1.The Contracting Authority shall exclude from the procedure for awarding a public procurement contract,any economic operator that:

— within the last 5 years has had a legally effective judgment pronounced against him/her for participation in a criminal organization, corruption, fraud or money laundering,

— is subject to a bankruptcy procedure or a liquidation procedure,

— has unpaid taxes, contributions or other public dues,

— has been pronounced with an additional judgment…

… prohibiting the participation in public procedures, public procurement contract awarding and public private partnership contracts,

… for temporary or permanent prohibition for performing of a certain activity,

— has a misdemeanor sanction involving prohibition to perform a profession, activity or duty, or temporary prohibition to perform a specific activity, and,

— gives false information or fails to submit the data requested by the Contracting Authority.

2.To prove his/her personal circumstance, the economic operator shall submit the following documents:

— statement of the economic operator that, within the last 5 years, it has not had any legally effectivejudgment for participation in a criminal organization, corruption, fraud or money laundering, pronounced against it,

— confirmation that it is not subject to an…

… open bankruptcy procedure by a competent authority,

… opened liquidation procedure by a competent authority,

— confirmation for paid taxes, contributions and other public dues issued by a competent authority in thecountry where the economic operator is registered,

— confirmation from the Registry of penalties for committed criminal acts of the legal entities that it…

… was not pronounced with a second penalty prohibiting the participation in the public procedures, the publicprocurement contract procedures and the public private partnership procedures,

… wasnot pronounced with a second penalty for temporary or permanent prohibiting for performing certain activity,

— confirmation that there is no legally effective judgment imposing a misdemeanor sanction involving prohibitionto perform a profession, activity or duty, or prohibition to perform a specific activity, imposed against it

3. The statement referred to in indent 1, sub-item 2 is prepared in an electronic form and is signedwith an electronic signature by the economic operator, and the same should not be verified by a competent authority.

4. The confirmations that there are no open bankruptcy and liquidation procedures are issued by competentauthorities in the country where the economic operator is registered. The Central Registry of RM is thecompetent authority for issuing such confirmations in the Republic of Macedonia.

5. The confirmation for paid taxes, contributions and other public dues is issued by a competent authority inthe country where the economic operator is registered. The Public Revenues Office is the competent authority inthe Republic of Macedonia for issuing of this confirmation.

6. The confirmation referred to in indent 5, sub-item 2.2.2 is issued by the competent authority of the countrywhere the economic operator is registered. The Central Registry of RM is the competent authority for issuing ofthis confirmation in the Republic of Macedonia.

7. The confirmation referred to in indent 6, sub-item 2.2.2 is issued by the competent authority of the countrywhere the economic operator is registered. The Central Registry of RM is the competent authority for issuing ofthis confirmation in the Republic of Macedonia.

8. The confirmation referred to in indent 7, sub-item 2.2.2 is issued by the competent authority of the countrywhere the economic operator is registered. The Central Registry of RM is the competent authority for issuing ofthis confirmation in the Republic of Macedonia.

9. The documents referred to in sub-item 2.2.2 must not be older than 6 (six) months counted backwardsfrom the final deadline for submission of the tenders.

10. If the country where the economic operator is registered does not issue the documents referred to in sub-item 2.2.2 or if the documents do not include all cases stipulated above, the economic operator may submit astatement notarized with a competent authority.

11. If economic operators submit a tender as a group of economic operators, all members of the group shallprove their personal circumstances individually.

12. The economic operator must submit a document that proves enrolment in a professional or trade register to prove that it has been registered as a company for performing the activity related to the subject of this public procurement contract

Економска и финансиска состојба:

report on the balance sheet notarized by a competent authority, i.e. audited balance sheet, or excerpts from the balance sheet in cases when the disclosure of the balance sheet is prescribed by law in the country wherethe economic operator is registered; or,

— statement of the total turnover of the enterprise (information from the income statement issued by a competent authority, i.e. audited income statement) and, if appropriate, statement of the turnover specific to the area covered by the public procurement contract, for the latest 3 years for which such data are available depending on the date when the enterprise was established or has begun to work and depending on the availability of such information.

Минимално ниво(а) на стандарди:

— The economic operator must have a turnover of 600 000 000 MKD for each of the last 3 fiscal years (2010, 2011, 2012).

Техничка и професионална способност:

— copy of License B for construction issued by the Ministry of transport and communications of the Republic of Macedonia in accordance with the Construction Law of the Republic of Macedonia,

— copy of employment documents, authorization B for construction issued bu the Chamber on Authorized Architects and Engineers of RM and short resume (CV( for the proposed key engineers,

— copy of employment documents for the proposed professional staff,

— confirmation document from a relevant employment agency for the number of employees of the economic operator issued no sooner than 30 days prior to the deadline for bid submission and a relevant proof for the professional qualifications of the professional staff,

— letter of recommendation for quality performance for at least five civil works contracts in the last five years similar in scope, complexity and nature to the subject works. The recommendation letters should bear information on contract price, time and location (if not, copies of the contracts or other relevant documents must be submitted) as well as a declaration that the works have been completed in accordance with the professional standards and in the stipulated time,

— relevant proof for ownership of the required technical equipment required for performing the works.

Минимално ниво(а) на стандарди:

— License B for construction of second category buildings in accordance with the Construction Law of Republic of Macedonia,

— One main construction engineer (architect or civil engineer) and two key staff engineers (electrical and mechanical engineer) each with at least 10 years of experience in construction of second category buildings and with an authorization B for construction, as full time regular employees with the economic operator,

— at least the following professional staff for conducting the works: 10 plumbers, 10 electricians, 10 staff members specialized in heating system installation, 10 welders, 5 sheet-metal workers and 8 carpenters,

— 500 full time employees,

— Successful completion as a main constructor of at least five civil works contracts in the last five years similar in scope, complexity and nature to the subject works, each in the amount not less than 180 000 000 MKD,

— The economic operator must have the following technical equipment:

— ten trucks,

— three bulldozers (hydraulic or wheeled),

— laboratory for quality control of works (soil, concrete),

— scaffold min. 1 000 m

— one mobile crane min. 20 t.
