In the excise warehouse/ reservoirs on the territory of the Republic of Macedonia, determined with a written order of the Directorate of Compulsory Reserves of Oil and Oil Derivatives as the contracting authority.

1) For proving personal status,economic operator should provide the following documents:

— Statement by the economic operator than it has not been announced, in the last 5 years, effective court decision for participation in criminal organisation, corruption, fraud or money laundering,

— a Certificate that it is not subject to bankruptcy procedure issued by competent authority,

— a Certificate that it is not subject to liquidation procedure issued by competent authority,

— a Certificate for paid taxes, contributions and other public duties by the competent

authority in the country where that economic operator is established,

— a Certificate from the Register of penalties for criminal…

… committed by legal entities that has not been imposedminor penalty ban on participation in procedures for public announcement, the award of public supply contractsand public-private partnership,

… acts committed by legal entities that has not been imposed minor penalty temporary or permanent prohibition of certain activities and,

— A Certificate that it is not being announced sanction for misdemeanour with an effective court decision, resulting in prohibition for pursuing professional activity or duty, i.e. temporary prohibition for performing professional activity

2. Document for registered activity - A document for a registered activity as a proof that the operator is registered as a natural person or a legal entity to perform an activity related to the public procurement contract or proof of membership in an appropriate professional association in accordance with the regulations of the country where the operator is registered,

— License for performing energy activities – wholesale with oil and oil derivatives issued by the Regulatory Committee of the Republic of Macedonia for domestic economic operators,

- Excise license for the provided reservoirs,

— For foreign entities – economic operators license or other equivalent document for performing of energy activities - wholesale with oil and oil derivatives issued by competent authorities in the country where the economic operator is registered. -

- License for performing energy storage business of oil and oil derivatives issued by the Regulatory Commission of the Republic of Macedonia. i.e. for foreign entities - economic operators appropriate treaty for provided excise warehouse in the teritorry of the Republic of Macedona.

Економска и финансиска состојба:

Documents for economic and financial ability of economic operator:

- Appropriate bank statements,

— Report on the balance sheet notarized by a competent authority, i.e. audited balance

sheet, or excerpts from the balance sheet in cases when the disclosure of the balance sheet is prescribed by law in the country where the economic operator is registered,

— For foreign entities – report by the reputable foreign audit company for its financial performance .

Минимално ниво(а) на стандарди:

- Minimum average annual turnover in amount of 20 000 000 denars ,

— A minimum of 3 contracts for delivery of liquid fuels concluded in the last year, with individual value of each not less than 2 000 000 denars.

Техничка и професионална способност:

Documents for technical or professional ability of the economic operator:

— Description of technical equipment and competence of the economic operator,

--- Economic operator should compile valid evidence that has its own excise reservoir capacity for oil derivatives. In the case of leased excise reservoir facilities is acceptable proof of lease agreement valid for at least 5 years;

— Copies of car licenses or car rental agreements for tanks which have been concluded

for a period not shorter than the period of validity of the agreement of public procurement and it should contain data from the car licenses of the leased tanks,

— List of delivery of oil derivatives in previous 3 years, with values, dates, buyers (contracting authorities and economic operators) providing confirmation by the recipients of timely and quality performed deliveries of the contractual obligations,

--- Certificate of analysis carried out in an institution responsible for quality control that would confirm the quality of the offered oil derivatives that meet the required quality characteristics specified in the tender documentation,

— Information about the elements of the contract which the economic operator intends to give to the subcontractor.

Минимално ниво(а) на стандарди:

— At least 10 (ten) own or leased technically correct tankers to transport oil and oil derivatives, according to valid legislation in Macedonia,

- Minimum 3 contracts for delivery of liquid fuels with individual value of eachnot less than 2 000 000 denars.

— Economic operator should possess its own and / or leased excise reservoir facilities for petroleum derivatives.

Standards for quality systems: — The quality, of the offered oil derivative Diesel fuel / Eurodiesel BS should be in accordance with the applicable Rules of the quality ofliquid fuels in the Republic of Macedonia (Official Gazette of RM No. 88/2007, 91/2007, 97/2007, 105/2007,157/2007, 15/2008, 78/2008, 156/2008 and 81/2009 and, — Standard: MKS EN 590:2007 cor.mk.

Economic operator proves the fulfillment of the standards systems of quality by submission of:

— Certificate / declaration of conformity with which the economic operator ensures that qualitative properties of the proposed petroleum derivative subject to public procurement comply with the required quality characteristics specified in the tender documentation.

In order to sign the contract with the selected most favorable economic operator, the successful bidder shall be required to provide a contract performance bank guarantee in the amount of 5 % of the contract value.

A group of economic operators shall have the right to submit a bid without an obligation to form any legally appropriate association. The contracting authority shall not require the group of bidders to be associated in an appropriate legal form if the group is selected as the carrier of the procurement.

Any interested person can attend the public bid opening on 25th November 2013 (11:00 local time ).

Only the authorized representatives of the bidders can participate in the procedure of the public bid opening by providing their comments in the minutes of the bid opening,

— The authorized representatives of the bidders shall bring with them to the public opening an authorization (PoA) signed by a responsible person of the bidder. All authorized representatives of bidders, present at the public opening, should sign an attendance list.

Precise information on deadline(s) for lodging appeals: Article 216 (Public Procurement Law - Official Gazette of

RM No. 136/2007, 130/2008, 97/2010, 53/2011, 85/2011 and 15/2013).

The appeals procedure shall be initiated by submitting the appeal, i.e. by submitting the request to the Appeals Commission for annulling the contract award procedure because the contracting authority failed tosubmit the required documentation pursuant to Article 222 of this Law.

In case of electronic auctions, the appeal regarding the actions or failures to undertake actions related to the tender documentation shall be lodged within 8 days from the of receipt of the formal decision for an individual right in the contract award procedure.

The economic operator failing to lodge an appeal pursuant to the provisions in paragraph (2) of this Article shall not have the right to lodge an appeal for the same legal basis in the latter stage of the procedure.

The appeal shall be lodged within 8 days from the day of:

— publication of the contract notice, regarding the information, actions or failures to undertake actions under the contract notice,

— opening of tenders, regarding the actions or failures to undertake actions related to the tender documentation, i.e. the public opening of tenders,

— receipt of the formal decision for an individual right in the contract award procedure, regarding the establishment of the qualifications from the requests to participate or the evaluation of tenders, as well as the decision, or,

— acknowledging illegal implementation of the contract award procedure, within one year after the day o fcompleting the contract award procedure
