Способност за вршење на стручната дејност:

1. In order to prove its personal status, the economical operator should submit the following documents:

— Certificate of the economic operator stating that no effective verdict has been imposed in the past 5 years for participation in criminal organization, corruption, fraud or money laundering;

— Certificate that no bankruptcy procedure has been initiated by a competent authority;

— Certificate that no liquidation procedure has been initiated by a competent authority;

— Certificate for paid taxes, contributions and other public fees from the authority competent in the country where the economic operator has been registered;

— Certificate from the Registry of penalties on committed criminal acts of legal entities stating that no secondary penalty,…

… ban on participation in open call procedures, on awarding of contracts for public procurement and contracts on public-private partnership, has been imposed;

… temporary penalty or permanent ban on the performance of particular activity has been imposed;

— Certificate stating that no misdemeanour sanction — ban on performing a profession, activity or obligation, i.e. temporary ban on performing a particular activity, has been imposed;

2. Capability for performing a professional activity of the economical operator:

— Document for registered professional activity (DRA form/Document of registration, competent authority to issue them in the Republic of Macedonia is the Central Register, and must not be older than 6 months from the deadline for bid submission/in original or as a copy verified by the bidder with a seal and signature of the authorized person, with the designation ‘True to the original’) as a proof for registration as a physical or legal entity for performing an activity related to the subject of the public procurement contract, or a proof of affiliation with a related professional association in accordance with the regulations of the country of registration;

— The economic operator should submit a proof issued by an authorized body on fulfilling the necessary conditions for performing an activity, regulated by the Law, and that refer to the subject of the public procurement contract, i.e. to submit at least a valid Licence D — contractor i.e. constructor, issued by the Ministry of Transport and Communications of the Republic of Macedonia, according to the Law on construction (A copy verified by the bidder with a seal and signature of the authorized person, and a designation ‘True to original’).

Техничка и професионална способност:

Necessary documents to prove the technical and professional capability of the economic operator:

— M1/M2 form (verified by the authorized agency that mediates the employment) of minimum 8 people employed at the economic operator, where at least 1 is a construction engineer with authorization A, or authorization B for engineering performance in construction activities, or a preview of the registration/log out in the compulsory social insurance of a business entity issued and verified by the Employment Service Agency of the Republic of Macedonia (A copy verified by the bidder with a seal and signature of the authorized person, and a designation ‘True to original’).

Nota bene: (In case the Economic operator submits a preview of the registration/log out as a proof, that document must be issued in the month in which the economic operator is submitting the bid).

— Valid authorization A, or authorization B for engineering performance in construction area, of having at least 1 employee as construction engineer with such authorization … (A copy verified by the bidder with a seal and signature of the authorized person, and a designation ‘True to original’).

Извршување на договорот
Потребни депозити и гаранции:

Condition for signing the contract with the winning bidder is providing a warranty for qualitative performance of the contract in the amount of 10 % (ten percent) of the contract value.

Правна форма што треба да ја преземе групата економски оператори на која ќе се додели договорот:

A group of bidders also has the right to place a bid (where the bid is prepared in accordance with the conditions and requirements specified for a group of bidders in the tender documentation) without an obligation for joining in an appropriate legal form. The contracting authority will not require the group of economical operators to join in an appropriate legal form for performance of the contract (upon the selection of most favourable bid) if the group is selected as the winner of the procurement.

Note: At the time of submission of the bid all members of the group should be registered in the Electronic System of Public Procurement ESPP: https://e-nabavki.gov.mk/PublicAccess/home.aspx#/home

The economic operator should submit at least a valid Licence D — contractor i.e. constructor, issued by the Ministry of Transport and Communications of the Republic of Macedonia, according to the Law on construction.
