2.1 Capability Proofing Method

2.1.1 Together with the offer, the economic operator or the group should obligatorily submit

the supporting documents by which it shall prove:

— the personal standing;

— the capability to perform the professional activity ;

— economic and financial standing;

— technical or professional capability;

— the standards of the quality systems;

— the standards for managing with the living environment.

2.1.2 The required documents shall be submitted in paper, in one original and in one copy.

2.1.3 Upon checking the completeness and validity of documents for determining the capability of the economic operator and upon the evaluation of the offer, the Commission may require from the economic operators to clarify or supplement the documents, if there are no significant deviations from the required documents.

2.1.4 The economic operator shall submit the required explanation in writing within the period determined by the contracting authority.

2.1.5 In the case of a group of economic operators, all members of the group should individually demonstrate their personal condition and capability to pursue the professional activity.

2.2 Personal standing

2.2.1 The contracting authority shall exclude every economic operator from the procedure for awarding a public procurement contract, in the following cases:

— the economic operator to whom a valid final decision was pronounced for participation in a criminal organization, corruption, fraud or money laundering in the past 5 years;

— the economic operator to whom a minor penalty was pronounced for banning participation in procedures of public tenders, awarding contracts and agreements for public procurements and contracts for private partnerships;

— the economic operator to whom minor penalty for temporary or permanent prohibition of a specific activity is pronounced;

— economic operator in the process of a bankruptcy or liquidation proceedings;

— economic operator with unpaid taxes, contributions and other public duties, except if deferred payment is allowed to the economic operator to pay the taxes, contributions and other public duties in accordance with the special provisions, and if it pays on regular base;

— economic operator to whom sanctions - prohibition for performing professional activity or duty is imposed, i.e. temporary prohibition for performing professional activity; and

— economic operator that provides false information or fails to submit the information requested by the contracting authority.

2.2.2 In order to prove his personal standing, the economic operator shall submit the following documents:

— a declaration by the economic operator that a valid final decision was not pronounced for participation in a criminal organization, corruption, fraud or money laundering in the past 5 years;

— a confirmation that no bankruptcy proceedings are opened by the competent authority;

— a confirmation that no liquidation procedure is opened by the competent authority;

— a confirmation for paid taxes, contributions and other public duties, issued by the competent authority of the country where the economic operator is established;

— a certificate from the Registry of penalties for crimes committed by legal persons that no…

… penalties or prohibitions for participation in public tender procedures, awarding contracts for public procurements and agreements for public-private partnership have been pronounced;

… minor penalties for temporary or permanent prohibition of professional activities have been pronounced, and

— a confirmation that final sentence for a penalty sanction - prohibition of professional activity, activity or duty, i.e. temporary prohibition for performing professional activity has not been pronounced. .

2.2.3 The declaration set forth in item 1 of sub-item 2.2.2 shall be prepared and signed by the economic operator, and it does not have to be certified by a competent authority.

2.2.4 The confirmations that no bankruptcy proceedings and liquidation proceedings are opened, as well as the certificates from the Registry of penalties for criminal acts set forth in lines 5 and 6 of sub-item 2.2.2, shall be issued by the competent authorities in the country in which the economic operator is registered. In the Republic of Macedonia, the body responsible for issuing of these certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The certificate for paid taxes, contributions and other duties shall be issued by a competent authority of the country where the economic operator is registered. In the Republic of Macedonia, the authority that is competent to issue such certificates is the Public Revenue Office.

2.2.6 The confirmation set forth in line 7 of sub-item 2.2.2 shall be issued by the competent authority in the country in which the economic operator is registered. In the Republic of Macedonia, the authority that is competent to issue this certificate is the Central Registry of the Republic of Macedonia.

2.2.7 The documents referred to in sub-item 2.2.2 must not be older than six (6) months, counted from the deadline for submission of bids.

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2, or if they do not cover all the above stated cases, the economic operator may submit a statement certified by a competent authority.

2.2.9 If the economic operators submit a bid as a group of economic operators (JB), personal condition is proved by taking into consideration the documents submitted individually by each member (company) of the group.

2.3 Capability to perform the professional activity

2.3.1 In order to qualify as capable to execute the subjected contract for public procurement from the aspect of the professional activity, the economic operator should fulfill the following minimum conditions:

It should be registered for conducting activities related to the subject of the contract for

public procurement;

It should possess an A license for contractor in accordance with the Law on Constructing (Official Gazette of RM nr.130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/2013 and 137/2013).

2.3.2. In order to prove the capability for conducting its professional activity, the economic operator should submit the following documents:

— a document for the registered activity - DRD form, as a proof that it is registered as a physical or legal entity for conducting activities related to the subject of the contract for public procurements or evidence that it belongs to the adequate professional association in accordance with the regulations of the country in which it is registered. In the Republic of Macedonia, the body that issues such a document (DRD form) is the Central Registry of the Republic of Macedonia.

If the country in which the economic operator is registered does not issues such a document, the economic operator may submit another adequate document that should be registered with an authorized body, in which it will be undoubtedly proved that it is capable to execute the subjected contract for public procurement from the aspect of performing the professional activity, as well as the equivalency of the foreign document with the Macedonian document for registered activity,

License A for contractors, issued in accordance with the Law on Constructing.

It is necessary for the foreign legal entity to receive a certificate for performing activities that are subject to the public procurements, i.e. building constructions of the first degree, by the body of the state government in charge of performing activities in furnishing the jobs within the scope of furnishing the space – Ministry of transport and communication, in accordance with the Law on Constructing.

2.4 Economic and Financial Standing

2.4.1 In order to qualify as capable of performing the contract for procurement in terms of its economic and financial situation, the economic operator must meet the following conditions:

a. to have a total turnover of at least 35.000.000,00 EUR for each of the last past three years;

b. positive financial report.

2.4.2 If the economic operator performs the activity in the period that is shorter than three years, the minimum condition for determining its economic and financial standing shall be that the economic operator should realize the turnover set forth in sub-item 2.4.1 in the years in which there are such data.

2.4.3 The economic operator shall prove the fulfillment of the minimum condition set forth in sub-item 2.4.1 or 2.4.2 by submitting the following:

Report on the balance sheet that is recorded with an authorized body, i.e. reviewed balance sheet, or excerpts from the report on the balance sheet in cases when the publishing of the balance sheet is prescribed by the law in the country in which the operator is registered;

Extract on the total turnover of the company (data from the balance sheet issued by an authorized body, I e reviewed balance sheet) and if adequate, on the turnover in the scope that is covered by the contract on public procurements, for the last three financial years at the most, for which such information are available, depending on the accessibility of such information.

2.4.4 If the balance sheet and income statement have been subject to commercial audit, the economic operator may submit them as proof that it meets the minimum requirement for establishing the economic and financial situation without being further verified by the competent authority.

2.4.5 If the balance sheet and income statement have not been subject to commercial audit, the economic operator shall submit them certified or issued by a competent authority, to prove that it meets the minimum requirement for establishing the economic and financial situation. The competent authority in the country is the Central Registry of the Republic of Macedonia.

2.4.6 The economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and the entity. If the economic operator proves its economic and financial capability referring to the support of another entity, it has to demonstrate that support with valid evidence, that the entity will make available the said financing to the economic operator. The entity that provides the financial support may not be prosecuted by a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.4.7 If the economic operators submit a bid as a group of economic operators, the economic and financial situation is proved by considering the resources of all group members. If the group of economic operators acts with financial support from a third entity, the economic and financial situation is determined according to the above mentioned.
