contract which the economic operator intends to subcontract to third parties.

For foreign natural and legal persons, Article 42 of the Law on Constructing (Official Gazette of RM nr. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, and 25/13) shall apply.

b) Special construction experience

(i) A number of completed similar contracts are required: Successful experience in at least one (1) contract for the construction or reconstruction or rehabilitation of state highways or municipal roads during the past (5) five years, with a minimum value of EUR 500.000 (proof - copy of the agreement and a confirmation for satisfactory performance);

Personnel: The key personnel for the works must meet the following minimum requirements (with designated facilities):

(i) Head of Works - Chief Engineer (1 B.Sc. civil engineer) with B authorization for an executive engineer of construction, he/she should have at least 10 years of experience in the construction industry, 7 years of experience on similar projects, 3 years as a Head of objects (evidence - copies of diplomas and authorization issued by the appropriate authority in the country, in accordance with the applicable Law on Constructing (Official Gazette of RM nr.130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12 and 25/ 13), a copy of M1 and M2 form of employment and completed forms for bidding (8) Summary of the candidate).

(ii) Assistant for earth and concrete works (1 BA . civil engineer) with B. authorization for an executive engineer of construction, he/she should have at least 7 years of experience in the construction industry, 3 years of experience on similar projects (evidence - copies of a Diploma and Authorization, issued by the appropriate authority in the country, in accordance with the applicable Law on Constructing (Official Gazette of RM nr.130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12 and 25/13), a copy of M1 and M2 form of employment and completed forms for bidding (8) Summary of the candidate).

(iii) Assistant for asphalt works (1 BA . civil engineer) with B. authorization for en executive engineer of construction, he/she should have at least 7 years of experience in the construction industry, 3 years experience on similar projects (evidence - copies of diplomas and authorization issued by the appropriate authority in the country, in accordance with the applicable Law on Constructing (Official Gazette of RM br.130/09, 124/10, 18/11, 36/11, 54/11, 13 12, 144/12 and 25/13), a copy of M1 and M2 form of employment and completed forms for bidding (8) Summary of the candidate).

(iv) Geometer : minimum surveying technician, he/she should have at least 5 years experience in the construction industry and experience of road projects (proof - copy of Bachelor of Education and a copy of M1 and M2 form of employment and completed forms for bidding (8) Summary of the candidate).

d) Equipment: The bidder should have owned or have provided access to (through hire, lease, purchase agreement, etc. the key equipment listed below, in full working order, and must demonstrate that based on known commitments, it will be available during the implementation of the proposed agreement. Also, the bidder should specify other equipment (vehicles, rollers etc.) which he will use to execute the contract. For the equipment that is not in his possession, the bidder will submit valid evidence under Article 154 of the Law on Public Procurement, that such equipment and facilities available to the duration of the Contract. The bidder should own or have assured access to the following key equipment (list with proof of ownership):

Asphalt base/s with a total production capacity of not less than 60 tons / hour of maximum distance from the facility to 150 km proof of ownership and proof that it is in use issued by the appropriate authority). For the asphalt base/s it is need to submit A - Integrated Environmental Permit (IPPC) or A - permit with adjustment plan" issued by a competent authority ( MEPP ) (proof copy thereof) . If the asphalt base/s is outside the territory of the Republic of Macedonia, the economic operator is required to submit valid proof of environmental protection, if it is regulated under the legislation of the country where it is located, the asphalt base shall otherwise require to submit a statement that would confirm that such a document is not issued in that state).

Concrete base/s with a total production capacity of not less than 30 cubic meters/hour and maximum distance from the facility up to 150 km (proof of ownership and proof that it is in use issued by the appropriate authority). The concrete base/s and need to provide B - Integrated Environmental Permit (IPPC) or B - permit with adjustment plan" issued by a competent authority (MEPP) (proof copy thereof). If the concrete base/s is outside the territory of the Republic of Macedonia, the economic operator is required to submit valid proof for environmental protection, if this is regulated under the legislation of the country in which it is located; otherwise the concrete base is required to submit a statement confirming that such a document is not issued in that state.

Machinery for excavation (or smaller excavators or smaller bulldozers) with a total capacity of not less than 200 m3/day (proof of ownership and a statement that they are in use); 2 vehicles.

Finisher pavers for embedding asphalt 1 vehicle (proof of ownership and a statement that it is in use) ;

Transport vehicles – trucks – 2 vehicles) with loading capacity of at least 12 cubic meters (proof of ownership, a copy of the driving license and a proof that they are in use, issued by the appropriate authority, as well as a statement that their loading capacity is 12 cubic meters);

Steam rollers (2 vehicles with rubber and 2vehicles with steel) (proof of ownership and a statement that they are in use);

Grader and loader (proof of ownership and a statement that they are in use);

2.5.2 Should the economic operators submit a bid as a group of economic operators (JB), the technical and professional capacity shall be proved by taking into account the resources of all group members.

2.5.3 The technical and professional capacity of economic operators may not be supported by another entity, regardless of the legal relations between the economic operator and the entity. If the economic operator proves its technical and professional capability referring to the support of another entity, it is required to demonstrate the support with a valid evidence that the specific entity will make available to the economic operator the adequate technical and professional resources. Valid verdict for participation in a criminal organization, corruption, fraud or money laundering should not be pronounced to the entity that provides technical and professional support.
