2.2 Personal condition:

2.2.1 The contracting authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership;

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity;

— it is in bankruptcy or liquidation proceedings;

— it has unpaid taxes and other public charges, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer;

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity; and

— it provides false information or fails to submit the information requested by the contracting authority.

2.2.2 In order to prove its personal condition, the economic operator shall submit the following documents:

— A declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority;

— confirmation that there is no liquidation procedure undertaken by the competent authority;

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that minor penalty…

… — ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership — has not been imposed;

… for temporary or permanent prohibition of a specific activity has not been imposed;

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

2.2.3 The statement in indent 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 The confirmations that there are no bankruptcy proceedings and liquidation proceedings, as well as the certificates from the Register of penalties for criminal acts in indents 5 and 6 of subsection 2.2.2, shall be issued by competent authorities in the country in which the economic operator is established. In the Republic of Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The receipt for paid taxes, contributions and other charges shall be issued by a competent authority of the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue such certificates is the Public Revenue Office.

2.2.6 The receipt in indent 7 of subsection 2.2.2 shall be issued by the competent authority in the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue this certificate is the Central Registry of the Republic of Macedonia.

2.2.7 The documents referred to in sub- item 2.2.2 must not be older than six (6) months from the deadline for submission of bids.

The Commission shall accept the documents for determining of the personal conditions that are issued after the date of the public opening of offers, but not later than the date of passing of a decision for electing the most favourable bid.

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2 or if they do not encompass all the cases mentioned above, the economic operator may submit a statement certified by a competent authority

2.3 Ability to perform professional activity:

2.3.1 In order to demonstrate the ability to perform professional activity, the economic operator should submit a document for registered activity, that it is registered as a legal entity for conducting activities related to the subject of the contract for public procurement, or proof that it belongs to a professional association in accordance with the regulations of the country in which it is registered.

Pursuant to article 148 paragraph 2 of the Law on Public Procurements upon determining the ability of economic operators to perform their professional activity, the contracting body shall also request a proof issued by an authorized body that they fulfil the special conditions for performing of their activities that are prescribed by law, which refer to the subject of the contract, and in this specific case that is:

— License B for construction.

Економска и финансиска состојба:

2.4 Economic and financial condition:

2.4.1 In order to qualify as capable of performing the contract for procurement from the aspect of its economic and financial situation, the economic operator must meet the following minimum requirements:

— To have a positive financial result (income statement) in the last 3 years.

— for Lot 1, to have a minimum average total revenue of 4 200 000 MKD in the last 3 years (total for the three years/3),

— for Lot 2, to have a minimum average total revenue of 7 000 000 MKD in the last 3 years (total for the three years/3),

— for Lot 3, to have a minimum average total revenue of 2 700 000 MKD in the last 3 years (total for the three years/3),

— for Lot 4, to have a minimum average total revenue of 27 100 000 MKD in the last 3 years (total for the three years/3),

— for Lot 5, to have a minimum average total revenue of 16 000 000 MKD in the last 3 years (total for the three years/3),

— for Lot 6, to have a minimum average total revenue of 14 500 000 MKD in the last 3 years (total for the three years/3),

— for Lot 7, to have a minimum average total revenue of 1 300 000 MKD in the last 3 years (total for the three years/3),

— for Lot 8, to have a minimum average total revenue of 1 530 000 MKD in the last 3 years (total for the three years/3).

Минимално ниво(а) на стандарди:

2.4.3 The economic operator shall prove the fulfilment of the minimum requirements stipulated in item 2.4.1 or 2.4.2 by submitting the following:

— Balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance-sheet is required under the law of the country where the economic operator is established;

— bank statement on the total turnover of the company (data on the balance sheet issued by an authorized body, i.e. the turnover in the scope that is going to be covered with the Public Procurement Contract, for the last three fiscal years at most, for which such information are available and depending on the date on which the company is established and started its operation, as well as depending on the access to such information.

2.5 Technical or professional capability:

2.5.1 In order to qualify as capable for performing the subjected contract for public procurement in terms of its technical or professional capability, the economic operator must meet the following minimum conditions:

— to have minimum 3 same or similar works that have been completed (performing hydro-construction works, construction of roads and excavation of mineral raw materials) in the last 5 years;

— the economic operator shall dispose with minimum one graduated engineers with License B for operation in the construction engineering;

— to dispose with adequate mechanical equipment for realisation of the subject of the contract, such as:

— For Lot 1, to have a minimum 1 dredger, 1 bulldozer and 1 tipping lorry;

— For Lot 2, to have a minimum 2 dredgers and 1 bulldozer;

— For Lot 3, to have a minimum 1 dredger and 1 bulldozer;

— For Lot 4, to have a minimum 2 dredgers, 1 bulldozer and 3 tipping lorries;

— For Lot 5, to have a minimum 1 dredger, 1 bulldozer and 1 tipping lorry;

— For Lot 6, to have a minimum 2 dredgers, 1 bulldozer and 1 tipping lorry;

— For Lot 7, to have a minimum 1 dredger, 1 bulldozer and 1 tipping lorry;

— For Lot 8, to have a minimum 1 bulldozer and 1 tipping lorry.

Минимално ниво(а) на стандарди:

2.5.2. The economic operator proves the fulfilment of the minimum requirements set forth in item 2.5.1 by submitting the following:

— a list of at least 3 (three) projects of the same or similar kind (cleaning of river beds and channels, construction and re-construction of hydro-technical objects, infrastructural objects (roads) excavation of mineral raw materials) that have been executed in the past five years, by submitting a confirmation for favourable performance of the main works, confirmations including value, time and location of the performed activities as well as statements for execution of the works in accordance with the regulations on business operation, as well as if the works are duly completed, or copies of concluded contracts;

— Evidence that it disposes with a construction engineer and submission of a copy of License B for operation in the field of construction, as well as submission of M1/M2 for the person that is employed with the economic operator or a contract for engagement of a skilled person if it is not permanently employed with the economic operator;

— Statement and description of the technical equipment that is at a disposal of the economic operator in order to conduct the particular works (by submission of evidence on ownership or rent, leasing of the mechanical equipment, etc.).
