To demonstrate the ability to perform professional activity, the economic operator should submit a document for registered activity as proof that it is registered as natural or legal entity for conducting activities related to the subject of the contract or proof that it belongs to a professional association in accordance with the regulations of the country where it is registered.

Економска и финансиска состојба:

The economic operator proves the fulfilment of the minimum requirement from 2.4.1 and 2.4.2 by supplying:

— balance sheet certified by the competent authority, i.e. revised balance sheet or abstracts from the balance sheet in cases when publishing of the balance sheet is regulated by law in the country where the economic operator is established;

— abstract from the total company turnover (data from the balance sheet issued from the competent authority, i.e. Revised Income Statement) and where it is appropriate, from the turnover in the area covered with the public procurement company from the last three financial years for which these information is available depending on the date of foundation or start of the company's work and depending on the availability of such information.

2.4.4 If the balance sheet and income statement have been subject to commercial audit, the economic operator may submit them as proof that it meets the minimum requirement for establishing the economic and financial situation without being further verified by the competent authority.

2.4.5 If the balance sheet and income statement have not been subject to commercial audit, the economic operator shall submit them certified or issued by a competent authority to prove that he meets the minimum requirement for establishing the economic and financial situation. The competent authority in the country is the Central Registry of the Republic of Macedonia.

2.4.6 Economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and the entity. If the economic operator proves his economic and financial capability referring to the support of the other entity, he is required to demonstrate with valid proof that the entity will make available the appropriate finance to the economic operator. The entity providing financial support shall not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.4.7 If economic operators submit a bid as a group of economic operators, the economic and financial situation is proved by taking into account the resources of all group members. If the group of economic operators performs with financial support from a third entity, the economic and financial situation is determined according to the above mentioned.

Минимално ниво(а) на стандарди:

— To have achieved positive financial performance in the last 3 years (2011, 2012 and 2013).

— Generated revenues of 55 000 000 MKD in the last 3 years (2011, 2012 and 2013).

Техничка и професионална способност:

The economic operator shall prove the fulfilment of the minimum requirements of item 2.5.1 of the submission:

— A copy of the contracts of the same or similar type to the subject of purchase and proof of quality work performed in relation to the contract;

— Copy of the license ‘B’ contractor for construction of the second category (economic operator established abroad in fulfilment of this requirement has proven by a certificate issued by the Ministry of Transport and Communications of the Republic of Macedonia);

— List of works executed in the last 3 years, with the values, dates, clients (both contracting authorities and economic operators).

— Statement on the technical staff and technical bodies regardless of whether they belong to the economic operator;

— A list of all employees issued by the Employment Agency not older than 15 (fifteen) days from the date of submission of bids;

— Copy of diploma or certificate, a copy of the authorization ‘B’ and the CV for the engineer in the field of…

… construction;

— A description of the technical equipment and human resources provider, measures to ensure its quality and equipment and ability to test and research;

— Valid proof of available equipment and

— Elements of the contract that the economic operator intends to subcontract to third parties.

2.5.3 The technical and professional capacity of the economic operator may be supported by another entity, regardless of legal relations between the economic operator and the entity. If the economic operator proves its technical and professional capability referring to the support by another entity, it is required to demonstrate that support with valid evidence that the entity will make available appropriate technical and professional resources to the economic operator. The entity providing technical and professional support should not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.5.4 If economic operators submit a bid as a group of economic operators, the technical and professional capacity shall be proved by taking into account the resources of all group members. If the group of economic operators participates with technical and professional support by a third entity or third parties, technical and professional capacity shall be determined according to the above mentioned.

Минимално ниво(а) на стандарди:

To qualify as capable of performing the contract for public procurement in terms of his technical and professional capability, the economic operator must meet the following minimum requirements:

— The economic operator to have contracted for work performed by the same or similar type to the subject of procurement in the last 3 years with a value not less than 10 000 000 MKD and to be able to provide a certificate for performed quality works in relation to the contract;

— Contractor licensed with certificate B for performance;

— Professional team:

— To possess at least one (1) Engineer for construction with authorization ‘B’ for engineer performance;

— To possess minimum (1) Engineer in the field of architecture with authority ‘B’ for engineer for construction;

— General Workers:

— To possess minimum ten (10) general workers to carry out the subject matter of the contract;

— Equipment:

— to possess a machine for cutting concrete;

— to possess minimum two (2) rollers;

— to possess minimum two (2) excavators;

— to possess minimum two (2) tipper truck.

Потребни депозити и гаранции:

Guarantee for quality performance of the contract

The economic operator within 5 days after signing the contract at its own cost and risk, must provide an unconditional bank performance guarantee of 10 % of the contract value. Banking guarantee also represents as a condition to introduce the work of the Contractor by the Procuring entity .This warranty will be for the benefit of the contracting authority.

7.5.2 The bank guarantee must be issued by a bank that has obtained approval for a business carried on by the National Bank of the Republic of Macedonia.

The guarantee must be submitted in its original form. Copies are not accepted. The guarantee must be valid for at least 14 days from the date of expiry of the contract of the purchasing process.

7.5.4 The bank guarantee for the contract performance will be in the currency of the contract.

7.5.5 The performance guarantee shall be delivered within the specified period, and in person contact in point 1.2.2 of the tender documentation.

7.5.8 The guarantee for quality performance of the contract will be charged if the carrier of the procurement does not fulfil some of the obligations from the contract for public procurement in the due date, for which it will inform the carrier of the procurement in writing. In case the guarantee for quality performance of the contract is charged, the Contracting Authority will publish a negative reference in the ESPP.

Where a prolonged period of implementation of the contract value or increased, the contractor should properly extend the validity and value of the performance guarantee of the contract.

7.5.9 If the contract is fully implemented as agreed, the contracting authority shall return the bank performance guarantee to the contractor within 14 days of completion of the contract.

The Contracting Authority returns the guarantee for quality performance of the contract to the carrier of the procurement by mail, personally in the headquarters of the economic operator or personally in the headquarters of the Contracting Authority.

The following method of payment is predicted:

— Payment will be made by properly delivered situations of performed works.

The manner of payment is obligatory. Each offer that contains a manner of payment different than the one established in this point will be considered unacceptable and will be rejected as such by the Public Procurement Committee.
