The contracting authority shall exclude from the procedure for awarding a public contract any economic operator:

— Within the last 5 years to a final verdict for participation in criminal organization, corruption, fraud or money laundering;

— Has imposed a penalty on participation in public tender procedures, the award of public procurement contracts and public-private partnership;

— Has imposed a temporary or permanent prohibition of professional activity;

— Which is in bankruptcy or liquidation proceedings;

— Failed to pay taxes and other public charges, unless the economic operator has been granted deferred payment of taxes, contributions and other public duties in accordance with special regulations and pays them regularly;

— It has a misdemeanour sanction prohibition of professional activity or duty, or prohibition to perform certain activity;

— Provides false information or fails to provide information requested by the contracting authority.

To prove its personal standing, the operator shall submit the following documents:

— A declaration by the economic operator that in the last 5 years he was rendered a verdict for participation in criminal organization, corruption, fraud or money laundering;

— Confirmation that no bankruptcy proceedings by a competent authority;

— Confirmation that no liquidation procedure by the competent authority;

— Confirmation of paid taxes and other public charges from the competent authority of the country where the economic operator is established;

— Certificate from the Registry of penalties for crimes committed by legal entities that were not imposed a…

… penalty on participation in public tender procedures, the award of public procurement contracts and public-private partnerships;

… temporary or permanent prohibition of professional activity;

— A certificate stating that there has not been imposed sanction ban on performing profession, activity or duty, or prohibition to perform certain activity.

The statement from Line 1 of Subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

Confirm that no bankruptcy proceedings and liquidation proceedings, the certificate from the registry of penalties for criminal acts in Lines 5 and 6 of Subsection 2.2.2 shall be issued by the competent authorities in the country where it is registered. In the Republic of Macedonia competent body for issuing such certificates is the Central Registry of the Republic of Macedonia.

The confirmation of paid taxes and other public charges issued by the competent authority in the country is registered. In Macedonia, the body responsible for issuing this certificate is the Public Revenue Office.

The receipt of Item 7 of Subsection 2.2.2 issued by the competent authority in the country is registered. In Macedonia, the body responsible for issuing this certificate is the Republic of Macedonia.

The documents in Item 2.2.2 must not be older than six (6) months from the deadline for submission of bids.

If the country where the economic operator is registered does not issue the documents referred to in Subsection 2.2.2 or they do not cover all the above cases, the economic operator may submit a statement verified by a competent authority.

Извршување на договорот
Потребни депозити и гаранции:

A condition for signing the contract with the winning bidder is providing a guarantee by the most favourable bidder for performance of the contract in the amount of 5 % of the contract value without VAT.

The guarantee of item 7.5.1 is delivered in the form of bank guarantee in writing. The guarantee should be submitted in original form. Copies are not acceptable.

The performance guarantee of the contract will be valid until the complete fulfilment of the agreement. The contracting authority for the selection of the best bidder additionally determine the end date of the guarantee.

The bank guarantee for performance of the contract will be in the currency of the contract.

The performance guarantee of the contract shall be issued by a bank.

The performance guarantee of the contract, the selected best bidder shall submit within 15 days after receiving notice of the choice before signing the contract.

The performance guarantee of the contract shall be activated if the contractor fails to meet an obligation of the public procurement in the given time frame, which shall notify the contractor. The collection of performance guarantee of the contract, the contracting authority shall publish EPPS negative reference. For payment of the bank guarantee.
