— statement of the economic operator that within the past 5 years they were not issued with an effective decision for participation in a criminal organization, corruption, fraud or money laundering;

— certificate for paid taxes, contributions and other public taxes by an authorized body in the country where the economic operator is registered;

— assessment of the Registry for fines for crimes of the legal entities that they were not issued with a minor penalty — prohibition for participation in procedures for public bidding, awarding contracts for public procurement and contracts for public-private partnerships;

— certificate of the Registry for fines for crimes of the legal entities that they were not issued with a minor penalty — temporary or permanent prohibition for performance of certain activity;

— certificate that there is no effective court decision for crime sanction — prohibition on performance of profession, activity or duty respectively temporary prohibition for performance of a certain activity.

Економска и финансиска состојба:

Necessary documents for validation of the economic condition of the economic operator:

— Report on the balance sheet certified by an authorized body respectively revised balance sheet or excerpts balance sheet for the situation in cases when the publishing of the balance sheet is foreseen with the law in the country where the economic operator was registered for the last 3 years 2011, 2012 and 2013;

— Report of the overall profit of the company (data of the profit and loss account issued by an authorized body i.e. revised profit and loss account for the last three years 2011, 2012 and 2013) and where appropriate, of the commerce in the area covered with the public procurement agreement, mostly for the past 3 financial years for which there is available data depending on the date when the company was established or started working and depending on the availability of such information.

The minimal criteria for assessment of the economic and financial condition of the economic operator:

— Minimal overall income for the past three (3) years, amounting 2 500 000 EUR in the area of construction i.e. 153 750 000 in MKD currency.

* If the economic operator uses economic-financial support from another subject, this support cannot be higher than 30 % of the terms stipulated for economic and financial capability. Economic-financial support from other subject is not allowed in the part of the data from the income statement.

Техничка и професионална способност:

Necessary documents for validation of the technical or professional capability of the economic operator:

— List of works — built object of building contractions of 1

— Minimum 3 realized agreements for construction of objects of 1

— Certificates (recommendations) for quality and timely performed work of building of 1

— Statement for engagement of the current contracts in the country and abroad with the overall value and deadline of completion.

— Statement of the economic operator for the average annual number of employees and for the number of the technical personnel within the past 3 years.

— Statement for 30 (thirty) employees who will be directly engaged in realization of the subject of the agreement (engineers, technicians and construction workers) including next info:

— name and family name,

— qualification,

— proof of eligibility (qualification) of the staff (persons) listed in the statement (for the engineers and technicians bachelors degree or authorization, and for construction workers documents for qualification or retraining).

— list of employees issued by the Employment Agency, in the moment when the bid is being submitted.

— Statement of the economic operator for the minimum professional staff that will be engaged for realization of the subject of procurement: minimum 3 (three) BA's in Engineering with A or B authorizations for construction (out of which at least two BA’s construction engineers and one construction engineer out of which one BA in construction engineering — construction department, stated with name and surname. For these employees, the bidder needs to submit:

— Authorization of execution.

— A proof (Diploma) for the BA in construction engineering — construction department.

— Referent list of realized objects (with the time and place of realization) within the past 2 years of the professional staff that will be engaged in the realization of the subject of procurement.

— Statement for the elements of the agreement which the economic operator will give to a subcontractor /s and data for the latter (company, address, single tax number, etc.) which fulfil the terms for execution of the works foreseen in the Law on construction.

— Statement certified by a notary public that if they are awarded with the public procurement agreement, the object will be executed by them until the phase shell (without being given to subcontractors).

The minimum criteria for assessment of the technical and professional condition of the economic operator:

For this minimal term, technical support is not allowed.

— Minimum 3 certificates (recommendations) for qualitative and timely executed works of buildings in the 1

— Minimum professional personnel that will be engaged for realization of the subject of procurement, minimum 3 (three) graduate engineers with A or B authorizations for performance (out of which minimum 1 BA engineer architect and 2 (two) BA construction engineers out of which 1 (one) BA in construction engineering — construction department.

— Minimum 30 employees directly engaged in the construction performance of the activity related to the subject of the public procurement agreement (construction),

For this minimal condition no technical support is allowed.

— The object needs to be performed by the bidder minimally to the phase of shell (it cannot be constructed by a subcontractor).

Capability of performance of professional activity of the economic operator:

— Document for registered activity

A registered activity related to the subject of the agreement is needed — document for registered activity — construction (DRD specimen) and A or B licenses for contractor, for performance of buildings of 1

(‘License C for contractor and License D for Contractor issued before the Law on construction entered into force, will continue to be valid until the expiration of the deadline for which the license was issued. The same license may serve in construction of buildings of second category referred to in Article 57 of the Law on construction in RM’).
