The contracting authority shall exclude from the procedure for awarding a public procurement contract, any economic operator that:

— Within the last 5 years has had a legally effective judgment pronounced against him/her for participation in a criminal organization, corruption, fraud or money laundering,

— Is subject to a bankruptcy procedure or a liquidation procedure,

— Has unpaid taxes, contributions or other public dues,

— That has a misdemeanor sanction involving prohibition to perform a profession, activity or duty, or prohibition to perform a specific activity, imposed against him/her and,

— That gives false information or fails to submit the data requested by the contracting authority to prove his/her personal circumstance, the economic operator shall submit the following documents:

—— Statement of the economic operator that, within the last five years, he/she has not had any legally effective judgment for participation in a criminal organization, corruption, fraud or money laundering, pronounced against him/her,

—— Confirmation that he/she is not subject to a…

… bankruptcy procedure initiated by a competent authority,

… liquidation procedure opened by a competent authority,

—— Confirmation of paid taxes, contributions and other public dues issued by a competent authority in the country where the economic operator is registered,

—— Confirmation that there is no legally effective judgment imposing a misdemeanor sanction involving prohibition to perform a profession, activity or duty, or prohibition to perform a specific activity, imposed against him/her.

To prove the capability to perform a professional activity, the economic operator will have to submit a document for a registered activity as a proof that the operator is registered as a natural person or a legal entity to perform an activity related to the public procurement contract or proof of membership in an appropriate professional association in accordance with the regulations of the country where the operator is registered.

Економска и финансиска состојба:

2.4.1 To qualify as capable of performing the contract for procurement in terms of its economic and financial situation, the economic operator must meet the following minimum requirements:

— Balance sheet and income statement issued by the competent authority,

— Statement of overall turnover in the last three years, the turnover of goods pertaining to the procurement.

2.4.2 If the economic operator carries on business in a period of less than three years, a minimum requirement for establishing the economic and financial condition of the economic operator has realized the requirement of subsection 2.4.1 in the years for which data are available.

2.4.3 The economic operator shall prove the fulfillment of the minimum requirements of subsection 2.4.1 or 2.4.2 of the submission:

— Balance sheet certified by a competent authority, ie audited balance sheets or extracts from the balance sheets where publication of the balance-sheet is required under the law of the country where the economic operator is established;

— Statement of overall turnover (data from the income statement issued by the competent authority, ie audited balance sheet) and, where appropriate, of turnover in the area covered by the contract and the last three financial years for which such data are available, depending on the date on which the company was founded or started work and depending on the availability of such information.

2.4.4 If the balance sheet and income statement have been subject to commercial audit, the economic operator may submit them as proof that it meets the minimum requirement for establishing the economic and financial situation without being further verified by the competent authority.

2.4.5 If the balance sheet and income statement have not been subject to commercial audit, the economic operator shall submit them certified or issued by a competent authority to prove that it meets the minimum requirement for establishing the economic and financial situation. The competent authority in the country is the Central Registry of the Republic of Macedonia.

2.4.6 Economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and the entity. If the economic operator proves its economic and financial capability referring to the support of another entity it is required to demonstrate that support with valid evidence that the entity will make available to the economic operator financing. The entity provides financial support must be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.4.7 If economic operators submit a bid as a group of economic operators, the economic and financial situation is proved by taking into account the resources of all group members. If the group of economic operators started with financial support from a third entity, the economic and financial situation is determined according to the above mentioned.

Техничка и професионална способност:

2.5.1 To qualify as capable of performing the contract for procurement in terms of its technical or professional ability, the economic operator must meet the following minimum requirements:

— To submit attestation for quality material by the competent authority in the Republic of Macedonia, which confirms the standards prescribed for this kind of material.

Reference-list ever made deliveries of its kind in the last 3 years,

To deliver 3-confirmations made and confirmed business with contracting authorities this kind of purchase.

— Appropriate personnel for carrying out the contract,

— Appropriate equipment to carry out procurement.

Минимално ниво(а) на стандарди:

2.5.2 The economic operator shall prove the fulfillment of the minimum requirements stipulated in item 2.5.1 by submitting:

list of the principal deliveries of tenderers or candidates in the last three years, with the sums, dates and buyers (contracting authorities and economic operators), by providing a relevant service delivery issued by the recipients or, if such certificates can be provided by reasons beyond the control of the economic operator, by his statement made deliveries

— description of the technical equipment which the economic operator, a statement of the technical staff and technical bodies,

— Attests to the quality issued by the competent authority in the Republic of Macedonia. (Attestation to certify standards that are applicable in the Republic of Macedonia).

2.5.4 The technical and professional capacity of economic operators may not be supported by another entity, regardless of the legal relations between the economic operator and the entity. If the economic operator proves its technical and professional capability referring to the support of another entity it is required to demonstrate that support with valid evidence that the entity will make available to the economic operator technical and professional resources. The entity provides technical and professional support should be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.5.5 If economic operators submit a bid as a group of economic operators, technical and professional capacity shall be proved by taking into account the resources of all group members. If the group of economic operators participates in technical and professional support of a third entity or third parties, technical and professional capacity shall be determined according to the above mentioned.
