Final deadline for submission of the bids is 17.6.2013, until 14:00 o'clock. The bids are submitted to the following address: Ministry of Justice-Directorate for Execution of Sanctions, Jurij Gagarin street No.15-1000 Skopje, Republic of Macedonia, marked "Za otvorena postapka br.09/2013”.The bid that will be submitted after the expiry of the final deadline for submission of the bids shall be rejected as late and will be returned unopened to the economic operator.Bids can be submitted only by economic operators that have obtaines certified hard copy of the tender documentation from the Contracting Authority.

The Contracting Authority will exclude from the procedure for awarding public procurement contract every economic operator who:

-Was subject to court verdict in effect in the last five years for involvement in criminal organization, corruption, fraud or money laundering;

-Who is subject to imposed temporary penalty –prohibition for performing acts of public call, awarding public procurement contracts and contracts for public private partnership

-Who is subject to imposed temporary penalty - interim or permanent prohibition for performing of specific activity

-Who is under bankruptcy or liquidation procedure;

-Who did not pay taxes, contributions and other public duties;

-Who is subject to imposed misdemeanor sanction – prohibition from performing of the profession, activity or duty i.e. interim prohibition for performing of specific activity,

-Who provides fake data or does not provide the data requested by the Contracting Authority.

The economic operator provides the following documents in order to prove his personal status:

-Statement from the economic operator that he was not subject to court verdict in effect in the last five years for involvement in criminal organization, corruption, fraud or money laundering;

-Confirmation that no liquidation procedure was opened by relevant authority;

-Confirmation that he is not subject to bankruptcy or liquidation procedure;

-Confirmation for clearance regarding paid taxes, contributions and other public duties issued by the relevant authority in the country where the economic operator is registered;

-Confirmation from the Register of sanctions for criminal acts of legal entities that he was not subject to court verdict temporary penalty -…

… prohibition for performing acts of public call, awarding public procurement contracts and contracts for public private partnership;

… interim or permanent prohibition for performing of specific activity

-Confirmation that he is not subject to imposed misdemeanor sanction – prohibition from performing of the profession, activity or duty i.e. interim prohibition for performing of specific activity.

In order to qualify as capable for realization of the contract for public procurement from the aspect of his professional activity, the economic operator has to meet the following requirements:

-to be registered for performing the activity related to the subject of the public procurement contract;

-to have License A 1 for executing construction works of first category, issued by the Ministry of Transport and Communication.

In order to prove his capacity for realization of the professional activity, the economic operator submits the following documents:

- document for registered activity – DRD form, as proof that he is registered as legal person for performing of the activity related to the subject of the public procurement contract, or proof that he is member of the relevant professional association, in accordance with the regulations of the country of registration. In the Republic of Macedonia the relevant authority to issue this document (DRD form) is the Central Register of Republic of Macedonia.

-certified copy of License A for executing construction works of first category issued by the Ministry of Transport and Communication;

Економска и финансиска состојба:

2.4.1 To qualify capable to execute the subject of the public procurement contract from its economic and financial capacity, the economic operator shall meet the following minimum conditions:

-A minimum annual income of financial assets of the economic operator of at least 3.000.000 euro in denar equivalent in the last three years (2010, 2011 and 2012), expressed for each year separately;

-Positive financial performance (net profit) in the last three years (2010, 2011 and 2012), expressed for each year;

-Minimum amount of liquid assets and/or credit assets to be 300 000 EUR in denar equivalency.

2.4.2 The economic operator proves that he meets the requirements from item 2.4.1 by providing:

-Balance sheets certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance sheet is required under the law of the country where the economic operator is registered.

-Statement of the overall turnover (data from the income statement issued by the competent authority. i.e. audited balance sheet) and, where appropriate, of turnover in the area covered by the public procurement contract at most for the last three financial years for which such data is available, depending on the date on which the company was founded or started to work and depending on the availability of such information;

-Balance sheet and income statement data issued by the competent authority, for the last three years (2010, 2011 and 2012), expressed for each year;

-Certificate from the bank for a loan and/or account balances, to prove the condition referred to in point 2.4.1, line 3

Техничка и професионална способност:

2.5.1 In order to qualify as capable for realization of the contract for public procurement from the aspect of his technical or professional capacity, the economic operator has to meet the following requirements:

- minimum 3 realized contracts in the last 5 years (2008-2012) or in phase of realization for construction of facilities, with individual value not less than 2 500 000 EUR in Denar equivalency of which minimum one contract for construction of facilities of social character (e.g. schools, hospitals, dormitories, educational-correctional institutions, prisons, police stations);

- the economic operator shall have at least 100 employees of which at least 4 engineers of architectural, civil, electrical or mechanical profile;

- to have experts from relevant fields with Authorization A² for construction of buildings that will be engaged in the realization of the construction;

-has a minimum of technical equipment and construction machinery for construction of facilities

² A foreign physical entity that has authorization from another country may perform works of designing, review, construction and supervision of constructions in the Republic of Macedonia if the authorization is approved by the Chamber of authorized architects and engineers. If the foreign physical entity fails to have some form of evidence for construction, the entity is required to provide the following documents to the Chamber of authorized architects and engineers such as:

-Proof for completed higher education in the appropriate technical field,

-Proof on previous working experience at least for the last 5 years for construction works from the first category,

-Proof for participation in the construction activities of at least 3 construction works from the first category, confirmed from the legal entity who conducted the construction works.

2.5.2 The economic operator proves the realization of the conditions from item 2.5.1 by providing:

- Reference list of the constructed buildings in the last five years (2008-2012), with individual value not less than 2 500 000 EUR in denar equivalency of which minimum one contract for construction of facilities of social character (e.g. schools, hospitals, dormitories, educational-correctional institutions, prisons, police stations) with indication of works, subject and number of contract, name and address of the investor, duration, date of realization and contract value (reference list)

- Fulfilled list of minimum 3 realized contracts in the last 5 years (2008-2012) or is in phase of realization for construction of buildings, with individual value not less than 2 500 000 EUR in denar equivalency of which minimum one contract for construction of facilities of social character (e.g. schools, hospitals, dormitories, educational-correctional institutions, prisons, police stations)

- At least three references of successful implementation issued by the investors for quality realization of buildings performed in the last five years (2008-2012) or is in phase of construction, with individual value no less than 2 500 000 EUR in denar equivalency of which minimum one contract for construction of facilities of social character (e.g. schools, hospitals, dormitories, educational-correctional institutions, prisons, police stations)

- Appropriate evidence from the Employment Agency of the Republic of Macedonia that the economic operator has at least 100 (one hundred) employees, or other appropriate evidence if the bidder is from abroad;

- М1/М2 forms for at least four engineers from architectural, civil, electrical and mechanical profile (evidence form by which the economic operators prove that has employed the required engineers if the bidder is from abroad);

- List of professional team of experts who will be engaged in the procurement , as follows:

1.Head of construction of architectural/civil engineering profile, 1 person, with Authorization A for construction of buildings

2. Engineer of architectural profile, minimum 1 person, with authorization A for construction of buildings;

3. Civil Engineer (construction, hydrotechnics, road) at least one person from each (a total of 3 people), authorization A for construction of buildings;

4. Engineer of mechanical engineering, minimum 1 person, with Authorization A for construction of buildings;

5. Electrical Engineer at least one person with authorization A for construction of buildings.

- Certified copies of the economic operator of authorizations for construction of buildings for the professionals that will be engaged in the construction or other appropriate evidence if the bidder is from abroad;

- CV of professional team of experts who will be engaged in the construction;

- Verified statement of an authorized economic operator for the list of professional team of experts in the relevant fields who will be engaged in the construction;

- Verified statement of an authorized person from the economic operator for the qualification structure, years of service and professional ability of the facility manager that will be responsible for the duration of the contract;

- List of minimum technical equipment and construction machinery for construction of buildings;

- Verified statement of an authorized person of the economic operator for engaging minimum necessary equipment for construction that will be used in the realization of the procurement;

-Verified statement of an authorized person from the economic operator showing the existence of a laboratory or to attach a contract with authorized laboratory for testing the quality of the built-in materials

2.5.3 The statements in item 2.5.2, line 9, 10, 12 and 13 are prepared and signed by the responsible person of the economic operator. If the bidder is from a foreign country, the corresponding proof for employees and Authorization A for construction of buildings in accordance with the applicable regulations of the Republic of Macedonia on the condition in item 2.5.2 paragraph 4.5 and 7 shall be issued and certified by the competent authority in the country where issued.

2.5.4 The technical and professional capacity of the economic operator can be supported by other entity, regardless of the business relations the legal links between the economic operator and that entity. If the economic operator is proving his technical and professional capacity by referring to support by another entity, he is obliged to prove the support with valid proof that that entity will make available to the economic operator the necessary technical and professional resources. The entity that expresses the technical or professional support must not be subject to legal verdict in effect for involvement in criminal organization, corruption fraud or prevention of money laundering.

2.5.5 If the Economic Operators submit a bid as a group of economic operators, the technical and professional capacity shall be proved by taking into consideration the resources of all group members. If the group of economic operators participate with technical and professional support of third entity, the technical and professional capacity shall be determined in accordance with the above stated.

2.6 Quality systems standards

2.6.1 To qualify as capable for executing the contract for public procurement in terms of quality systems, the economic operator shall have the following standard:

ISO 9001:2008

2.6.2 The economic operator proves the fulfillment of the standard in item

2.6.1 by submitting:

Verified copy of the economic operator of Certificate ISO 9001:2008

2.7 Environmental management standards

2.7.1 in order to qualify as capable of performing the contract for public procurement in terms of environmental management standards, the economic operator shall have the following standard:

- ISO 14001:2004

2.7.2 The economic operator proves the fulfillment of the standard in item 2.7.1 by submitting:

- a certified copy of the economic operator of the Certificate ISO 14001:2004

As part of the bid, the economic operator compulsory provides tender guarantee in the amount of 3 % of the bid without VAT.The guarantee is in a form of bank guarantee, issued by reputed bank institution, selected by the economic operator. All banks are acceptable for the Contracting Authority.The guarantee should be submitted in original. No copies are accepted. The guarantee must be valid at least fourteen days after the tender validity period. Every bid that does not include tender guarantee, or includes tender guarantee that does not comply to the conditions in the tender documentation, will be rejected by the Contracting Authority as unacceptable.The conditions for signing the contract with the most favorable economic operator is the provision of bank guarantee by the selected best bidder in the amount of 10% of the contract value.

7.5.2 The guarantee from the above item is submitted as bank guarantee in written form. The guarantee should be submitted in its original form. No copies are accepted.

The following method of payment is envisioned: it is a multi-year public procurement with payment dynamics: 2013, 2014 and 2015 in accordance with the provided funds. The payment shall be made on the basis of monthly interim situations for completed works and submission of construction book certified by the supervising engineer, certified by the supervisory authority and the orderer of the works.

No advance payment is allowed for the preparation of the public procurement contract.

Every bidder that has a legal interest for winning the public procurement contract or who suffered, or could suffer, damage from eventual violation of the provisions from the Law on Public Procurement, can request legal protection against the decisions, actions and omissions to undertake actions by the Contracting Authority in the procedure for awarding of public procurement contract.

The right to appeal in a procedure which ends in e-auction in terms of determining the capacity of the bidders and the overall evaluation of the initial bids shall be used following the passing of the Decision for selection of most favorable bidder or the invalidation of the procedure.
