2.1 Verifying the capacity of the economic operator:

2.1.1 Along with the offer the economic operator has to submit documents that shall verify the economic operator's:

— personal state,

— capacity to perform professional activity, and

— technical capacity.

2.1.2 The requested documents are submitted in an original form or in a form of a copy certified by the economic operator with a stamp and signature by an authorized person bearing the mark ‘Certified Copy’.

2.1.3 While evaluating the offer and checking the validity of the documents and whether all documents required are submitted in order to verify the capacity of the economic operator, the committee may request the economic operators to clarify or supplement some documents, as long as they do not differ from the requested documentation significantly.

2.1.4 The economic operator submits the requested explanation in a written form within the deadline determined by the contracting authority.

2.1.5 The committee or the economic operator must not request offer or allow any changes in the offer, except for corrections of arithmetic mistakes.

2.1.6 In case there is a group of economic operators, all members of the group must verify their personal state and capacity to perform professional activity individually.

2.2 Personal state:

2.2.1 The contracting authority shall exclude any economic operator from the procedure for obtaining a public procurement contract that:

— in the course of the last 5 years has had an effective court decision passed against them for participating in a criminal organization, corruption, fraud and money laundering,

— had secondary penalty for participating in public call procedures, awarding public procurement contracts and public private partnership contracts passed against them,

— had secondary penalty of temporary or permanent prohibition to perform individual activity passed against them,

— has bankruptcy proceedings or liquidation procedure under way,

— has back taxes, back contributions and other public charges, except in case when the economic operator has been approved to obtain deferred payment of taxes, contributions and other public charges in accordance with the appropriate regulations and regularly defrays them,

— has misdemeanour sanction passed against them — prohibition to perform profession, activity or other duty or temporary prohibition to perform certain activity, and

— has given false data or has not submitted the data requested by the contracting authority.

2.2.2 In order to verify their personal state, the economic operator has to submit the following documents:

— a statement that no effective court decision has been passed against the economic operator in the course of the last 5 years for participating in a criminal organization, corruption, fraud and money-laundering,

— a certificate that no bankruptcy proceedings are under way issued by a competent authority,

— a certificate that no liquidation procedure is under way issued by a competent authority,

— a certificate of paid taxes, contributions and other public charges, issued by the competent authority of the country where the economic operator is registered,

— a certificate from the Registry of penalties for committed crimes of legal persons that no secondary penalty…

… prohibition to participate in public call procedures, awarding public procurement contracts and public private partnership contracts has been passed against the economic operator,

… of temporary or permanent prohibition to perform individual activity has been passed against the economic operator,

— a certificate that no misdemeanuor sanction has been passed against the economic operator — prohibition to perform profession, activity or other duty or temporary prohibition to perform certain activity.

2.2.3 The statement from indent 1, Subsection 2.2.2) is prepared and signed by the economic operators themselves and it need not be certified by a notary.

2.2.4 Certificates about the absence of bankruptcy proceedings and liquidation procedure, as well as certificates from the Registry of penalties for committed crimes for indents 5 and 6, Subsection 2.2.2) are issued by the competent authority of the country where the economic operator is registered. In the Republic of Macedonia, the competent authority for issuing these certificates is the Central Register of the Republic of Macedonia.

2.2.5 A certificate of paid taxes, contributions and other charges is issued by the competent authority of the country where the economic operator is registered. In the Republic of Macedonia, the competent authority for issuing this certificate is the Administration for Public Revenues.

2.2.6 A certificate for indent 7, Subsection 2.2.2) is issued by the competent authority of the country where the economic operator is registered. In the Republic of Macedonia, the competent authority for issuing this certificate is the Central Register of the Republic of Macedonia.

2.2.7 The documents of Subsection 2.2.2) must not be older than 6 months considering the final deadline for delivering the offers.

The committee shall also accept documents for determining the personal state issued even the day after the public offer opening but not later than the day of choosing the most favourable offer.

2.2.8 If the country where the economic operator is registered does not issue the documents listed in Subsection 2.2.2) or if they do not encompass the aforementioned instances the economic operator can submit a statement certified by a competent authority.

Техничка и професионална способност:

In order to qualify as capable to perform the concerned public procurement contract regarding their technical and professional capacity the economic operator must meet the following minimal requirements:

— Have a marketing authorization for the vaccine in the market of the Republic of Macedonia or temporary permit or final approval for parallel import issued by the Ministry of Health/Medicines Agency,

— To offering vaccine against seasonal flu, mono doses 0.5 ml. The deadline should be in accordance with WHO recommendations, but not longer than 1 year.

— Is to ensure safe transport and delivery of vaccines to protect against flu to all public health centres participating in public procurement respecting the cold chain.

Минимално ниво(а) на стандарди:

The economic operator verifies meeting the minimal requirements in Subsection 2.4.1) by submitting:

— To offering vaccine against seasonal flu mono doses 0.5 ml. The deadline should be in accordance with WHO recommendations, but not longer than 1 year.

— Is to ensure safe transport and delivery of vaccines to protect against flu to all public health centres participating in public procurement respecting the cold chain.

3 % bid guarantee (from the value of the bid),

5 % performance guarantee (from the contract value).
