To prove his personal situation, the economic operator shall submit the following documents:

— Statement by the economic operator that in the last 5 years he has an effective sentence for participation in a criminal organization, corruption, fraud or money laundering;

— Confirmation that no bankruptcy procedure by the competent authority;

— Confirmation that it is not subject to liquidation proceedings by a competent authority;

— Confirmation of payment of taxes and other public duties by the competent authority of the country in which the economic operator is established;

— Confirmation from the Register of penalties for crimes committed by legal persons that have been stated ban on participation in public bidding procedures, awarding contracts and contracts for public-private partnerships;

— Confirmation from the Register of penalties for crimes committed by legal persons that have been imposed minor penalty temporary or permanent prohibition of professional activity;

— Confirmation that a final decision has not been imposed sanction ban on performing profession, activity or duty, or prohibition to perform certain activities.

To qualify as capable of performing the contract for public procurement in terms of its technical or professional ability, the economic operator must meet the following minimum requirements:

— Have performed services of this type of contract in the last three years, with the values, dates, buyers (contracting authorities and economic operators), a certificate for the services issued by the recipients or, if such certificates can be obtained from reasons beyond the control of the economic operator, by statement of deliveries guarantee the service.

Минимално ниво(а) на стандарди:

2.4.2 The economic operator shall prove the fulfillment of the minimum requirements of item 2.4.1 by submitting:

— To Submit a list of services of this kind of purchase or service made in the last three years, with the values, dates, buyers (contracting authorities and economic operators) to provide at least 3 references for performed services issued by the recipients of services or if such certificates can not be provided for reasons beyond the control of the economic operator, by statement of services rendered,

— Da Submit a written statement for the guarantee of the service (i.e. time to specify the type of warranty service),

— To submit a written statement or list of technical staff is trained to perform this type of contract or providing service,

— Da Submit certificate authorized service area of procurement which apply economic operator.

Техничка и професионална способност:

2.4.3 The technical and professional capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and that entity, except for the reference list, previously signed contracts. If the economic operator proves its technical and professional ability invoking the support of another entity, it is obliged to prove the support with valid proof that that entity will make available to the economic operator relevant technical and professional resources. The entity that provides technical and professional support should be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.4.4 If economic operators submit a bid as a group of economic operators, technical and professional ability is proved by taking into account the resources of all group members. If the group of economic operators participates with technical and professional support from a third entity or third parties, technical and professional capacity shall be determined according to the above mentioned.

2.4.5 The offer does not meet the minimum requirements listed in Section 2.4.1 and 2.4.2 Procurement Committee will reject as unacceptable and will not be evaluated.

Извршување на договорот
Потребни депозити и гаранции:

Guarantee of the supply 2 %

guarantee for quality performance of 5 % the agreement.

Главни услови за финансирање и аранжмани за плаќање и/или упатување на релевантните одредби што ги уредуваат:

— The payment shall be fixed by the offer.

— Economic operator defines the payment deadline in its offer, but it must not be shorter than 60 days.

— Any offer that does not contain a defined payment and who is less than 60 days will be considered as unacceptable and as such will be rejected by the Procurement Committee.

Any bidder who has a legal interest in obtaining the contract and who has suffered or may suffer damage from possible violations of the provisions of this Law may ask for legal protection against the decisions, actions or failure to take action by the contracting authority the procedure for awarding a public contract, in accordance with the terms and procedure provided by the Law on Public Procurement. The right of appeal procedure ends with an electronic auction in terms of determining the ability of the bidders and the full evaluation of the initial offer is accomplished by making the decision to choose the best offer or annulment proceedings.
