- Statement by the economic operator that it has not been announced, in the last 5 years, effective court decision for participation in criminal organization, corruption, fraud or money laundering;

- Certificate that it is not subject to bankruptcy procedure issued by competent authority;

- Certificate that it is not subject to liquidation procedure issued by competent authority;

- Certificate for paid taxes, contributions and other public duties by the competent authority in the country where that economic operator is established;

- Certificate from the Register of penalties for committed criminal acts of legal entities that a minor penalty…

… temporary or permanent ban on performing certain activity has not been imposed.

- Certificate that it is being announced sanction for misdemeanor with an effective court decision, resulting in prohibition for pursuing professional activity or duty, i.e. temporary prohibition for performing professional activity.

- For the purpose of proving the suitability for pursing professional activity, the economic operator shall present relevant document for registered activity in order to prove it is registered as natural or legal person to carry out the activity related to the subject-matter of the public contract.

Економска и финансиска состојба:

- Minimum annual income of EUR 1,000,000 / year in the last three years (separately for 2010, 2011 and 2012) (Proof - Balance sheet and report data for 2010, 2011 and 2012 income statements, certified by a competent authority, i.e audited balance sheets or extracts of balance sheets where publication of the balance sheet is required under the law of the country where the economic operator is registered.

- Auditor reports of the Foreign Tenderer, which shall be positive and shall be issued by a reputable foreign institution, registered to provide audit services. Auditor reports should contain data about the overall economic operation of the Foreign Tenderer (for the years 2010, 2011, and 2012).

Техничка и професионална способност:

- Educational and professional qualification of the economic operator or of its expert personnel, and especially of the individuals in charge of providing a particular service (according to the requirements in the Tender Documentation);

- Statement about engaged technical personnel and technical bodies regardless if they belong directly to the economic operator (according to the requirements in the Tender Documentation)

- Statement about technical equipment and capacity of the economic operator, and other resources available to provide the specific services and quality assurance.

- Notification on contract elements that the economic operator intends to subcontract to third parties.

- License A for designing structures of first category (proof – copy of License A for designing first category structures as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12 and 144/12).

- License for urban plan designing in accordance with the Law on Spatial and Urban Planning (proof – copy of License for urban plan designing in accordance with the Law on Spatial and Urban Planning, Official Gazette of Republic of Macedonia no. 51/05, 137/07, 91/09, 124/10, 18/11 and 53/11)

Experience:

- Minimum 3 (three) years of professional work experience in the area of road designing (proof – Lists of major services performed by the Tenderer in the last 3 (three) years, and confirmations about the performed services issued by the beneficiaries, and proofs that projects are completed;

- Minimum 1 (one) contract for at least 20 km prepared, revised and accepted design for construction or reconstruction or rehabilitation of state roads (motorways, express roads, national or regional roads) in the last 5 years, with a minimum value of 20,000,000.00 denars. (proof – Contract copy and evidence that the projects are completed)

- Minimum 20 (twenty) employees (to enclose M1/M2 employment forms as evidence);

- Minimum 10 (ten) graduated engineers employed, of which at least 5 (five) hold License A for designing structures (proof - enclose M1/M2 employment forms and copies of diplomas, and copies of License A for designing structures as evidence);

Key Personnel:

- Main Designer: a graduated civil engineer with authorization A for structures designing, with at least 15 years of work experience as a designer, and 5 years of work experience as road designer; (proof – copies of the diploma and of License A for structure designing issued by competent authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12 and 144/12), employment forms M1/M2 and completed short biography forms for the proposed experts).

- Road Alignment Designer: a graduated civil engineer with Licence A for structures designing, with at least 10 years of work experience as a designer, and 5 years of work experience as road designer; (proof – copies of the diploma and of Licence A for structures designing issued by competent authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12 and 144/12), employment forms M1/M2 and completed short biography forms for the proposed experts);

- Designer of Structures (bridges, underpasses, overpasses, retaining walls and viaducts): graduated civil engineer with Licence A for structures designing, with at least 10 years of work experience as designer, and 5 years as designer on similar projects; (proof – copies of the diploma and of Licence A for structures designing issued by competent authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12 and 144/12), employment forms M1/M2 and completed short biography forms for the proposed experts);

- Geotechnics Designer: graduated engineer with Licence A for structures designing, with at least 10 years of work experience in civil engineering, and 5 years experience as a designer on similar projects; (proof – copies of the diploma and of Licence A for structures designing issued by competent authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12 and 144/12), employment forms M1/M2 and completed short biography forms for the proposed experts);

- Surveying (Geodetic) Engineers with Authorizations: at least 5 years of work experience in the civil engineering field; (proof – copies of Authorizations in geodesy, employment forms M1/M2 and a completed short biography forms of the proposed experts).

- Environment Protection Expert: Certificate of passed professional exam for obtaining the status of an Expert in Environmental Impact Assessment for projects, issued by the Ministry of Environment and Physical Planning, with at least 5 (five) years of working experience and at least one developed Environmental Impact Assessment Study, which also included Social Impact Assessment according to rules of the EBRD or the IFC (proof – Certificate of passed professional exam for obtaining the status of an Expert in Environmental Impact Assessment for projects, and Environmental Impact Assessment of a project, which would also include Social Impact Assessment according to rules of the EBRD or the IFC).

For foreign natural and legal persons, article 42 from the Law on Construction (“Official Gazette of Republic of Macedonia” no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12 and 144/12) shall apply.

Equipment:

- Appropriate technical equipment with hardware and software that are necessary for preparing the design documentation in electronic version (proof – statement of technical equipment).

Geodetic instruments and equipment (appropriate equipment for surveying, double frequency GPS unit, 2 (two) total stations, off-road vehicle); (proof - statement of technical equipment).

Accredited laboratory for geo-mechanic testing ISO/IEC 17025:2005 (proof – valid document for an Accredited laboratory for geo-mechanic testing ISO/IEC 17025:2005)

Quality System Standards:

- Quality System Standards ISO 9001:2008 (proof – copy of Quality System Standards ISO 9001:2008 Certificate).

- Standard for Occupational Health and Safety OHSAS 18001:2007 (proof – copy of Certificate for Occupational Health and Safety OHSAS 18001:2007).

- Applies to each member of the group, if the tenderer is a group of economic operators (JV)

Environmental Management Standards

- Environmental Management Standards ISO 14001:2004 (proof – copy of Environmental Management ISO 14001:2004 Certificate)
