Each bidder who has a legal interest in obtaining the contract and who has suffered or may suffer damage from possible violations of the Law on Public Procurement, can seek legal protection against the decisions, actions or failure to take action by the contracting authority in the procedure for awarding a public contract. The right of appeal procedure ends with an electronic auction in terms of determining the ability of the bidders and the full evaluation of the initial offer is accomplished by making the decision to choose the best offer or annulment proceedings.

The appeal shall be filed within 8 days from the day:
— The date of receipt of the completed technical dialogue regarding the actions or failure to take action related to the implementation of the technical dialogue,
— The announcement of the award of a public contract in terms of information, actions or failure to take action by the announcement,
— Opening of tenders, regarding the actions or failure to take action related to the tender documentation, i.e. the bid opening,
— The deadline for a decision on selection or cancellation of the procedure under Article 162, paragraph 2 of the Public Procurement Act in relation to the failure to adopt a decision on selection or cancellation of the procedure in the relevant period,

— Receipt of the decision, which decides the individual right from the procedure for awarding a public contract, in terms of determining the ability to participate or evaluation of bids or
— Awareness of illegal procedure for the award of a public contract, within one year from the date of completion of the procedure.
The economic operator failing to lodge an appeal against the provisions of item 6.3.1, there is no right of appeal at a later stage of the procedure for the same legal basis. The complaint should include the following elements:
— Information about the complainant (name, name of the economic operator, address of residence and seat)
— Data representative or proxy,
— Name and address of the contracting authority;
— Number and date of the procedure for awarding a public contract and information about the advertisement for awarding a public contract
— Number and date of the decision to choose the best offer, cancelling the procedure or other decisions of the contracting authority;
— Information about the actions or failure to take action by the contracting authority;
— A description of the actual situation,
— Description of the irregularities and explanation,
— Proposed evidence,
— Complaint and/or request compensation for the cost of the procedure and
— Signature of authorized person and seal.
The appellant shall submit proof of payment of the fee for the procedure.
The appellant is not located on the territory of the Republic of Macedonia is obliged to appoint a representative to receive written.
The appeal is filed with the State Commission. The appeal shall be submitted in person or by registered mail simultaneously to the contracting authority and the State Commission. Day of the appeal by registered mail is considered day of filing. In the case of the appeal the contracting authority shall issue to the applicant about the time of receipt. In the proceedings before the State Commission, the appellant, despite the administrative fee paid and the fee for the procedure depending on the amount of the bid, including:

— To 20 000 in counter fee of 100 EUR in counter,
— From 20 000 to 100 000 EUR in counter fee of 200 EUR in counter,
— From 100 000 to 200 000 EUR in counter fee of 300 EUR or equivalent,
— Over 200 000 EUR in counter fee of 400 EUR in MKD.
In the absence of an offer, the fee for the procedure is calculated based on the estimated value of the contract in the State Commission shall inform the complainant of the fee and the period within which to submit proof of payment.
The fee for the procedure is meant for the Budget.
The contracting authority shall not sign the contract and for its execution within 12 days from receipt of the decision to decide on an individual right in the procedure for the award of the contract, except for:
— In the case of Articles 99 and 198 of this Law,
In case when he participated in the procedure only one bidder whose bid has been selected as winners or
— In the case of individual public contracts based on framework agreement.
