The contracting authority shall exclude from the proceedings for awarding a public contract any economic operator :

— That in the last 5 years has been rendered a verdict for participation in a criminal organization , corruption , fraud or money laundering ;

— Who is a minor penalty imposed ban on participation in public tender procedures , awarding contracts and agreements for public-private partnership ;

— Who is a minor penalty imposed temporary or permanent prohibition of a specific activity ;

— Which is in bankruptcy or liquidation proceedings ;

— Which has unpaid taxes and other public charges;

— Who imposed sanction - prohibition of professional activity or duty , ie temporary prohibition for performing professional activity;

— Who provides false information or fails to submit the information requested by the contracting authority

To prove his personal situation , the economic operator shall submit the following documents :

— A declaration by the economic operator that in the last 5 years he was rendered a verdict for participation in a criminal organization , corruption , fraud or money laundering ;

— Confirmation that no bankruptcy proceedings by the competent authority ;

— Confirmation that no liquidation procedure by the competent authority ;

— Receipt for paid taxes , contributions and other public duties by the competent authority of the country where the economic operator is established ;

— Certificate from the Registry of penalties for crimes committed by legal persons that have been imposed minor penalty…

… ban on participation in public tender procedures , awarding contracts and agreements for public- private partnership ;

… for temporary or permanent ban on performing certain activities and

— Confirmation that the final sentence imposed sanction - prohibition of professional activity or duty , i.e temporary prohibition for performing professional activity .

To demonstrate the ability to perform professional activity, the economic operator should submit a document for registered activity that is registered as a legal entity conducting activities related to the subject of the contract or proof that it belongs to a professional association, and submit a license for the energy business - trade in oil and oil products, the energy Regulatory Commission of the Republic of Macedonia or equivalent institution

To qualify as capable of performing the contract for procurement in terms of standards for quality systems, the economic operator should submit:

— Quality certificates of extra light fuel oil

The economic operator shall prove the fulfillment of the minimum requirements stipulated in item 2.4.1 by submitting:

— Balance sheet data and income statement for the last 3 financial years certified by the Central Registry of RM or equivalent institution.

Минимално ниво(а) на стандарди:

To qualify as capable of performing the contract for procurement in terms of its economic and financial situation, the economic operator should meet the minimum requirement for the last 3 financial years have a total annual income of at least 200 000 000 MKD.

The economic operator shall prove the fulfillment of the minimum requirements stipulatedby submitting:

— A list of the principal deliveries of bidders in the last 3 years, by providing delivery declarations issued by the recipients;

— A description of the technical equipment and staff;

— A statement of the technical staff.

Минимално ниво(а) на стандарди:

To qualify as capable of performing the contract for procurement in terms of its technical and professional capability, the economic operator must meet the following minimum requirements:

— In the last 3 years have performed deliveries of extra light heating oil for at least three contracting authority;

— Is the owner of at least one gas station and a minimum of one tank car for transportation of oil;

— Bidder to have employed at least 2 drivers for tank car

Guarantee for application - 3 % of the offer price without VAT included (this guarantee is part of the offer) and Guarantee for completing the contract - 5 % of the value of the contract (this guarantee is needed only from the supplier who will be elected after electronic auction before the signing the contract).

In proceedings before the State Commission, the appellant , in addition to administrative fees , and pay a fee for the procedure depending on the amount of the bid , including:

— Up to 20 000 EUR in MKD , compensation of 100 EUR in counter-

— From 20 000 to 100 000 EUR in MKD , compensation of 200 EUR in counter-

— From 100 000 to 200 000 EUR in MKD , compensation of 300 EUR or equivalent

— Over 200 000 EUR in MKD , compensation of 400 EUR in MKD .

Any economic operator who has a legal interest in a public contract and who has suffered or could suffer damage from possible violations of provisions of the Law on Public Procurement , may require legal protection against decisions , actions or failure to take action by the contracting authority in the awarding of public procurement . The right of appeal procedure ends with an electronic auction realized after making the decision to choose the best bidder , or canceling the procedure .

The appeal shall be filed within eight days from the day :

— The announcement of the award of a public contract in terms of data , actions or failure to take action by the announcement ,

— Opening of tenders in respect of the actions or failure to take action related to the tender documentation , ie the public opening of bids ,

— The deadline for a decision on selection or cancellation of procedure in accordance with Article 162 paragraph 2 of the Law on Public Procurement in terms of failure to deciding on selection or cancellation of the procedure in the relevant period ,

— Receipt of the decision that determines the individual right of the procedure for awarding a public contract , in terms of determining the ability of applications for participation or evaluation of bids or

— Knowledge of illegal procedure for awarding a public contract , no later than 1 year from the date of completion of the procedure.
