2.2 Personal situation

2.2.1 The contracting authority shall exclude from the proceedings for awarding a public contract any economic operator:

— that in the last 5 years has been rendered final judgment for participation in a criminal organization, corruption, fraud or money laundering;

— which imposed minor penalty ban on participation in public tender procedures, awarding contracts and agreements for public-private partnership;

— which imposed minor penalty temporary or permanent prohibition of a specific activity;

— which is in bankruptcy or liquidation proceedings;

— which has unpaid taxes and other public charges, unless the economic operator is authorized deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and are regularly paid;

— Who misdemeanor sanction – prohibition of professional activity or duty, ie temporary prohibition for performing professional activity;

— who provides false information or fails to submit the information requested by the contracting authority.

2.2.2 To prove his personal situation, the economic operator shall submit the following documents:

— declaration by the economic operator that in the last 5 years he was rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering;

— confirmation that no bankruptcy proceedings by the competent authority;

— Confirmation that no liquidation procedure by the competent authority;

— certificate for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that have been imposed minor penalty…

… ban on participation in public tender procedures, awarding contracts and agreements for public-private partnership;

… temporary or permanent prohibition of a specific activity;

— confirmation that a final judgment has been rendered sanction - prohibition of professional activity or duty, ie temporary prohibition for performing professional activity.

2.2.3 The statement in line 1, item 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 confirmation that no bankruptcy proceedings and liquidation proceedings, as well as certificates of registry of penalties for criminal acts in lines 5 and 6 of item 2.2.2, issued by competent authorities in the country where the economic operator is established. In Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The receipt for paid taxes, contributions and other charges issued by a competent authority of the country where the economic operator is established. Macedonian authority to issue such certificates PRO.

2.2.6 The receipt of item 7 of item 2.2.2 issued by the competent authority in the country where the economic operator is established. Macedonian authority to issue this certificate is the Republic of Macedonia.

2.2.7 The documents referred to in item 2.2.2 must not be older than six (6) months from the deadline for submission of bids.

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in item 2.2.2 or if they do not include all the above mentioned cases, the economic operator may submit a statement certified by a competent authority.

2.3 Ability to perform professional activity

2.3.1 To demonstrate the ability to perform professional activity, the economic operator should submit a document for registered activity that is registered as a legal entity for conducting activities related to the subject of the contract or proof that it belongs to association in accordance with the regulations of the country where it is registered.

To demonstrate the ability to perform professional activity, the economic operator should possess icenca l (B) contractor to perform construction issued by the competent authority in accordance with state law building

6.3 Legal Protection

6.3.1 Any economic operator who has a legal interest in a public contract and who has suffered or could suffer damage from possible violations of provisions of the Law on Public Procurement, may require legal protection against decisions, actions or failure to actions by the contracting authority in the awarding of public procurement.

6.3.2 The appeal shall be filed within eight days from the day:

— the announcement of the award of a public contract in terms of data, actions or failure to take action by the announcement,

— opening of the bids in respect to actions or failure to take action related to the tender documentation, ie the opening of bids,

— receipt of the decision that determines the individual right of the procedure for awarding a public contract, in terms of determining the ability of applications for participation or evaluation of bids or

— knowledge of illegal procedure for awarding a public contract, no later than one year from the date of completion of the procedure.

6.3.2 An appeal is filed and within three days of receipt of the contract based on a framework agreement.

6.3. 3 The economic operator failing to appeal to the provisions of item 6.3.1, no right of appeal at a later stage of the procedure for the same legal basis.

6.3. 4 The complaint should contain the following elements:

— Data for the complainant (name, name of the operator, residence and office)

— Data representative or attorney

— Name and address of the contracting authority

— Number and date of the procedure for awarding a public contract and data advertisement for awarding a public procurement

— Number and date of the decision of choosing the best bid, or cancelling the other decisions of the contracting authority

— Data for the actions or failure to take action by the contracting authority

— description of the actual situation,

— description of irregularities and explanation,

— suggestion of evidence,

— complaint and / or request a place to compensate costs of the procedure and

— signature of the authorized person and seal.

6.3. 5 The appellant shall submit proof of payment of the fee for the procedure.

6.3. 6 The appellant has not established in the territory of the Republic of Macedonia is obliged to appoint a proxy to receive written.

6.3. 7 The appeal is filed with the State Commission. The appeal shall be submitted in person or by registered mail to both the contracting authority and the State Commission. Date of filing of the complaint by registered mail is considered a day of submission. In case the person filing the complaint contracting authority is obliged to issue a receipt confirming the time of admission.

6.3. 8 In the proceedings before the State Commission, the appellant, in addition to administrative fees, and pay a fee for the procedure depending on the amount of the bid, including:

— 20,000 EUR in MKD, compensation of 100 EUR in counter-

— from 20,000 to 100,000 EUR in MKD, compensation of 200 EUR in counter-

— from 100,000 to 200,000 EUR in MKD, compensation of 300 EUR or equivalent

— over 200,000 EUR in MKD, compensation of 400 EUR in MKD.

6.3. 9 In the absence of an offer, the fee for the procedure are calculated based on the estimated value of the contract, and the State Commission shall notify the complainant of the fee and the period within which to submit proof of payment.

6.3. 10 The fee for the procedure is the Budget of the Republic of Macedonia.

6.3.11 The contracting authority shall not sign the contract and for its execution within 12 days from receipt of the decision that determines the individual right in the procedure for awarding the contract, except:

— According to Articles 99 and 198 of this Law,

To the case where the procedure took only one bidder whose offer the winning or

— In case of individual contracts based on framework agreement.
