2 Ability to bidders

2.1 Method of proof of ability

2.1.1 The offer economic operator must provide supporting documentation to prove:

— Personal situation,

— The ability to perform professional activities.

2.1.2 The required documentation shall be submitted in original or certified copy of the economic operator with seal and signature of the responsible person, marked 'True to the original'.

2.1.3 When checking the completeness and validity of the documentation to determine the capability of the economic operator and the evaluation of the tender, the Commission may require economic operators to clarify or supplement the documents, unless it is a significant deviation from the required documentation.

2.1.4 explain the economic operator shall submit in writing within the period determined by the contracting authority.

2.1.5 changes in supply, unless the correction of arithmetic errors, may not be requested or allowed by the commission or the economic operator.

2.1.6 In the case of a group of economic operators, all members of the group individually to demonstrate their personal situation and the ability to perform professional activities.

2.2 Personal situation

2.2.1 The contracting authority shall exclude from the proceedings for awarding a public contract any economic operator:

— That in the last 5 years was announced a verdict for participation in a criminal organization, corruption, fraud or money laundering;

— That is a minor penalty imposed ban on participation in public tender procedures, awarding contracts and agreements for public-private partnership;

— That is a minor penalty imposed temporary or permanent prohibition of professional activity;

— Which is in bankruptcy or liquidation proceedings;

— Which has unpaid taxes and other public charges, unless the economic operator has been granted deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and are regularly paid

— Who sanction - prohibition of professional activity or duty, ie. temporary prohibition for performing professional activity and

— Giving false information or fails to submit the information requested by the contracting authority.

2.2.2 To prove his personal situation, the economic operator shall submit the following documents:

— A declaration by the economic operator in the last 5 years has not been rendered final judgment for participation in a criminal organization, corruption, fraud or money laundering (1 statement);

— Confirmation that no bankruptcy proceedings the competent authority (1 certificate);

— Confirmation that no bankruptcy proceedings for liquidation by the competent authority (1 certificate);

— Receipt for paid taxes, contributions and other public duties by the competent authority of the country in which the economic operator is established (1 certificate);

— Certificate from the Registry of penalties for crimes committed by legal persons that have been imposed minor penalty…

… ban on participation in public tender procedures, awarding contracts and agreements for public-private partnership (1 certificate);

… temporary or permanent prohibition of professional activity (2 confirmed);

— Confirmation that the verdict does not sanction - prohibition on performing a profession, activity or duty, ie. temporary prohibition for performing professional activity (2 confirmed).

2.2.3 The statement in line 1, item 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 The confirmation that no bankruptcy proceedings and liquidation procedure and confirm the registry of penalties for criminal acts in lines 5 and 6 of item 2.2.2, issued by competent authorities in the country where the economic operator is established. Macedonian authority to issue such certificate is the Republic of Macedonia.

2.2.5 The receipt for paid taxes, contributions and other charges issued by the competent authority of the country where the economic operator is established. In Macedonia, the body responsible for issuing this certificate is the public revenue.

2.2.6 Certificates of line 7, item 2.2.2 issued by the competent authority in the country where the economic operator is established. Macedonian authority to issue such certificate is the Republic of Macedonia.

2.2.7 The documents referred to in item 2.2.2 must not be older than six (6) months from the deadline for submission of bids back.

2.3 Ability to perform professional activity

2.3.1 To demonstrate the ability to perform professional activity, the economic operator should submit a document for registered activity as evidence that it is registered as a legal entity performing activities related to the subject of the contract or proof that it belongs to appropriate professional association in accordance with the regulations of the country where it is registered.

The economic operator must be registered to provide access to public fixed communication network and provide public fixed telephone and internet services in the Electronic Communications Agency of the Republic of Macedonia.

6.3 Legal Protection

6.3.1 Any bidder who has a legal interest in a public contract and who has suffered or could suffer damage from possible violations of the provisions of this Act, may require legal protection against decisions, actions or failure to take action by the contracting authority in the procedure for awarding a public contract, in accordance with the conditions and procedure provided by the Law on Public Procurement. The right of appeal procedure ends with an electronic auction in terms of determining the capability of bidders and full evaluation of the initial offer is realized by making the decision to choose the best bidder, or canceling the procedure.

6.3.2 The complaint should contain the following elements:

— Data on the complainant (name, name of the economic operator, address of residence and office)

— Information about the proxy or attorney

— Name and address of the contracting authority;

— Number and date of the procedure for awarding a public contract and information about the advertisement for awarding a public contract

— Number and date of the decision to choose the best bid, cancellation of the procedure or other decisions of the contracting authority;

— Information about the actions or failure to take action by the contracting authority

— A description of the actual situation,

— Description of the irregularities and explanation thereof,

— The proposed evidence,

— Complaint and / or request for reimbursement for the cost of the procedure and

— Signature of the authorized person and seal.

6.3.5 The applicant shall submit proof of payment of the fee for the procedure.

6.3.6 The appellant has not established in the territory of the Republic of Macedonia is obliged to appoint a legal representative to receive correspondence.

6.3.7 The appeal shall be lodged with the Appeals Commission. The appeal shall be submitted in person or by registered mail to both the contracting authority and the State Commission. Date of filing of the complaint by registered mail is considered the day of submission. In case the person filing the complaint contracting authority shall issue to the applicant about the time of admission.

6.3.8 In the proceedings before the State Commission, the appellant, in addition to the administrative fee, pay a fee for the procedure depending on the offer, including:

— To 20,000 in counter fee of 100 EUR in

— From 20,000 to 100,000 EUR in counter fee of 200 EUR in counter

— From 100,000 to 200,000 EUR in counter fee of 300 EUR or equivalent

— Over 200,000 EUR in counter fee of 400 EUR in denars.

6.3.9 In the absence of an offer, the fee for the procedure is calculated based on the estimated value of the contract, and the State Commission shall inform the complainant of the fee and the period within which to submit proof of payment.

6.3.10 The fee for the procedure is meant for the budget of the Republic of Macedonia.

6.3.11 The contracting authority shall not sign the contract and for its execution within 12 days from receipt of the decision to decide on an individual right in the procedure for awarding the contract, except:

— In cases of Articles 99 and 198 of this Law, In case when the procedure took part in only one bidder whose bid is the winning or

— In case of individual public contracts based on framework agreement.
