To qualify as capable to perform according the contract from the aspect of his economical and financial situation, the economic operator has to fulfill the following minimum conditions:

— to have a positive financial work in the last 3 years.

If the economic operator performs the activity less than three years, the minimal condition for determing the financial and economical situation is the economic operator to record an income from item 2.4.1 through the years of working.

The economic operator proves the fulfilling of the minimal condition from item 2.5.1 or 2.5.2 with supplying any official prove, from which can be seen the financial situation of the company for that period.

— a report for the balance sheet, verified at the competent authority, for the last 3 years, a revised balance of the situation or excerpts from the report for the balance according the law of the country where the economic operator has been registered.

— Document from the whole revenue of the company for the last three financial years, according the year when the company has been started and according the availability of these information.

If the balance of the condition and success have been a subject of a commercial revision, the economic operator can supply the same documents as a prove that he fulfills the minimal condition to determine the economic and financial situation without additional verification.

If the balance of the situation and success has not been a subject of a commercial revision, the economic operator supplies the same documents, verified, issued by the Central Register of the Republic of Macedonia.

The economical and financial ability of the economic operator can be supported by another subject, no matter their regulated law relations, except in case of the data about the balance of success. If the economic operator proves its economic and financial ability with the support of another subject, he is obliged to prove the support with a valid document that the subject will offer him suitable financials. This subject must not have a verdict for participating in crime acts, corruption, fraud or money laundering.

If economic operators supply an offer as a group of economic operators, the economic and financial situation is proved taking into account the resources of all the members of the group. If the group acts with a financial support from a third subject, the economic and financial situation is to be determined according the mentioned above.

Техничка и професионална способност:

To qualify as able to perform the contract from the aspect of his technical and professional ability, the economic operator has to fulfill the following minimal conditions:

— a license for construction (License B) issued by the Ministry of Transport and Communication of the Republic of Macedonia, according the law Republic of Macedonia,

— to have a mechanization and equipment for building objects from second category.

The economic operator proves these conditions from item 2.4.1 by supplying the following documents:

— a license for construction, second category ( License B) ) issued by the Ministry of Transport and Communication of the Republic of Macedonia, according the law Republic of Macedonia;

A copy signed and verified by the bidder, labeled “True to the original”

The operators to bear in mind the transitional and final provisions / article 168 and 175 page 3, from the Law for building.

The technical and professional ability of the economic operator can be supported from another subject, no matter the law relations between the economic operator and that subject, except in the part of the referent list, the agreements between them and the licenses. If the economic operator proves its technical and professional ability with the support of another subject, he is obliged to prove that support with a valid document that the particular subject will offer him suitable technical and professional resources. Against the subject who supplies the technical or the professional support, must not be issued a verdict for participation in crime acts, corruption, fraud or money laundering.

If economic operators give an offer as a group of economic operators, the technical and the professional ability is proved with taking into account the resources of all the members of the group. If the group of the economic operators acts with technical or professional support from a third subject, the technical and the professional ability is verified according mentioned above.

Извршување на договорот
Потребни депозити и гаранции:

As part of the offer, the economic operator gives a guarantee of the offer (participation guarantee) at least 3 % of the whole value of the offer, without VAT.

Главни услови за финансирање и аранжмани за плаќање и/или упатување на релевантните одредби што ги уредуваат:

The contracting authority shall submit the public procurement contract to the selected most convenient bidder in 6/six copies for signing. The selected most convenient bidder is obliged to sign the public procurement contract within 7/seven days from receiving the contract and to return it to the contracting authority. Contracting authority undertakes an obligation to send required number of copies of the contract to the selected most convenient bidder after it is signed by the authorized person of the contracting authority.

Payment of works that are subject to this agreement will be made by submitting invoices for the completed works, delivered by the Contractor, according to the Memorandum of Understanding no.03-869/1 of 26.5.2015, and will be carried out the following way:

— first payment: one month after the signing of the contract, contractor is allowed to invoice up to 15 % of the total amount of the contract i.e. 15 % of the bank guarantee. The invoice is issued in MKD to the Municipality,

— second payment: two months after signing the contract, the contractor is allowed to invoice the amount depending on operating activities (based on quantity), but not more than 35 % of the total amount of the contract. The invoice should be issued to SEKO in Swiss francs,

— third payment: four months after signing the contract, contractor is allowed to invoice the amount depending on operating activities (based on quantity), but not more than 35 % of the total amount of the contract. The invoice should be issued to SEKO in Swiss francs,

— final payment: upon completion of the project and its approval by the Municipality and the consultant, the contractor is obliged to invoice the remaining amount under the contract. The remaining amount will be divided into one invoice issued in MKD to the Municipality and to every invoice issued in Swiss francs and in terms of regulations of the memorandum.

Each invoice issued under the contract is submitted to the Mayor of the Municipality, the Municipality shall check the invoice and the Mayor approves it. Verified and approved invoice shall be sent to the consultant for re-checking. After the approval of the invoice by the consultant, the Municipality i.e. SEKO can pay it. Invoices issued to the Municipality will be paid of its project account. Invoices issued to SEKO will be paid directly by SEKO. Works, supplies and services provided by the contractor which are financed by SEKO are without VAT. To provide relief from VAT, the Contractor shall prepare invoice amount excluding VAT of Public Revenue Office form. PRO approve the invoice to be exempt from paying VAT. All invoices issued to SEKO in Swiss francs should be based on the contractual prices in Macedonian denars according to the exchange rate on the date of issuance of invoice published by the National Bank of Republic of Macedonia.

Method and deadline of payment is compulsory. Any offer that includes deadline of payment different from the one determined in this point will be considered unacceptable and as such will be rejected by the commission for public procurement.

The Contractor is obliged to perform the works- subject to the specific procurement contract, within 3/three effective months from the date of introduction into service by the contracting authority, established with report on introduction onto service, but in any case no longer than the duration of the validity of the contract. Notice: all offers including an extended period of anticipation will be rejected as unacceptable. The contractor is obliged to perform the subject in the contract as follows:

— after properly submitted application to the Contracting Authority to introduce to the work, which will contain all the necessary date for uninterrupted performance of the work, according to the calculations and control plan for the Subject, and for implementation of the project. The deadline for the works is running from the introduction of Contractors in work and will be defined in the contracts assigned to the most convenient bidder.
