Способност за вршење на стручната дејност:

— is a under a bankruptcy or liquidation procedure;

— has unpaid taxes, contributions or other public duties, unless the economic operator is approved delayed payment of taxes, contributions or other public duties, in accordance with the special regulations and pays them on regular basis;

— has been imposed a secondary sentence prohibition on participation in open call procedures, awarding public procurement contracts and contracts for public private partnership;

— has been imposed a secondary sentence temporary or permanent prohibition on performing a certain-activity;

— is being pronounced a misdemeanour sanction prohibition on practising profession, performing activity or duty,i.e. temporary prohibition for performing a particular activity, or

— presents false information or does not submit the information required by the contracting authority.

The economic operator shall submit the following documents for the purpose of proving its personal standing:

— a statement by the economic operator that it has not been imposed a legally valid court decision for participation in criminal organization, corruption, fraud or money laundering in the last 5 years;

— certificate by a competent authority that a…

… bankruptcy procedure has not been initiated;

… liquidation procedure has not been initiated;

— certificate by a competent authority from the country where that economic operator is registered for paid taxes, contributions and other public duties;

— certificate by the Register of sentences for committed crimes of legal entities that a secondary sentence…

… prohibition on participation in open call procedures, awarding public procurement contracts and contracts for public private partnership, has not been imposed,

… temporary or permanent prohibition on performing a certain activity, has not been imposed

— certificate that a misdemeanour sanction resulting in prohibition for practising profession, performing activity or duty, i.e. temporary prohibition for performing a particular activity has not been imposed by a legally valid court decision.

Each economic operator shall deliver a document for registered activity in order to prove it is registered as a natural person or legal entity to pursue the activity related to the subject-matter of the public procurement contract or a proof that it belongs to a professional association in accordance with the regulations of the country where registered.

Each economic operator shall deliver Licence A for the construction of category 1 works in accordance with the Law on Construction in The Republic of Macedonia.

Економска и финансиска состојба:

— Balance sheets certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets, when the announcement of the balance sheet is prescribed by law in the country wherein the economic operator is registered.

— Statement regarding the overall turnover of the enterprise (data on the profit and loss account issued by a competent authority, i.e. audited profit and loss account) for the last 3 financial years.

*Foreign tenderer must submit positive audit report issued by foreign renowned institution registered for performing the audit. The audit report shall contain data on the economic performance of the Foreign tenderer for the last 3 years and should be obligatory translated into Macedonian.

The economic operator to have positive financial result (profit) in each of the last 2 financial years.

Техничка и професионална способност:

Construction work experience:

— Reference list of similar works executed by the tenderers or the candidates in the past 5 years, by enclosing copiеs of the contracts and/or statements about the performed contracts issued by the contractors containing values, dates, location of the execution of the works and indications whether the works have been executed according to the business operations rules and whether they have been finished according to the regulations.

— A statement by the economic operator on the construction work experience.

Staff:

— A statement by the economic operator on the…

… average annual number of employees in the past 3 years and that the economic operator has the required technical personnel with the required qualifications and authorisations for min. 2(two) civil engineers(by enclosing copy of M1 and M2 employment forms or the relevant form issued by a competent institution in the domicile country of the Economic operator and copies of the required authorisations).

… hired key technical personnel in charge for the construction of works, and that the hired personnel will not be substituted during the contract execution, regardless of whether they directly belong to the economic operator. If the hired personnel does not belong to the economic operator, the economic operator shall present a valid proof that the hired personnel will be available during the contract execution (by enclosing CV's and authorisations).

Equipment:

— A statement on the technical equipment available to the economic operator for the execution of the respective works.

— The economic operator shall specify and prove that he has owned or through contract to rent, lease Contract, purchase contract for or other ways have provided the following minimum key equipment in full working condition. Also, the economic operator shall specify alternative equipment which he would propose to use for the contract, together with an explanation of the proposal.

Минимално ниво(а) на стандарди:

Construction work experience:

— The economic operator shall have realized at least 3 contracts performed for the same or similar works in the past 5 years;

— Minimum value of 2 realized contracts, performed for the same or similar works in the past 5 years shall amount to 30 000 000 MKD with VAT for each contract.

Staff

— The economic operator shall have an average number of personnel employed in full-time employment in the last 3 years minimum of 20 Persons of which 2 persons civil engineers with authorization ‘A' for performance of buildings from the first category (to be submitted in addition M1/M2 forms or confirmation of authorized institution) of which: — minimum of 2 civil engineers authorization ‘A' for construction;

The economic operator to specify key technical personnel on a construction site in charge for construction of work that needs to meet the following minimum requirements:

— minimum of 2 Civil Engineers authorization ‘A’ for construction.

a) 1 (one) Head of Construction — Bachelor of Civil Engineering with the authority ‘A’ for construction with min. 10 years. the experience of objects of a similar nature,

b) 1 (one) Assistant for earth works and concrete works — with min. 7 (seven) years the experience of objects of a similar nature,

c) Laboratory Assistant — Construction Technician — Laboratory experience with a minimum of 7 (seven) years as a laboratory technician,

d) 1 (one) Assistant asphalt works — with min. 7 (seven) years the experience of objects of a similar nature and

e) 1 (one) Geodetic engineer with minimum the experience of 7 (seven) years as a surveyor.

The economic operator has to submit CV (curriculum vitae) for each of the proposed technical personnel on a construction site — the first and an alternative (if the bidder believes that shall state alternative), Authorizations the required and photocopy of the completed university degrees.

The specified technical personnel has to be available at the construction site throughout the duration of the contract regardless of whether it belongs to of economic operator and if the said technical personnel on a construction site does not belong to the economic operator to prove its availability.

Equipment

The economic operator should specify and prove that he has owned or through contract to rent, lease Contract, purchase contract for or other ways have provided the following minimum key equipment in full working condition.

a) minimum 1 (one), excavator

b) minimum 2 (two) graders with engine power 140KC

c) minimum 5 (five) tipper truck

d) Asphalt equipment production capacity 60 t/c, located on the territory of RM

e) minimum 1 (one) Crane / truck by hand,

f) A concrete base with a production capacity of concrete 20 m³/c, located on the territory of RM,

g) minimum 2 (two) water pumps with capacity 1 (one) of pump 500 litre/hour,

h) Paver Installation of asphalt,

i) Minimum 2 compaction means,

j) minimum 3 (three) vibrating roller and 1 (one) rubber roller for asphalt work,

k) minimum 3 (three) concrete mixer truck with a capacity from 6 m³,

l) Current laboratory tests during construction,

m) minimum 3 (three) excavators.

Also, the economic operator should specify alternative equipment which he would propose to use for the contract, together with an explanation of the proposal.

Потребни депозити и гаранции:

Tender guarantee in the form of bank guarantee [3 %].

Guarantee for implementation of the contract in a quality manner in the form of a bank guarantee [15 %].

All other information about the guarantees are determined in the tender documentation.

Contracting authority will not require from the group of economic operators to associate in a specific legal-form, for the purpose of executing the contract.
