The contractor shall be obliged to deliver the estimated quantities of heating oil — extra light household oil-1 (EL-1) by means of tank trucks with built-in calibrated flow metres, in 2 tranches free on board tanks to the employment centres, according to the list of locations contained in the technical specification.

— Statement by the economic operator that in the past 5 years no effective court decision has been delivered against the economic operator for participation in a criminal organization, corruption, fraud or money laundering;

— Confirmation that no bankruptcy procedure has been initiated by a competent authority;

— Confirmation that the economic operator is not subject to liquidation proceedings by a competent authority;

— Receipt for paid taxes, contributions and other public duties by a competent authority of the country in which the economic operator is established;

— Certificate issued by the Registry of penalties for crimes committed by legal entities that against the economic operator no…

… ban on participation in public tender procedures, public contract awarding and public-private partnership agreements has been imposed;

… penalty of temporary or permanent prohibition of a specific activity has been imposed;

— Confirmation that by means of an effective court decision no penalty sanction of prohibition to perform a profession, activity or duty, i.e. temporary prohibition for performing professional activity has been imposed against the economic operator.

In order to prove its ability to perform a professional activity, the economic operator should deliver a document of registered activity as a proof that it is registered as a natural person or legal entity to pursue the activity related to the subject matter of the public contract or a proof that it is a member of an appropriate professional association in accordance with the regulations of the country where it is registered.

Within its tender, the economic operator should also submit a valid license for pursuing the energy activity wholesale of oil and oil derivatives (Heating oil — extra light household oil-1 (EL-1)) issued by the Energy Regulatory Commission of the Republic of Macedonia, in original or as a copy certified by the economic operator itself.

Економска и финансиска состојба:

— Balance sheet report certified by a competent authority, i.e. a revised balance sheet, or excerpts from the balance sheet report in cases when the publication of a balance sheet is regulated by law in the country where the economic operator is registered;

— Statement on the overall trading of the enterprise (data from the income statement issued by a competent authority, i.e. a revised income statement), and where appropriate, on the trading in the field covered by the public contract, at most for the past 3 financial years for which such information is available depending on the date of establishment of the enterprise or when it started operating, and also depending on the availability of such information and;

— Information on the economic and financial situation of the economic operator for the past 3 years, i.e. for the years for which there is available data, if the economic operator pursues the activity in a period shorter than 3 years.

Минимално ниво(а) на стандарди:

— The economic operator should have achieved positive financial operation during the past 3 financial years.

Техничка и професионална способност:

— Statement of quality and standard adherence of the oil derivative, subject to supply, in compliance with the effective Rulebook on Quality of Liquid Fuels, and a copy of a certificate issued by a manufacturer or an accredited laboratory, certified by the economic operator itself;

— Statement on the technical equipment and skills in executing the respective services;

— Reference list of the principal deliveries effected in the past three years, with the values, dates, clients (both contracting authorities and economic operators), by providing confirmations of duly fulfilled contracts issued by clients, or, if such confirmations cannot be provided, and if that is not within the power of the tenderer, only by providing its own statement of effected deliveries.

Минимално ниво(а) на стандарди:

— To possess a certificate of quality of the oil derivative, subject to supply, issued by a manufacturer or an accredited laboratory, as a proof of compliance of the quality features of the tendered derivative with the border values set in the effective Rulebook on Quality of Liquid Fuels;

— To dispose of technical equipment and skills for the delivery of the oil derivative pursuant to effective legal regulations and;

— To have completed delivery of similar nature in the past three years to contracting authorities or economic operators on the level of the Republic of Macedonia.
