For proving the personal condition, the economic operator must submit the following documents:

— statement by the economic operator that in the last 5 years it was not sentenced with an effective verdict for participation in a criminal organization, corruption, fraud or money laundering;

— certificate that no insolvency procedure is open by an adequate authority;

— certificate that no liquidation procedure is open by an adequate authority;

— certificate for paid taxes, contributions and other public charges by an adequate authority from the country where the economic operator is registered;

— certificate from the Register of penalties for performed criminal acts of the legal entities, that it was not sentenced with a minor penalty for participation in procedures for open invitation, awarding agreements on public procurement and public-private partnership agreements;

— certificate by the Register of penalties for performed criminal acts of the legal entities that it was not sentenced with a minor penalty — temporary or permanent prohibition for performance of a certain activity and

— certificate that with an effective verdict it was not sentenced with a sanctioned offence and — prohibition for performing profession, business activity or duty, that is, temporary prohibition for performing certain activity.

Економска и финансиска состојба:

Necessary document for proving the economic and financial condition of the economic operator: a report on the balance sheet certified by an adequate authority.

Минимално ниво(а) на стандарди: Average revenue (turnover) in the last 3 years: 150,000.000 MKD.
Техничка и професионална способност:

Necessary documents for proving the technical or professional ability of the economic operator:

— A copy of the License Type B for carrying out construction works, issued to the economic operator by the Ministry of Transport and Communications;

— Copies of the M1/M2 forms, copies of the Authorization Type B for carrying out construction works, issued by the Chamber of Authorized Architects and Engineers for the engineering personnel.

— Copies of the M1/M2 forms for the additional personnel;

— A Certificate issued by an adequate authority on the number of employees, not older than 15 days from the deadline for submission of bids;

— Copies of contracts for executed works of at least 1 (one) construction in the last 5 (five) years, where each is not lower than 100 000 000 MKD, where such works are similar to the works, subject of the tender. Also, with the contracts, the bidder should submit certificates on satisfactory execution of works for at least 1 (one) construction in the last 5 (five) years, which value is not lower than 100 000 000 MKD, where such works are similar to the works, subject of the tender. The certificates should include value, period and location of execution of works (in case there is no such data on the Certificates, the bidder should enclose the contracts or documents for technical acceptance, containing the wanted data, or any other such document).

— Proof of ownership or possession or requested equipment.

Минимално ниво(а) на стандарди:

The minimum criterion for determining the Technical or professional ability of the economic operator:

— To own a Contractor License Type B for carrying out constructions in the second category, as per the Law on Construction.

— To have at disposal the following engineering personnel:

— one (1) construction engineer with Authorization Type B for construction;

— one (1) architect engineer with Authorization Type B for construction;

— one (1) electrical engineer with Authorization Type B for construction.

— To have at disposal the following additional personnel:

— twenty (20) qualified workers (plumbers, electrician, heating, welders or masons).

— To have at least 20 (twenty) full time employees.

— To have successfully executed works/contracts on at least one (1) construction, which value is not lower than 100 000 000 MKD, where such works are similar to the works, subject of the tender.

— To have at disposal the following equipment:

— truck;

— scaffolding of at least 500 m².

The appeal shall be filed within a time period of eight days for the open procedure as of the day of:

— publication of the contract notice regarding the data, actions or omissions to undertake actions referred to in the contract notice;

— opening of tenders, regarding the actions or omissions to undertake actions related to the tender documentation, i.e. the tender opening procedure;

— expiry of the time period for adoption of a decision for selection or cancellation of the procedure in accordance with Article 162 paragraph (2) of this Law in respect to the omission for adoption of decision for selection or cancellation of the procedure in the corresponding deadline;

— receipt of the decision for an individual right in the contract award procedure regarding the determination of the competence of the requests to participate or the evaluation of tenders and the decision; or

— acknowledgement of the illegal conduct of the contract award procedure, within a time period of 1 year at the latest as of the day of completing the conducted procedure.
