Способност за вршење на стручната дејност:

1.The Contracting Authority shall exclude from the procedure for awarding a public procurement contract,any economic operator that:

— within the last 5 years has had a legally effective judgement pronounced against him/her for participation in a criminal organization, corruption, fraud or money laundering,

— is subject to a bankruptcy procedure or a liquidation procedure,

— has unpaid taxes, contributions or other public dues,

— has been pronounced with an additional judgement…

… prohibiting the participation in public procedures, public procurement contract awarding and public private partnership contracts,

… for temporary or permanent prohibition for performing of a certain activity,

— has a misdemeanor sanction involving prohibition to perform a profession, activity or duty, or temporary prohibition to perform a specific activity, and,

— gives false information or fails to submit the data requested by the Contracting Authority.

2.To prove his/her personal situation, the economic operator shall submit the following documents:

— statement of the economic operator that, within the last 5 years, it has not had any legally effective judgement for participation in a criminal organization, corruption, fraud or money laundering, pronounced against it,

— confirmation that it is not subject to an…

… open bankruptcy procedure by a competent authority,

… opened liquidation procedure by a competent authority,

— confirmation for paid taxes, contributions and other public dues issued by a competent authority in the country where the economic operator is registered,

— confirmation from the Registry of penalties for committed criminal acts of the legal entities that it was not pronounced with a second penalty…

… prohibiting the participation in the public procedures, the public procurement contract procedures and the public private partnership procedures,

… for temporary or permanent prohibiting for performing certain activity,

— confirmation that there is no legally effective judgement imposing a misdemeanor sanction involving prohibition to perform a profession, activity or duty, or prohibition to perform a specific activity, imposed against it

3. The statement referred to in indent 1, sub-item 2 is prepared in an electronic form and is signed with an electronic signature by the economic operator, and the same should not be verified by a competent authority.

4. The confirmations that there are no open bankruptcy and liquidation procedures are issued by competent authorities in the country where the economic operator is registered. The Central Registry of RM is the competent authority for issuing such confirmations in the Republic of Macedonia.

5. The confirmation for paid taxes, contributions and other public dues is issued by a competent authority in the country where the economic operator is registered. The Public Revenues Office is the competent authority in the Republic of Macedonia for issuing of this confirmation.

6. The confirmation referred to in indent 5, sub-item 2.2.2 is issued by the competent authority of the country where the economic operator is registered. The Central Registry of RM is the competent authority for issuing of this confirmation in the Republic of Macedonia.

7. The confirmation referred to in indent 6, sub-item 2.2.2 is issued by the competent authority of the country where the economic operator is registered. The Central Registry of RM is the competent authority for issuing of this confirmation in the Republic of Macedonia.

8. The confirmation referred to in indent 7, sub-item 2.2.2 is issued by the competent authority of the country where the economic operator is registered. The Central Registry of RM is the competent authority for issuing of this confirmation in the Republic of Macedonia.

9. The documents referred to in sub-item 2.2.2 must not be older than 6 (six) months counted backwards from the final deadline for submission of the tenders.

10. If the country where the economic operator is registered does not issue the documents for assessing the personal situation of the economic operator or if the documents do not include all cases stipulated above, the economic operator may submit a statement notarized by a competent authority.

11. If economic operators submit a tender as a group of economic operators, all members of the group shall prove their personal standing individually.

Економска и финансиска состојба:

report on the balance sheet notarized by a competent authority, i.e. audited balance sheet, or excerpts from the balance sheet in cases when the disclosure of the balance sheet is prescribed by law in the country where the economic operator is registered; and statement of the total turnover of the enterprise (information from the income statement issued by a competent authority, i.e. audited income statement) for the latest 3 years.

Минимално ниво(а) на стандарди:

— The economic operator must have a total turnover of at least 400 000 000 Macedonian denars in the last 3 years (2011, 2012 and 2013)

Техничка и професионална способност:

— To have published at least 10 (ten) editions (books, textbooks, other literature, magazines etc.) in the last 3 years, each in the circulation of at least 5 000,

— To have at least 30 (thirty) regularly employed staff,

— To have or to be able to provide as support at least 20 vehicles for distribution suitable for the subject procurement,

— To have printed at least 100 (one hundred) titles/editions(books, textbooks, other literature, magazines, catalogues etc.) over the last 3 years, out of which at least 10 (ten) in a language other than the Macedonian language and its Cyrillic alphabet,

— Copy of valid ISO 9001 certificate,

— Copy of valid ISO 14001 certificate.

Минимално ниво(а) на стандарди:

— Statement that outlines at least 10 publications of the economic operator in the last 3 years each with a circulation of at least 5000 copies, stating titles, issue years, circulation and ISBN or ISSN number,

— Document from the relevant employment agency for at least 30 (thirty) employees in regular employment with the company, issued no earlier than 15 days from the date designated for tender submission for the subject procurement,

— Statement and copies of registration documents that confirm that the economic operator has or is able to provide at least 20 vehicles for distribution suitable for the subject procurement,

— Statement that indicates at least 100 (one hundred) titles that have been printed by the economic operator in the last 3 years, with at least 10 (ten) among those in a language different from the Macedonian language and its Cyrillic alphabet,

— ISO 9001,

— ISO 14001.

Peformance security in the form of a bank guarantee in the amount of 10 % of the contract price including VAT.

Payment will be done upon entering into separate contracts under the framework agreement, no later than 6 months upon satisfactory completion of the relevant contract services, substantiated by delivery notes, acceptance certificates and separate invoices for primary and secondary education textbooks.

Any economic operator having legal interest in the contract awarding procedure, which has endured or could endure damages from possible violations of the provisions of the Law on Public Procurement, may appeal against the decisions, actions and omissions of the contracting authority in accordance with the Law on Public Procurement of the Republic of Macedonia. Lodging of appeals for procedures that end in an electronic auction related to meeting the tender requirement is done after the decision of award of contract or decision for procedure cancellation.
