Final deadline for submission of the bids is 9.1.2014 until 14.00 h. The bids are submitted to the following address: Ministry of Justice-Directorate for Execution of Sanctions, Jurij Gagarin street No.15-1000 Skopje, Republic of Macedonia, marked 'Za otvorena postapka br.21/2013' (For Open Procedure n.21/2013). The bid that will be submitted after the expiry of the final deadline for submission of the bids shall be rejected as late and will be returned unopened to the economic operator. Bids can be submitted only by economic operators that have obtained certified copy of the tender documentation from the Contracting Authority.

The Contracting Authority will exclude from the procedure for awarding public procurement contract every economic operator who:

— Was subject to court verdict in effect in the last five years for involvement in criminal organization, corruption, fraud or money laundering;

— Who is subject to imposed temporary penalty –prohibition for performing acts of public call, awarding public procurement contracts and contracts for public private partnership

— Who is subject to imposed temporary penalty - interim or permanent prohibition for performing of specific activity

— Who is under bankruptcy or liquidation procedure;

— Who did not pay taxes, contributions and other public duties unless the economic operator is granted deferred payment of taxes, contributions or other taxes in accordance with special regulations and if they are paid regularly ;

— Who is subject to imposed misdemeanor sanction – prohibition from performing of the profession, activity or duty i.e. interim prohibition for performing of specific activity,

— Who provides fake data or does not provide the data requested by the Contracting Authority.

The economic operator provides the following documents in order to prove his personal status:

— Statement from the economic operator that he was not subject to court verdict in effect in the last 5 years for involvement in criminal organization, corruption, fraud or money laundering;

— Confirmation that no liquidation procedure was opened by relevant authority;

— Confirmation that he is not subject to bankruptcy or liquidation procedure;

— Confirmation for clearance regarding paid taxes, contributions and other public duties issued by the relevant authority in the country where the economic operator is registered;

— Confirmation from the Register of sanctions for criminal acts of legal entities that he was not subject to court verdict temporary penalty - prohibition for performing acts of public call, awarding public procurement contracts and contracts for public private partnership;

Confirmation from the Register of sanctions for criminal acts of legal entities that he was not subject to court verdict temporary penalty - interim or permanent prohibition for performing specific activity

— Confirmation that he is not subject to imposed misdemeanor sanction – prohibition to perform the profession, activity or duty i.e. temporary prohibition for performing specific activity.

In order to qualify as capable for realization of the contract for public procurement from the aspect of his professional activity, the economic operator has to meet the following requirements:

— to be registered for performing the activity related to the subject of the public procurement contract

In order to prove his capacity for realization of the professional activity, the economic operator submits the following documents:

— document for registered activity – DRD form, as proof that he is registered as legal person for performing of the activity related to the subject of the public procurement contract, or proof that he is member of the relevant professional association, in accordance with the regulations of the country of registration. In the Republic of Macedonia the relevant authority to issue this document (DRD form) is the Central Register of Republic of Macedonia

Техничка и професионална способност:

2.4.1 In order to qualify as capable to execute the subject of the public procurement contract in terms of its technical or professional capacity, the economic operator shall fulfill the following minimum conditions:

— to be authorized by the vehicle manufacturer, subject to the procurement, to import and sell the vehicle on the territory of RM,

— to own authorization to service the vehicle by the manufacturer or to have contract with authorized service provider for the vehicle, subject to the procurement,

— to own technical equipment and competence to execute the subject of the procurement in accordance with all standards,

— to provide free technical check of the vehicle every 6 months in authorized service provider during the guarantee period,

— to be equipped to maintain and service the vehicle and to build in original spare parts and consumables from the authorized dealer of the particular brand, that meet the manufacturing specifications and quality standards of the vehicle manufacturer,

— to provide tow service in case of malfunction of the vehicle or car accident, on the territory of RM during the guarantee period

— to present the technical characteristics of the offered vehicle through delivered catalogues/photographs of the vehicle or upon request to provide test drive.

2.4.2 The economic operator proves the fulfillment of the technical or professional capacity in sub point 2.4.1 by submitting the following:

— contract/authorization for authorized dealer of the motor vehicle, subject of the procurement

— contract/authorization for servicing the vehicle by the manufacturer or contract with authorized service provider for servicing the vehicle subject to the procurement

— statement for technical preparedness and competence and for the other potentials available to provide the subject of the procurement and quality assurance in line with all standards (sales space, service and warehouse for spare parts)

— statement that free technical check of the vehicle will be provided every 6 months by authorized service during the guarantee period

— statement that it will maintain and service the vehicle and build in original spare parts or consumables by the authorized dealer of the particular brand, that meet the manufacturing specifications and quality standards of the vehicle manufacturer

— statement that the bidder will provide tow service free of charge in case of malfunction of the vehicle or car accident on the territory of RM during the guarantee period

— statement that it will provide free change/balance of summer and winter tires during the guarantee period

— catalogs, photographs of the vehicle with specification of the detailed technical characteristics of the offered vehicle and test drive (upon request)

— notification on the elements of the contract that the economic operator intends to subcontract to third parties, as well as data regarding all proposed subcontractors (company, headquarters, tax identification number etc.)

2.4.3 The technical and professional capacity of the economic operator may be supported by other entity, regardless of the legal relations between the economic operator and the other entity. If the economic operator proves its technical and professional capacity referring to the support of other entity, he is obliged to prove the support with statement of the entity that is making available the adequate technical and professional resources to the economic operator. The entity that provides technical or professional support shall submit a statement that no final verdict was pronounced to him for participation in criminal organization, corruption, fraud or money laundering.

2.4.4 If the economic operators submit a bid as a group of economic operators, the technical and professional capacity is proved by taking into consideration the resources of all members of the group. If the group of economic operators appears with technical or professional support of third party or third parties, the technical and professional capacity is determined in accordance with the above.

Потребни депозити и гаранции:

As part of the bid, the economic operator compulsory provides tender guarantee in the amount 3 % of the bid, VAT excluded.

4.6.2 The guarantee is in a form of bank guarantee, issued by reputed bank institution, selected by the economic operator. All banks are acceptable for the Contracting Authority.

4.6.3 The guarantee should be submitted in original. No copies are accepted. The guarantee must be valid at least 14 days after the tender validity period. Every bid that does not include tender guarantee, or includes tender guarantee that does not comply to the conditions in the tender documentation, will be rejected by the Contracting Authority as unacceptable.

7.5.1 The condition for signing the contract with the most favorable economic operator is the provision of bank guarantee by the selected best bidder in the amount of 10 % of the contract value.

7.5.2 The guarantee from item 7.5.1 is submitted as bank guarantee in written form. The guarantee should be submitted in its original form. No copies are accepted.

No advance payment is allowed for the preparation of the public procurement contract.

The public opening of the bids may be attended by any interested person.

Only representatives authorized by the bidders may participate in the procedure of public opening of the bids by giving their comments which would be entered in the minutes of the opening of bids.

The authorized representatives of the economic operators present on the opening must have authorization signed by the responsible person of the economic operator. All authorized representatives of the economic operators, present at the public opening, should sign the registration list.

Every economic operator that has a legal interest for winning the public procurement contract or who suffered, or could suffer, damage from eventual violation of the provisions from the Law on Public Procurement, can request legal protection against the decisions, actions and omissions to undertake actions by the Contracting Authority in the procedure for awarding of public procurement contract.

The right to appeal in a procedure which ends in e-auction in terms of determining the capacity of the bidders and the overall evaluation of the initial bids shall be used following the passing of the Decision for selection of most favorable bidder or the invalidation of the procedure.
