Production of control stamps — labels labelling of flour for the requirements of the Department for marketing and quality of MAFWE.

‘Printing of labels for marking of seeds and transplanting materials’ for the requirements of the Directorate for seeds.

2. Capabilities of economic operators

2.1 Method of proving capability

2.1.1 Together with its bid, the economic operator must provide supporting documents, in order to prove the following:

— Personal condition,

— The capability to perform professional activity,

— Economic and financial condition( for part I).

— Technical or professional capability (for part I and part II).

2.1.2 The required documents shall be submitted in original form or as a copy certified by the economic operator with seal and signature of the responsible person, marked as ‘True to the original.’

2.1.3 Upon checking the completeness and validity of documents for determining the capability of the economic operator and upon evaluation of the bid, the Commission may request from the economic operator to clarify or supplement the documents if there are no significant deviations from the required documents.

2.1.4 The economic operator shall submit the requested clarification in writing, within the period determined by the contracting authority.

2.1.5 The Commission or the economic operator is not allowed to offer or allow changes in the bid, except the correction of arithmetic errors.

2.1.6 In the case of a group of economic operators, all members of the group shall individually demonstrate their personal conditions and ability to perform professional activities.

2.2 Personal condition

2.2.1 The contracting authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership;

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity;

— it is in bankruptcy or liquidation proceedings;

— it has unpaid taxes and other public charges, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer;

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity; and

— it provides false information or fails to submit the information requested by the contracting authority.

2.2.2 In order to prove its personal condition, the economic operator shall submit the following documents:

— A declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— confirmation that there are no bankruptcy proceedings by the competent authority;

— confirmation that there is no liquidation procedure by the competent authority;

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that minor…

… penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership has not been imposed;

… penalty for temporary or permanent prohibition of a specific activity has not been imposed;

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

2.2.3 The statement in indent 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 The confirmations that there are no bankruptcy proceedings and liquidation proceedings, as well as the certificates from the Register of penalties for criminal acts in indents 5 and 6 of subsection 2.2.2, shall be issued by competent authorities in the country in which the economic operator is established. In the Republic of Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The receipt for paid taxes, contributions and other charges shall be issued by a competent authority of the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue such certificates is the Public Revenue Office.

2.2.6 The receipt in indent 7 of subsection 2.2.2 shall be issued by the competent authority in the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue this certificate is the Central registry of the Republic of Macedonia.

2.2.7 The documents referred to in sub- item 2.2.2 must not be older than six (6) months from the deadline for submission of bids.

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2 or if they do not encompass all the cases mentioned above, the economic operator may submit a statement certified by a competent authority.

2.3 Ability to perform professional activity

2.3.1 In order to demonstrate the ability to perform professional activity, the economic operator should submit a document for registered activity that is registered as a legal entity for conducting activities related to the subject of the contract or proof that it belongs to association in accordance with the regulations of the country where it is registered.

2.4 Economic and financial condition (for part I) for part II are not foreseen

2.4.1 In order to qualify as capable of performing the contract for public procurement for part I ‘Production of control stamps — labels’ from the aspect of its economic and financial situation, the economic operator must meet the following minimum requirements:

— To have a positive financial result (income statement) for the last 3 years.

— To have a minimum average annual turnover of 15 000 000 million MKD within the last 3 years.

2.4.2 If the economic operator carries on its business in a period of less than three years, a minimum requirement for establishing the economic and financial condition shall be that the economic operator has achieved the turnover of sub-item 2.4.1 in the years for which data are available.

2.4.3 The economic operator shall prove the fulfilment of the minimum requirements stipulated in item 2.4.1 or 2.4.2 by submitting the following:

— Balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance-sheet is required under the law of the country where the economic operator is established;

— Statement of overall turnover (data from the income statement issued by the competent authority, i.e. audited balance sheet) and, where appropriate, of turnover in the area covered by the contract and the last financial year for which such data are available, depending on the date on which the company was founded or started to work and depending on the availability of such information.

2.4.4 If the balance sheet and income statement have been subject to commercial audit, the economic operator may submit them as proof that it meets the minimum requirement for establishing the economic and financial situation without being further verified by the competent authority.

2.4.5 If the balance sheet and income statement have not been subject to commercial audit, the economic operator shall submit them as certified or issued by a competent authority to prove that it meets the minimum requirement for establishing the economic and financial situation. The competent authority in the Republic of Macedonia is the Central Registry of the Republic of Macedonia.

2.4.6 Economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and the subject, except in the case of data from the income statement. If the economic operator proves its economic and financial capability referring to the support of another entity it is required to demonstrate that support with valid evidence that the entity will make available the financing to the economic operator. The entity provides financial support must not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.4.7 If economic operators submit a bid as a group of economic operators, the economic and financial situation is proved by taking into account the resources of all group members. If the group of economic operators started with financial support from a third entity, the economic and financial situation is determined according to the above mentioned.

2.4 Economic and financial condition (for PART I) for PART II are not foreseen

2.4.1 In order to qualify as capable of performing the contract for public procurement for part I ‘Production of control stamps — labels’ from the aspect of its economic and financial situation, the economic operator must meet the following minimum requirements:

— To have a positive financial result (income statement) for the last 3 years.

— To have a minimum average annual turnover of 15 000 000 million MKD within the last 3 years.

2.4.2 If the economic operator carries on its business in a period of less than 3 years, a minimum requirement for establishing the economic and financial condition shall be that the economic operator has achieved the turnover of sub-item 2.4.1 in the years for which data are available.

2.4.3 The economic operator shall prove the fulfilment of the minimum requirements stipulated in item 2.4.1 or 2.4.2 by submitting the following:

— Balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance-sheet is required under the law of the country where the economic operator is established;

— Statement of overall turnover (data from the income statement issued by the competent authority, i.e. audited balance sheet) and, where appropriate, of turnover in the area covered by the contract and the last financial year for which such data are available, depending on the date on which the company was founded or started to work and depending on the availability of such information.

2.4.4 If the balance sheet and income statement have been subject to commercial audit, the economic operator may submit them as proof that it meets the minimum requirement for establishing the economic and financial situation without being further verified by the competent authority.

2.4.5 If the balance sheet and income statement have not been subject to commercial audit, the economic operator shall submit them as certified or issued by a competent authority to prove that it meets the minimum requirement for establishing the economic and financial situation. The competent authority in the Republic of Macedonia is the Central Registry of the Republic of Macedonia.

2.4.6 Economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and the subject, except in the case of data from the income statement. If the economic operator proves its economic and financial capability referring to the support of another entity it is required to demonstrate that support with valid evidence that the entity will make available the financing to the economic operator. The entity provides financial support must not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.4.7 If economic operators submit a bid as a group of economic operators, the economic and financial situation is proved by taking into account the resources of all group members. If the group of economic operators started with financial support from a third entity, the economic and financial situation is determined according to the above mentioned.

2.5 Technical or professional ability (for part I and part II)

2.5.1 In order to qualify as capable of performing the contract for procurement from the aspect of its technical and professional capability, the economic operator must meet the following minimum requirements:

— To have previous experience in completing the same or similar subject of procurement with minimum 5 confirmations for on-time executed deliveries in the past 3 years in accordance with the subject of procurement for part I, and previous experience in completing the same or similar subject of procurement with minimum three confirmations for on-time execution of deliveries in the past 3 years in accordance with the subject of procurement in part II.;

—To have a minimum of 5 full-time employees that are going to execute the subject of procurement (submission of evidence M1/M2 forms); and

—To have technical equipment and capability of economic operators with description of the equipment that is going to be used for completion of the service in accordance with the subject of procurement , and personnel and vehicles for transport of the procurement.

2.5.2 The economic operator shall prove the fulfilment of the minimum requirements stipulated in sub-item 2.5.1 by submitting:

— List of main deliveries performed by bidders or candidates, executed in the past 3 years, together with values, dates, buyers (contracting bodies or economic operators), by providing minimum 5 confirmations (for part I) and three confirmations (for part II) for on time execution of deliveries that are going to be issued by the recipients, or, if such confirmations can not be provided because of reasons that are out of control of the operator, its statement on the performed deliveries;

— educational or professional qualifications of the economic operator or its professional stuff, and especially the persons that are responsible for extending a specific service.

— Statement on the technical equipment of the economic operator and other possibilities on disposal for execution of specific services, and providing quality, especially on the machines that are going to be used for execution of services;

— Report on the elements of the contract that the economic operator intends to assign to a sub-contractor.

2.5.3.The documents stated in item 2.5.2. shall be prepared by the economic operator and they should not be recorded by the authorized body.

2.5.4. The technical and professional capacity of economic operators may not be supported by another entity, regardless of the legal relations between the economic operator and the entity, except for the reference list, previously signed contracts and licenses. If the economic operator proves its technical and professional capability referring to the support of another entity it is required to demonstrate that support with valid evidence that the entity will indeed make available the technical and professional resources to the economic operator. The entity provides technical and professional support should not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.5.5 If the economic operators submit a bid as a group of economic operators, technical and professional capacity shall be proved by taking into account the resources of all members of the group. If the group of economic operators participates with technical and professional support of a third entity or third parties, technical and professional capacity shall be determined according to the above mentioned.

2.5 Technical or professional ability (for part I and part II)

2.5.1 In order to qualify as capable of performing the contract for procurement from the aspect of its technical and professional capability, the economic operator must meet the following minimum requirements:

— To have previous experience in completing the same or similar subject of procurement with minimum 5 confirmations for on-time executed deliveries in the past three years in accordance with the subject of procurement for part I, and previous experience in completing the same or similar subject of procurement with minimum 3 confirmations for on-time execution of deliveries in the past three years in accordance with the subject of procurement in part II.;

—To have a minimum of 5 full-time employees that are going to execute the subject of procurement (submission of evidence M1/M2 forms); and

—To have technical equipment and capability of economic operators with description of the equipment that is going to be used for completion of the service in accordance with the subject of procurement , and personnel and vehicles for transport of the procurement.

2.5.2 The economic operator shall prove the fulfilment of the minimum requirements stipulated in sub-item 2.5.1 by submitting:

— List of main deliveries performed by bidders or candidates, executed in the past 3 years, together with values, dates, buyers (contracting bodies or economic operators), by providing minimum 5 confirmations (for part I) and 3 confirmations (for part II) for on time execution of deliveries that are going to be issued by the recipients, or, if such confirmations can not be provided because of reasons that are out of control of the operator, its statement on the performed deliveries;

— educational or professional qualifications of the economic operator or its professional stuff, and especially the persons that are responsible for extending a specific service.

2.5.5 If the economic operators submit a bid as a group of economic operators, technical and professional capacity shall be proved by taking into account the resources of all members of the group. If the group of economic operators participates with technical and professional support of a third entity or third parties, technical and professional capacity shall be determined according to the above mentioned.

Performance guarantee = 10 % legal statement for the seriousness of the bid documentation.
