Consulting services for conducting a diagnostic analysis on the foreign direct investments system currently in place in Republic of Macedonia with a follow up document on potential improvement measures

The scope of the procurement shall include the procurement of consulting services for conducting a diagnostic analysis on the foreign direct investments system currently in place in the Republic of Macedonia, which will include:
— an analysis of the most promising sectors for additional FDI,
— the diagnostic of the Government's current approach to investment attraction, including the institutional system for FDI attraction (i.e. institutions in charge for attracting FDI, their interaction with each other and with potential investors, eventual over lapses and miscommunications).
The consultant, based on the analysis, will be expected to provide a diagnostic document identifying major opportunities as well as limiting factors in Macedonia's FDI system. These areas of action/improvement include the institutional set-up, sector focus and regulatory environment in Macedonia for attraction of foreign direct investments.

— a statement made by the economic operator that in the previous five (5) years it has not been imposed a legally valid court decision for participation in a criminal organization, corruption, fraud or money laundering;

— a certificate by a competent authority that a bankruptcy procedure has not been initiated against it;

— a certificate by a competent authority that a liquidation procedure has not been initiated against it;

— a certificate by a competent authority from the country where that economic operator is registered for paid taxes, contributions and other public duties;

— a certificate by the Register of sentences for committed crimes of legal entities that a secondary sentence…

… prohibition on participation in open call procedures, awarding public procurement contracts and contracts for public private partnership, has not been imposed,

… temporary or permanent prohibition on performing a certain activity, has not been imposed, and

— a certificate that a misdemeanor sanction resulting in prohibition for practising profession, performing activity or duty, i.e. temporary prohibition for performing a particular activity has not been imposed by a legally valid court decision.

The statement in line 1, shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

The documents proving the personal situation must be issued by the competent authorities of the country in which the economic operator is established.

The contracting authority shall accept all documents issued by the competent authorities of the country in which the economic operator is registered as evidence of meeting the criteria for determining the personal standing of economic operators.

If the country in which the economic operator is registered does not issue the documents from line 2 to line 7 the contracting authority as evidence of meeting the criteria for determining the personal standing shall accept statements of the economic operator certified by a competent authority.

The documents must not be older than six (6) months from the deadline for submission of bids.

In order to demonstrate the capacity to perform a professional activity, the economic operator should submit a document for registered activity as a proof that it is registered as a legal entity conducting activities related to the subject of the public procurement contract or proof that it belongs to a professional association in accordance with regulations of the country where it is registered.

The document shall be attached to the bid in original or copy certified by the bidder.

Техничка и професионална способност:

— reference list of services of the same or similar kind as the public procurement of economic operator in the last three years (2013, 2012 and 2011), with values of contracts, dates of contracts and contracting services (contracting authorities/government institutions in the country or abroad);

— a short CV-portfolio of the economic operator that shall specify the professional experience in the field of analysing and improving FDI attraction systems in the SEE region or internationally;

— a completed statement (enclosed in the tender documentation) for the number of the professional staff (two (2) persons) that the economic operator shall engage for the implementation of the procurement. In addition to the statement, the bidder submits a detailed CV (filling in the form provided in the tender documentation) for all experts - consultants involved in the procurement which proves the relevant experience of persons in the same or similar projects such as the procurement in question;

— an appropriate evidence of professional experience of the consulting team;

— a statement that it is not under any kind of dependence, influence or control of any local or foreign state agency or state agency (attached to the tender documentation), and

— a statement that there is no conflict during the submission of the bid with previous or current obligations to other suppliers, or a position that may lead them to be unable to perform the service in the best interest of the contracting authority (attached to the tender documentation).

The statements shall be signed by the economic operator. The contracting authority reserves the right to review the data listed in the statements and in the case of some doubts about the truth in these statements, the contracting authority has the right to submit them to the competent institutions in the country and abroad.

Минимално ниво(а) на стандарди:

— performed at least 2 services same or similar as the subject of the public procurement in the last 3 years (2013, 2012 and 2011 year) for public institutions in Republic of Macedonia or abroad;

— that the economic operator has professional experience in the field of analysing and improving FDI attraction systems in the SEE region or internationally;

— that the economic operator has a staff of two (2) people (expert — consultants) with a minimum of five (5) years professional experience in the in the field of analysing and improving FDI attraction systems in the SEE region or internationally. The economic operator should submit name and surname, educational and professional qualifications of the persons, position that they shall be responsible for during the implementation of the procurement and years of professional experience; and

— that the economic operator is not in any dependence, influence or control of any local or foreign institution or state government agency and that there is no conflict with the submission of the bid with previous or current obligations to other suppliers, or a position that could lead it in a situation to be unable to perform the service in the best interest of the contracting authority.

The public opening of bids shall be made in the presence of 1 or 2 authorized representatives of economic operators, which choose to attend the opening. While attending the public opening, authorized representatives of the economic operators must have an authorization signed by the responsible person of the economic operator and identification documents.

All bidders that submitted acceptable technical bid shall be notified about the exact date, time and place of the public opening of bids. Acceptable technical bid shall be the bidder who won at least twenty (20) points for the element ‘Quality’ of meat criteria. The Public Procurement Commission shall first evaluate the technical bids of the bidders in accordance with the requirements of the tender documentation and all bidders shall be invited for the public opening of financial bids.

All authorized representatives of economic operators, present at the public opening, shall sign an attendance sheet.
