Any bidder shall be excluded from the procedure for awarding a PPP Contract by the Public Partner if the bidder:
- in the last 5 years has been not rendered a final decision for participation in a criminal organization, corruption, fraud or money laundering;
- is in the process of bankruptcy or liquidation proceedings;
- has unpaid taxes, contributions and other duties, except if the economic operator has been approved a deferred payment of those taxes, contributions and other duties in accordance with the special regulations, and pays its installments regularly.
- has been sentenced sanction - ban on performing profession, activity or duty, i.e. temporary prohibition for performing certain activities
- has been sentenced additional punishment - ban on participation in procedures for public announcement, the award of public supply contracts and public private partnership;
- has been sentenced a misdemeanor penalty - additional temporary or permanent prohibition to perform certain activities; or
- gives false information or does not submit the data required by the public partner.

To prove the economic and financial statement, the bidder (legal entity) shall submit a report on the balance sheet and income statement for the last 3 years. (2010, 2011 and 2012), certified by a competent authority, i.e. audited balance sheet and income statement, or extracts from the balance sheet and income statement in cases where publication of balance sheet and income statement is prescribed by law in the country the economic operator is registered in.
To prove the economic and financial statement, the bidder (legal entity) shall submit a report on the balance sheet and income statement for the last 3 years. To qualify as eligible to perform the contract for public private partnership in terms of its economic and financial statement, the bidder must prove that in the last 3 (three) years (2010,2011 and 2012) achieved a profit in all the three years and a total turnover in the minimum amount of EUR 10,000,000.00. (Exchange of denars into euros shall be made in accordance with the official exchange rate of the National Bank of Macedonia, and the exchange rates are those that were applicable 14 days before the deadline for submission of the bids).

The bidder shall prove the fulfillment of minimum requirements of item by submission of:
- A certified copy of the license B for performance of construction
- A certified copy of the license B for design
- Reference list of completed works in last 5 years in construction (Buildings) and
- Reference list of services rendered in the last 3 years in the domain of design of constructions, i.e. buildings.

In order to be qualified as capable for performing the contract in terms of its technical and professional ability, the bidder (legal entity) must:
- be licensed to perform construction;
- be licensed to design buildings and
- have adequate experience in designing and performance of buildings

The bid shall be accompanied by a bid bond to the extent of at least 0.2% of the assessed value of the PP project (at least EUR 25,208.20)The bid bond shall be in form of a bank guarantee issued by a renowned bank selected by the economic operator.The bid bond shall be submitted in original copy. Photocopies are not acceptable. ; Signing the contract with the selected most favorable bidder shall be conditioned by provision of a performance bond by the selected most favorable bidder regarding the contract to the extent of 5% of the assessed value of the PP project (at least EUR 630,205.00). The guarantee of item shall be submitted in form of a bank guarantee in written form. The guarantee shall be in original form. Photocopies are not acceptable.

In case the consortium is selected as the most favorable bidder, it shall, within 7 days before conclusion of the PPP Contract, register a CSP in the Republic of Macedonia – which would have a status of a private partner, which would sign (conclude) the PPP Contract and would be holder of all rights and obligations arising from this tender and documentation and the PPP Contract.

In case the consortium is selected as the most favorable bidder, it shall, within 7 days before conclusion of the PPP Contract, register a CSP in the Republic of Macedonia – which would have a status of a private partner, which would sign (conclude) the PPP Contract and would be holder of all rights and obligations arising from this tender and documentation and the PPP Contract.
CSP from article 1 of this subparagraph shall be constituted as a limited liability company according to the Law for trade companies of the Republic of Macedonia, with basic financial assets of at least 5,000 Euros for a period of time not shorter than the end date of the guarantee for the warranty period. CSP shall have a private partner status.

CSP from article 1 of this subparagraph shall be constituted as a limited liability company according to the Law for trade companies of the Republic of Macedonia, with basic financial assets of at least 5,000 Euros for a period of time not shorter than the end date of the guarantee for the warranty period. CSP shall have a private partner status.
Други посебни услови:
The Private partner shall issue a bond for the warranty period, not later than 14 days after the day of the final technical acceptance, valid at least for 2 years upon the day of issuing.
This bond shall be issued to cover the deficiencies of the construction works for the administrative part of the object – owned by the Public partner in the given time period of 2 years upon completion
If the Private partner does not issue a Bond for the warranty period, the PPP contract shall be deemed terminated and the Private partner shall be considered responsible for such termination, under the conditions determined in the PPP contract.The Bond shall be in the amount of 10% of EUR 2,898,940.00 which represents 23% of the estimated value of the PPP project, e.g. the Bond for the warranty period shall be in the amount of EUR 289,894.00.
If the Private partner does not issue a Bond for the warranty period, the PPP contract shall be deemed terminated and the Private partner shall be considered responsible for such termination, under the conditions determined in the PPP contract.The Bond shall be in the amount of 10% of EUR 2,898,940.00 which represents 23% of the estimated value of the PPP project, e.g. the Bond for the warranty period shall be in the amount of EUR 289,894.00.
