Subject of the Procurement Contract is Professional supervision over the construction and reconstruction of facilities within the complex of the Penitentiary-Correctional Institution “IDRIZOVO” (Municipality Gazi Baba, Skopje) as follows:

Final deadline for submission of bids is 05.08.2013 until 14,00h.The bids shall be submitted to the following address: Ministry of Justice – Directorate for Execution of Sanctions, Jurij Gagarin St. n.15 – 1000 Skopje, Republic of Macedonia marked “For Open Procedure n.12/2013”, “Za otvorena postapka br. 12/2013”. The bid submitted after the deadline for submission of bids shall be rejected as late and will be returned to the economic operator unopened. Bids can be submitted only by economic operators that have obtained certified hard copy of the tender documentation from the Contracting Authority.

The Contracting Authority shall exclude any Economic Operator from the process of awarding contract for public procurement that:

- was subject to final court verdict in the last five years for involvement in criminal organization, corruption, fraud or money laundering;

- was subject to imposed temporary penalty –…

… prohibition for performing acts of public call, awarding public procurement contracts and contracts for public private partnership

… interim or permanent prohibition to perform specific activity

- is under bankruptcy or liquidation procedure;

- who has unpaid taxes, contributions and other public duties, except if postponed payment was allowed to the economic operator to pay the taxes and other public charges in accordance with the special regulations and paid regularly;

- who is subject to imposed misdemeanor sanction – prohibition to perform profession, activity or duty i.e. temporary prohibition to perform certain activity and

- provides false data or fails to provide data requested by the Contracting Authority

To prove its personal standing, the Economic operator shall provide the following documents:

- Statement from the economic operator that he was not subject to final court verdict in the last five years for involvement in criminal organization, corruption, fraud or money laundering;

- Confirmation that no liquidation procedure was opened by relevant authority;

- Confirmation that no bankruptcy procedure was opened against it by competent authority;;

- Confirmation on paid taxes, contributions and other public charges from the competent authority in the country of registration of the economic operator;

- Confirmation from the Register of sanctions for criminal acts of legal entities that he was not subject to final court verdict temporary…

… penalty –interim or permanent prohibition for performing specific activity

- Confirmation that he is not subject to imposed misdemeanor sanction – prohibition from performing of the profession, activity or duty i.e. interim prohibition for performing of specific activity

In order to qualify as capable for realization of the contract for public procurement from the aspect of his professional activity, the economic operator has to meet the following requirements:

- to be registered for performing the activity related to the subject of the public procurement contract;

- Pursuant to the Construction Law, to have License A 1 for constructor for executing construction works of first category, issued by the Ministry of Transport and Communications;

In order to prove his capacity for realization of the professional activity, the economic operator submits the following documents:

- Document for registered activity – DRD form, as proof that he is registered as legal person for performing of the activity related to the subject of the public procurement contract, or proof that he is member of the relevant professional association, in accordance with the regulations of the country of registration. In the Republic of Macedonia the relevant authority to issue this document (DRD form) is the Central Register of Republic of Macedonia;

- Certified copy of authorized person of the bidder of License A for performing supervision over construction works of first category.

Економска и финансиска состојба:

2.4.1 To qualify capable to execute the subject of the public procurement contract from the aspect of its economic and financial capacity, the economic operator shall meet the following minimum conditions:

-annual income of the economic operator of at least 165.000 euro in denar equivalent in the last three years (2010, 2011 and 2012), expressed for each year separately.

-positive financial performance (net profit) in the last three years (2010, 2011 and 2012), expressed for each year;

2.4.2 The economic operator proves that he meets the requirements from item 2.4.1 by providing:

-Balance sheets for the last three years certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance sheet is required under the law of the country where the economic operator is registered.

-Report on the income statement for the last three years certified by a competent authority i.e. audited income statement, or extracts from the income statement in cases where the publishing of the income statement is prescribed by law in the country where the economic operator is established;

-Balance sheet and income statement data issued by the competent authority, for the last three years (2010, 2011 and 2012), expressed for each year.

Техничка и професионална способност:

2.5.1 To be qualified capable of performing the referred public procurement contract from the aspect of its technical and professional capability, the Economic Operator should meet the following minimum conditions:

-Minimum three realized contracts or to be in the process of realization in the last 5 years (2008-2012), for professional supervision over construction of buildings of which one of them is not less than 100.000 euro in denar equivalency.

-The economic operator shall have at least 10 employees of which at least four engineers of which two posses Authorization A for supervision;

-To have available professionals in the adequate fields i.e. minimum professional staff, consisted of:

-Head supervision engineer of the construction of architectural/civil profile with Authorization A for supervisory engineer – (1) one person

-Engineer of architectural profession with Authorization A ² for supervisory engineer – (1) one person

-Civil Engineer (constructive) with Authorization A for supervisory engineer –(1) one person

-Civil Engineer (hydro) with Authorization A for supervisory engineer – (1) one person

-Civil Engineer (traffic) with Authorization A for supervisory engineer – (1) one person

-Electrical Engineer with Authorization A for supervisory engineer – (1) one person

-Mechanical Engineer (Thermo technology) with Authorization A for supervisory engineer – (1) one person

² Foreign physical entity may perform the works of design, revision, performance and supervision in the Republic of Macedonia if the authorization is verified by the Chamber of authorized architects and engineers. If the foreign entity does not have certain type of proof of construction, the person shall provide the following documents to the Camber of authorized architects and engineers:

-Proof of completed university degree in adequate technical field;

-Proof of previous work experience in the last 5 years for construction works of first category

-Proof of participation in construction of at least 3 constructions of first category, confirmed by a legal entity performing the constructions. www.komoraoai.mk/mk/zakoni

2.5.2. The Economic Operator shall prove the fulfillment of minimum conditions stipulated in sub-item 2.5.1 by submitting:

- Reference list of executed supervision over construction of buildings in the last five years (2008-2012), or is in phase of realization with indication of works, subject and number of contract, name and address of the investor, duration, date of realization and contract value of which one with value not less than 100.000 euro in denar equivalency;

-Fulfilled list of three contracts for timely, good quality and duly executed supervision over the construction of the buildings in the last five years(2008-2012) or is in phase of realization, of which one with a value not less than 100.000 euro in denar equivalency.

-A minimum of three references issued by investors for executed supervision over construction of buildings in the last five years (2008-2012) or is in phase of realization, for appropriate, timely and quality execution of works of which one with a value not less than 100.000 euro in denar equivalency

-Verified М1/М2 forms for the professional team of the economic operator or adequate evidence from the Employment Agency of the Republic of Macedonia, or other adequate evidence if the bidder is from abroad.

-List of the professional team of the economic operator;

-Verified copies of the economic operator of the authoritizations of the professional team available to the economic operator;

-Statement of the economic operator on the engaged professional team from the adequate fields that will be responsible for the realization of the procurement

2.5.3 The technical and professional capacity of the economic operator can be supported by the other entity, regardless of the legal links between the economic operator and that entity. If the economic operator is proving his technical and professional capacity by referring to support by another entity, he is obliged to prove the support with valid proof that that entity will make available to the economic operator the necessary technical and professional resources. The entity that provides the technical or professional support must not be subject to legal verdict in effect for involvement in criminal organization, corruption fraud or prevention of money laundering.

2.5.4 If the Economic Operators submit a bid as a group of economic operators, the technical and professional capacity shall be proved by taking into consideration the resources of all group members. If the group of economic operators participate with technical and professional support of third entity, the technical and professional capacity shall be determined in accordance with the above stated.

Потребни депозити и гаранции:

As part of the bid, the economic operator compulsory provides bid guarantee in the amount 3% of the bid, VAT excluded.

4.7.2 The guarantee is in a form of bank guarantee, issued by reputed bank institution, selected by the economic operator. All banks are acceptable for the Contracting Authority.

4.7.3 The guarantee should be submitted in original. No copies are accepted. The guarantee must be valid at least fourteen days after the tender validity period. Every bid that does not include tender guarantee, or includes tender guarantee that does not comply to the conditions in the tender documentation, will be rejected by the Contracting Authority as unacceptable.

7.5.1 The conditions for signing the contract with the most favorable economic operator is the provision of bank guarantee by the selected best bidder in the amount of 5% of the contract value.

7.5.2 The guarantee from item 7.5.1 is submitted as bank guarantee in written form. The guarantee should be submitted in its original form. No copies are accepted.

The payment under this Contract shall be made by submitting an invoice based on monthly performance.

The monthly invoice shall be submitted along with a verified monthly situation and report from the carrier of the procurement, and from that day, within 15 days it will be paid by the Orderer.

Advance payment is not allowed for the execution of the public procurement contract.

Every economic operator that has a legal interest for winning the public procurement contract or who suffered, or could suffer, damage from eventual violation of the provisions from the Law on Public Procurement, can request legal protection against the decisions, actions and omissions to undertake actions by the Contracting Authority in the procedure for awarding of public procurement contract.

The right to appeal in a procedure that ends with an electronic auction in terms of determining the capability of the candidates and complete evaluation of the initial bids is accomplished after the passing of the decision for selection of the best bidder or annulment of the procedure.
