Cleaning of the canals for drainage and irrigation in the year 2014” for the requirements of the Water Management Directorate with the MAFWE.

2.2 Personal condition

2.2.1 The contracting authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership;

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity;

— it is in bankruptcy or liquidation proceedings;

— it has unpaid taxes and other public charges, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer;

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity; and

— it provides false information or fails to submit the information requested by the contracting authority.

2.2.2 In order to prove its personal condition, the economic operator shall submit the following documents:

— A declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— confirmation that there are no bankruptcy proceedings by the competent authority;

— confirmation that there is no liquidation procedure by the competent authority;

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that minor…

… penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership has not been imposed;

… penalty for temporary or permanent prohibition of a specific activity has not been imposed;

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

2.2.3 The statement in indent 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 The confirmations that there are no bankruptcy proceedings and liquidation proceedings, as well as the certificates from the Register of penalties for criminal acts in indents 5 and 6 of subsection 2.2.2, shall be issued by competent authorities in the country in which the economic operator is established. In the Republic of Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The receipt for paid taxes, contributions and other charges shall be issued by a competent authority of the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue such certificates is the Public Revenue Office.

2.2.6 The receipt in indent 7 of subsection 2.2.2 shall be issued by the competent authority in the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue this certificate is the Central registry of the Republic of Macedonia.

2.2.7 The documents referred to in sub- item 2.2.2 must not be older than 6 months from the deadline for submission of bids.

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2 or if they do not encompass all the cases mentioned above, the economic operator may submit a statement certified by a competent authority.

2.4 Economic and financial condition

2.4.1 In order to qualify as capable of performing the contract for procurement from the aspect of its economic and financial situation, the economic operator must meet the following minimum requirements:

— To have a minimum average total income of 100 000 000 MKD within the last 3 years (the total for the three years/3),

— for Lot 1, to have a minimum average monthly revenue of 8 000 000,00 MKD in the past 3 years (a total sum for the three years/3),

— for Lot 2 to have a minimum average monthly revenue of 29 300 000,00 MKD in the past 3 years (a total sum for the three years/3),

for Lot 3 to have a minimum average monthly revenue of 12 400 000,00 MKD in the past 3 years (a total sum for the three years/3),

for Lot 4 to have a minimum average monthly revenue of 20 600 000,00 MKD in the past 3 years (a total sum for the three years/3),

for Lot 5 to have a minimum average monthly revenue of 16 000 000,00 MKD in the past 3 years (a total sum for the three years/3),

for Lot 6 to have a minimum average monthly revenue of 9 700 000,00 MKD in the past 3 years (a total sum for the three years/3),

for Lot 7 to have a minimum average monthly revenue of 1 800 000,00 MKD in the past 3 years (a total sum for the three years/3),

for Lot 8 to have a minimum average monthly revenue of 2 200 000,00 MKD in the past 3 years (a total sum for the three years/3),

— To have a positive financial result (income statement) for the last 3 years.

In cases in which the economic operator participates for several lots, the minimum average total revenue for the past 3 years (a total sum for the 3 years) should be the total sum of the lots for which he/she participates on the bid.

2.4.2 If the economic operator carries on business in a period of less than 3 years, a minimum requirement for establishing the economic and financial condition of the economic operator has achieved the turnover of sub-item 2.4.1 in the years for which data are available.

2.4.3 The economic operator shall prove the fulfilment of the minimum requirements stipulated in item 2.4.1 or 2.4.2 by submitting the following:

— Balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance-sheet is required under the law of the country where the economic operator is established;

— Statement of overall turnover (data from the income statement issued by the competent authority, i.e. audited balance sheet) and, where appropriate, of turnover in the area covered by the contract and the last three financial years for which such data are available, depending on the date on which the company was founded or started to work and depending on the availability of such information.

2.4.4 If the balance sheet and income statement have been subject to commercial audit, the economic operator may submit them as proof that it meets the minimum requirement for establishing the economic and financial situation without being further verified by the competent authority.

2.4.5 If the balance sheet and income statement have not been subject to commercial audit, the economic operator shall submit them as certified or issued by a competent authority to prove that it meets the minimum requirement for establishing the economic and financial situation. The competent authority in the Republic of Macedonia is the Central Registry of the Republic of Macedonia.

2.4.6 Economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and the subject, except in the case of data from the income statement. If the economic operator proves its economic and financial capability referring to the support of another entity it is required to demonstrate that support with valid evidence that the entity will make available the financing to the economic operator. The entity provides financial support must not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.4.7 If economic operators submit a bid as a group of economic operators, the economic and financial situation is proved by taking into account the resources of all group members. If the group of economic operators started with financial support from a third entity, the economic and financial situation is determined according to the above mentioned.

2.4 Economic and financial condition

2.4.1 In order to qualify as capable of performing the contract for procurement from the aspect of its economic and financial situation, the economic operator must meet the following minimum requirements:

— To have a minimum average total income of 100 000 000 MKD within the last 3 years (the total for the 3 years/3)

— for Lot 1, to have a minimum average monthly revenue of 8 000 000,00 MKD in the past 3 years (a total sum for the 3 years/3),

— for Lot 2 to have a minimum average monthly revenue of 29 300 000,00 MKD in the past 3 years (a total sum for the 3 years/3),

for Lot 3 to have a minimum average monthly revenue of 12 400 000,00 MKD in the past 3 years (a total sum for the 3 years/3),

for Lot 4 to have a minimum average monthly revenue of 20 600 000,00 MKD in the past 3 years (a total sum for the 3 years/3),

for Lot 5 to have a minimum average monthly revenue of 16 000 000,00 MKD in the past 3 years (a total sum for the 3 years/3),

for Lot 6 to have a minimum average monthly revenue of 9 700 000,00 MKD in the past 3 years (a total sum for the 3 years/3),

for Lot 7 to have a minimum average monthly revenue of 1 800 000,00 MKD in the past 3 years (a total sum for the 3 years/3),

for Lot 8 to have a minimum average monthly revenue of 2 200 000,00 MKD in the past 3 years (a total sum for the 3 years/3),

— To have a positive financial result (income statement) for the last 3 years.

In cases in which the economic operator participates for several lots, the minimum average total revenue for the past 3 years (a total sum for the 3 years) should be the total sum of the lots for which he/she participates on the bid.

2.4.2 If the economic operator carries on business in a period of less than 3 years, a minimum requirement for establishing the economic and financial condition of the economic operator has achieved the turnover of sub-item 2.4.1 in the years for which data are available.

2.4.3 The economic operator shall prove the fulfilment of the minimum requirements stipulated in item 2.4.1 or 2.4.2 by submitting the following:

— Balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance-sheet is required under the law of the country where the economic operator is established;

— Statement of overall turnover (data from the income statement issued by the competent authority, i.e. audited balance sheet) and, where appropriate, of turnover in the area covered by the contract and the last 3 financial years for which such data are available, depending on the date on which the company was founded or started to work and depending on the availability of such information.

2.4.4 If the balance sheet and income statement have been subject to commercial audit, the economic operator may submit them as proof that it meets the minimum requirement for establishing the economic and financial situation without being further verified by the competent authority

2.4.5 If the balance sheet and income statement have not been subject to commercial audit, the economic operator shall submit them as certified or issued by a competent authority to prove that it meets the minimum requirement for establishing the economic and financial situation. The competent authority in the Republic of Macedonia is the Central Registry of the Republic of Macedonia.

2.4.6 Economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and the subject, except in the case of data from the income statement. If the economic operator proves its economic and financial capability referring to the support of another entity it is required to demonstrate that support with valid evidence that the entity will make available the financing to the economic operator. The entity provides financial support must not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.4.7 If economic operators submit a bid as a group of economic operators, the economic and financial situation is proved by taking into account the resources of all group members. If the group of economic operators started with financial support from a third entity, the economic and financial situation is determined according to the above mentioned.

2.5 Technical or professional ability

2.5.1 In order to qualify as capable of performing the contract for procurement from the aspect of its technical and professional capability, the economic operator must meet the following minimum requirements:

— To have A or B license contractor;

— To have a minimum of 5 performed same or similar works (performing works of hydro- construction and civil engineering) in the last 5 years;

—To have a minimum of 2 full-time employees that are graduate civil engineers with A or B license for performance in the area of the construction industry; and

— To have at least 15 full-time employed construction workers for Lot 8;

— To have a minimum of 2 excavators, 1 bulldozer and 2 registered trucks tippers;

— For Lot 2, 3, 4 and 6, one of the excavators to be an excavator for excavation with a flat engine for excavation in water;

For Lot 8, there is no need for submission of a proof for 2 registered truck tippers, because transport of extra material is not envisaged.

In a case in which the economic operator participates for more Lots, the minimum number of excavators, bulldozers and trucks should be a total number from all lots in which it participates.

2.5.2 The economic operator shall prove the fulfilment of the minimum requirements stipulated in sub-item 2.5.1 by submitting:

— A or B contractor license;

— A or B rating authorization for performance in the are of the construction industry for professionals;

— List of same or similar works realized in the past 5 years, by submitting the agreements committed for the same or similar works, or to deliver certificates for timely and quality execution of works for which the list is submitted, which should contain the value of the contract and implementation period as well as statements whether the work is performed in accordance with the rules of business;

— Statement on the professional staff who will participate in the implementation of activities with their educational qualifications and professional commitments (CV), with a list of projects in which it participated in the last 5 years;

— Every executor should submit a proof of regular employment with the bidder (M1/M2 form);

— Description of the technical equipment of the economic operator with proofs of ownership or lease, leasing of machinery. (in cases where the proof of ownership is written in a foreign language, in addition to the evidence submitted to it a certified translation into Macedonian language by a court translator is necessary). Regarding the trucks, vehicle registration documents for the trucks should be submitted as evidence;

— Report on the elements of the contract which the economic operator intends to subcontract to third parties.

2.5.3. If the economic operator is a foreign legal entity with foreign experts, the fulfilment of its technical and professional capacity shall be proven by submitting the following evidence:

— Certificate issued to the contractor by the state administration responsible for the affairs of the spatial arrangement in accordance with the Law on Construction (Official Gazette of RM no. 130/09, 124/10, 18/11, 36 / 11, 54/11, 13/12, 144/12, 25/13 and 79/13);

— A or B rating authorization for performance in construction works of the professional personnel issued by the appropriate institution of his home state, which must be confirmed by the Court of certified architects and engineers of the Republic of Macedonia.

— List of same or similar executed works in the last 5 years (original and translation by a certified translator);

— Receipt for timely and quality execution of works for which the list is submitted, that should include the contract value and period of implementation and statements whether the work is performed in accordance with the rules of business (original and translation by a certified translator);

— Statement on the professional staff who will participate in the implementation of activities with their educational qualifications and professional commitments (CV), a list of projects on which they participated in the last 5 years, in accordance with the criteria for evaluation. For every executive a proof of regular employment with the bidder (original and translation by a certified translator) should be submitted;

— Description of the technical equipment and capability of the bidder with proof of ownership or lease, leasing of machinery.

2.5.4 All the above stated documents shall be prepared and signed by the economic operator and they doesn't have to be certified by a competent authority.

2.5.5 The technical and professional capacity of economic operators may not be supported by another entity, regardless of the legal relations between the economic operator and the entity, except for the reference list, previously signed contracts and licenses. If the economic operator proves its technical and professional capability referring to the support of another entity it is required to demonstrate that support with valid evidence that the entity will indeed make available the technical and professional resources to the economic operator. The entity provides technical and professional support should not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.5.6 If the economic operators submit a bid as a group of economic operators, technical and professional capacity shall be proved by taking into account the resources of all members of the group whereby the economic operator — Bidder (group leader) should independently meet the requirement for A or B contractor licenser. If the group of economic operators participates with technical and professional support of a third entity or third parties, technical and professional capacity shall be determined according to the above mentioned.

2.6 Standards for quality systems

2.6.1 To qualify as capable of performing the contract for procurement from the aspect of standards for quality systems, the economic operator shall meet the following standards:

— Standard quality system.

2.6.2 The economic operator shall prove the fulfilment of the standards stipulated in sub- item 2.6.1 by submitting:

— Valid ISO 9001 certificate.

2.7 Standards for Environmental Management.

2.7.1 To qualify as capable of performing the contract for procurement from the aspect of standards for environmental management, the economic operator shall meet the following standards:

— Standard for environmental management.

2.7.2 The economic operator shall prove the fulfilment of the standards stipulated in sub-item 2.7.1 by submitting:

— Valid Certificate ISO 14001.

2.3 Ability to perform professional activity.

2.3.1 In order to demonstrate the ability to perform professional activity, the economic operator should submit a document for registered activity that is registered as a legal entity for conducting activities related to the subject of the contract or proof that it belongs to association in accordance with the regulations of the country where it is registered.

To have a constructor license A or B.
