The service requesting party shall exclude from the public procurement contract proceedings any legal entity:

— Which has been issued a sentence for participation in criminal organization, corruption, fraud or money laundering;

— Which is undergoing bankruptcy or closure procedures;

— Which has been given an supplementary sentence — ban from participation in public procurement proceedings participation, being selected in public procurement contracts and contracts for public — private partnership;

— Which has unpaid taxes, contributions and other public debt;

— Which has been given an infringement sanction — ban from conducting a profession, business or duty, i.e., a temporary ban from conducting a specific business;

— Which gives out false information or does not deliver the information requested by the service requesting party.

A document for registered business as evidence that the company has been registered as a legal entity for conducting the business which is the subject of the public procurement contract need be submitted:

— A license for specific line transport and a copy of the license issued in accordance with the Public Transportation and Traffic Law (Official Gazette of R. Macedonia No. 68/04).

Економска и финансиска состојба:

In order to qualify as able to fulfil the public procurement contract at hand in terms of its economic and financial liquidity, the legal entity needs to provide evidence that they fulfil the following minimal criteria:

— A bank statement certified copy, i.e., a revised financial statement for the last 3 (three) years;

— Positive financial balance for each of the past 3 (three) years.

Техничка и професионална способност:

— License for conducting specific passenger line transportation issued by the Ministry of Transport and Communication of the Republic of Macedonia. A copy of the license is submitted for each vehicle owned or leased by the legal entity with which the legal entity applies for every separate line. The legal entity may submit an offer to transport students for as many lines for as they own available vehicles for specific passenger line transport and the vehicles are all to abide by the minimum technical standards as stated in the Law on Road and Traffic Safety (Official Gazette of R. Macedonia No. 54/07); Public transportation and traffic Law (Official Gazette of R. Macedonia No. 68/04, 127/06, 114/09, 83/10, 140/10, 17/11, 53/11, 6/12, 23/13, 120/13, 163/13, 187/13 and 42/14) and the ‘Rulebook on special technical and exploitation conditions for vehicles that perform different types of road traffic and the form and content of the certificate for fulfilment of the special technical — exploitation conditions’ (Official Gazette of R. Macedonia No. 87/07, 34/08, 20/09, 90/09 and 160/14).

— Should the legal entity submit offers on 1 or more items and in doing so, should the number of students that need to be transported in every specific line exceed the number of the licensed capacity of the vehicles, the offer will be discarded.

— A certified copy of the registration for each of the licensed vehicles;

— Evidence of relevant insurance for the licensed vehicles (insurance policy and the mandatory passenger in public transport insurance for each vehicle);

— A list of available vehicles for specific line transport of passengers which fulfil the minimum technical-exploitation conditions with a complete list of which vehicle would be used for which line, the registration number of the vehicle, year of manufacture, date of last registration, capacity (evidence — copy of the valid registration and copy of the license for the vehicle specific line transport),

— List of qualified drivers for each offered vehicle with which transport would be conducted (evidence — M1/M2 form).
