2.2 Personal situation

2.2.1 The Contracting Authority shall exclude from the proceedings for awarding a public procurement contract any economic operator:

— that in the last 5 years has been rendered final judgement for participation in a criminal organization, corruption, fraud or money laundering;

— on whom a minor penalty ban on participation in public tender procedures, awarding public procurement contracts and agreements for public-private partnership has been imposed;

— on whom a minor penalty, temporary or permanent prohibition of a specific activity has been imposed;

— who is in bankruptcy or liquidation proceedings;

— who has unpaid taxes and other public charges,

— on whom sanction prohibition of professional activity or duty, i.e. temporary prohibition for performing professional activity is imposed;

— who provides false information or fails to submit the information requested by the Contracting Authority.

2.2.2 To prove his personal status, the economic operator shall submit the following documents:

— a statement by the economic operator that in the last 5 years he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering;

— Confirmation that he is not subject to an open bankruptcy proceedings by the competent authority;

— Confirmation that he is not subject to liquidation procedure by the competent authority;

— Receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— Certificate from the Registry of penalties for crimes committed by legal persons that minor penalty ban on participation in public tender procedures, awarding contracts and agreements for public-private partnership has not been imposed on him;

— certificate from the Registry of penalties for crimes committed by legal persons that a minor penalty for temporary or permanent prohibition of a specific activity has not been imposed over him;

— confirmation that a final judgement — prohibition of professional activity or duty, i.e. temporary prohibition for performing professional activity has not been imposed over him.

2.2.3 Statement from paragraph 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 Confirmations that no bankruptcy proceedings and liquidation proceedings, as well as certificates of the registry of penalties for criminal acts in lines 5 and 6 of subsection 2.2.2, are issued by competent authorities in the country where the economic operator is established. In Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia.

2.2.5 Certificate for paid taxes, contributions and other charges is issued by a competent authority of the the country where the economic operator is established. In Macedonia, competent authority for issuing such certificate is the PRO.

2.2.6 The confirmation of the item 7 of subsection 2.2.2 is issued by the competent authority in the country where the economic operator is established. Macedonian authority to issue this certificate is the Central Registry of the Republic of Macedonia.

2.2.7 Documents stipulated in item 2.2.2 must not be older than 6 months counting backwards from the deadline for submission of bids.

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in item 2.2.2 or if they do not include all the above mentioned cases, the economic operator may submit a statement certified by a competent authority.

Економска и финансиска состојба:

— balance sheet certified by the competent authority, i.e. revised balance sheet or abstracts from the balance sheet in cases when publishing of the balance sheet is regulated by law in the country where the economic operator is established;

— abstract from the total company turnover (data from the balance sheet issued from the competent authority, i.e. Revised Income Statement) and where it is appropriate, from the turnover in the area covered with the public procurement company from the last 3 financial years for which these information is available depending on the date of foundation or start of the company's work and depending on the availability of such information.

Минимално ниво(а) на стандарди:

— Realized income of 1 000 000 000 MKD in the last 3 years (2011, 2012 and 2013).

Техничка и професионална способност:

— list of main deliveries of bidders or candidates made in the last 3 years, with values, dates, buyers (contracting authorities or economic operators), with supplying confirmation for made deliveries issued by the recipients or if such confirmation can't be supplied for reasons that are out of control of the economic operator, only with his statement for made deliveries,

— description of the technical equipment and capability of the economic operator, measures for ensuring the quality and its equipment and capability for examination and exploration.

— statement for hired technical staff and technical authority regardless of whether they belong directly to the economic operator.

— samples, description and/or photographs that are subject to delivery, and whose reliability the economic operator is obliged to confirm if the Contracting Authority demands it.

— certificates issued by the competent authorities for the quality control with acknowledged competence and which test the suitability of the products which was clearly determined by reference to specifications and standards.

— in case of procurement of complex goods or in exceptional cases for special purposes, inspection of the production capacities of the economic operator is provided, or, when it is necessary, an inspection of his capacities for studying and exploring, and the measures for quality control, which is conducted by the contractual authority or in his name, a competent authority in the country in which the economic operator is registered and

— information about the elements of the agreement which the economic operator intends to hand over to the sub-contractor.

Минимално ниво(а) на стандарди:

The Contractor should have ‘A’ license for construction.

Key team of experts:

— Team leader — an engineer with degree in constructions with minimum 10 (ten) years work experience in his area, with professional and practical knowledge;

— Assistant — an engineer with degree in architecture with minimum 10 (ten) years work experience in his area, with professional and practical knowledge;

Team of professionals:

— to have at least 3 (three) graduated architects with ‘A’ authorization for construction;

— to have at least 2 (two) graduated construction engineers with ‘A’ authorization for construction;

— to have at least 2 (two) graduated electrical engineers with ‘A’ authorization for construction;

— to have at least 2 (two) graduated mechanical engineers with ‘A’ authorization for construction;

— to have at least 1 (one) graduated surveyor engineer;

General workers:

— to have at least 90 (ninety) general workers for completing the subject of procurement;

Equipment:

— to have minimum 10 (ten) trucks from which (tipper truck and truck with crane);

— to have minimum 2 (two) trucks with working basket;

— to have minimum 5 (five) ditch diggers with pneumatics;

— to have minimum 2 (two) bulldozers;

— to have minimum 1 (one) low trailer with 20 tons load;

— to have an attested scaffolding;

— to have minimum 3 (three) rollers;

— to have minimum 1 (one) machine for drilling underground installations, minimum Ф110;

— to have minimum 3 (three).

Потребни депозити и гаранции:

4.6 Bid guarantee

4.6.1 As part of the offer, the economic operator must provide unconditional and irreversible bid guarantee (participation guarantee) in the amount of 3 % of the total value of the offer ( VAT excluded). This guarantee will be in the form of a bank guarantee in the benefit of the Contracting Authority.

4.6.2 The bank guarantee should be issued by a bank that has a work permission form the National Bank of Republic of Macedonia (Narodna banka na Republika Makedonija).

4.6.3 The guarantee should be submitted in the original form. Copies are not accepted. The guarantee must have validity of at least 14 days from the day of expiration of the bid. Each bid that does not contain bid guarantee or contains a guarantee that is not in the accordance to the condition of the tender documentation, shall be rejected by the Contracting Authority as unacceptable.

4.6.4 The bid guarantee for the unsuccessful economic operators is returned in a period of 7 days after the signing of the agreement with the most agreeable economic operator.

4.6.5 The bid guarantee can be charged if the bidder withdraws his offer before the expiration of its validity, does not accept the correction of arithmetic errors by the committee,does not sign the public procurement contract and does not supply guarantee for quality realization of the contract.

7.5 Guarantee for quality performance of the contract

7.5.1 Condition for signing of the agreement with the chosen best bidder is providing guarantee by the chosen best bidder for quality performance of the contract in the amount of .... (the amount of the bank guarantee for quality performance of the contract can be from 5 % to 15 % from the value of the contract) from the value of the contract.

7.5.2 The guarantee from item 7.5.1 is supplied in the form of bank guarantee in writing. The guarantee should be submitted in the original form. Copies are not accepted.

7.5.3 The guarantee for quality performance of the contract will be valid until the complete realization of the contract. The Contracting Authority after choosing the best bidder additionally determines the end date of the validity of the guarantee.

7.5.4 The bank guarantee for quality performance of the contract will be in the currency in which the contract is made.

7.5.5 The guarantee for quality performance of the contract should be issued from a bank.

7.5.6 The chosen best bidder delivers the bank guarantee for quality performance of the contract after the obtained information about the completed selection, and before the signing of the agreement in the deadline specified by the Contracting Authority with the information.

7.5.7 The guarantee for quality performance of the contract is delivered in the stated deadline, by: post or in person to the contact person from item 1.2.2 from the tender documentation.

7.5.8 The guarantee for quality performance of the contract will be charged if the carrier of the procurement does not fulfil some of the obligations from the contract for public procurement in the due date, for which it will inform the carrier of the procurement in writing. In case the guarantee for quality performance of the contract is charged, the Contracting Authority will publish a negative reference in the ESPP.

7.5.9 If the contract for public procurement is fully realized according to the contract, the Contracting Authority returns the bank guarantee for quality performance of the contract to the carrier of the procurement in 14 days from the complete realization of the contract.

7.5.10 The Contracting Authority returns the guarantee for quality performance of the contract to the carrier of the procurement by mail, personally in the headquarters of the economic operator or personally in the headquarters of the Contracting Authority.

7.1 Manner of payment

7.1.1 The following method of payment is predicted: With transfer order on orderly delivered invoice and temporary monthly condition and final condition.

7.1.2 The temporary monthly situations are delivered by the Contractor in one month period.

7.1.3 The temporary monthly situation is delivered to the Contracting Authority in the proposed period, no later then the 5

7.1.4 The Contractor delivers and hands for payment the final situation after the conducted reception of the construction works.

7.1.5 The payment period of the temporary and of one final situation will be in the following years: 2014, 2015, 2016 and 2017.

7.1.6 The payment spread by years will be done as follows: in 2014, the amount of 85 013 400.00 MKD, in 2015, the amount of 193 000 000.00 MKD, in 2016 the amount of 193 000 000.00 MKD and in 2017 the amount of 193 000 000.00 MKD. The given amounts are with VAT included.

7.1.8 The Contracting Authority reserves the right on each orderly delivered monthly situation to pay a 10 % lower value of the paid advance. The rest of the advance is closed with the final situation.

7.1.9 The payment method is obligatory. Each offer that contains a manner of payment different from the one established in this point will be considered unacceptable and will be rejected as such by the Public Procurement Committee

5.1.1 The public opening of bids may be attended by any interested person.

5.1.2 Only authorized representatives of the bidders may participate in the proceedings of the public opening of the bids by giving their comments in the Minutes of the bid opening.

6.3.1 Any bidder who has a legal interest in a public contract and who has suffered or could suffer damage from possible violation of the provisions of this Act, may seek legal protection against decisions, actions or failure to act by the Contracting Authority in the procedure for awarding a public contract, in accordance with the terms and procedures stipulated in the Law on Public Procurement. The right of appeal in a procedure that ends with an electronic auction in terms of determining the qualification of the bidders and the full evaluation of the initial offers is accomplished after the decision of choosing the best bidder, or cancellation of the procedure.

6.3.2 The appeal is submitted no later than 8 days from the day of decision and should contain the following elements:

— Information about the appellant (name and surname, name of the economic operator, residence and headquarters),

— Information about the agent or the authorized person,

— Name and address of the Contracting Authority,

— Number and date of the procedure for awarding a public contract and data about the advertisement for awarding the contract for public procurement,

— Number and date of the decision of choosing the best bid, or cancelling the procedure, or other decisions of the Contracting Authority,

— Data for the actions or failure to take action by the Contracting Authority,

— Description of the actual situation,

— Description and explanation of the irregularities,

— Proposal of evidence,

— Complaint and/or request for reimbursement for the costs of the procedure and

— Signature of the authorized person and seal.

6.3.3 The appellant shall submit proof of payment of the fee for the procedure.

6.3.4 The appellant who does not have an establishment in the territory of the Republic of Macedonia is obliged to appoint a legal representative to receive written documents.

6.3.5 The appeal shall be lodged with the State Committee. The appeal shall be submitted in person or by registered mail to both the Contracting Authority and the State Committee. Date of filing of the appeal by registered mail is considered a day of submission. In case of filing the appeal in person the Contracting Authority is obliged to issue a receipt confirming the time of admission.

6.3.6 In the procedure in front of the State Committee, the appellant, in addition to administrative fees, shall pay a fee for the procedure depending on the amount of the bid:

— Up to 20 000 EUR in MKD equivalent, compensation of 100 EUR in MKD equivalent,

— From 20 000 to 100 000 EUR in MKD equivalent, compensation of 200 EUR in MKD equivalent,

— From 100 000 to 200 000 EUR in MKD equivalent, compensation of 300 EUR in MKD equivalent,

— Over 200 000 EUR in MKD equivalent, compensation of 400 EUR in MKD equivalent.

6.3.7 In the absence of an offer, the fee for the procedure is calculated based on the estimated value of the public procurement contract, and the State Committee shall notify the appellant of the fee and the deadline in which he shall submit proof of payment.

6.3.8 The fee for the procedure is an income for the Budget of the Republic of Macedonia.

6.3.9 The Contracting Authority shall not sign the public procurement contract and start its execution within 12 days from receiving of the decision, counting from the day of the receipt of decision that determines the individual right in the procedure for awarding the public procurement contract, except:

— in cases under Articles 99 and 198 of this Law,

— In cases where the procedure took only 1 bidder whose offer was selected as most favourable or

— In case of individual public procurement contracts based on framework agreement.
