The contracting authority shall exclude any economic operator from the contract award procedure, provided that it:

— is a under a bankruptcy or liquidation procedure;

— has unpaid taxes, contributions or other public duties, unless the economic operator has been approved delayed payment of taxes, contributions or other public duties, in accordance with the special regulations and pays them on regular basis;

— has been imposed a secondary sentence prohibition on participation in open call procedures, awarding public procurement contracts and contracts for public private partnership;

— has been imposed a secondary sentence temporary or permanent prohibition on performing a certain activity;

— has been issued a misdemeanour sanction prohibition on practising profession, performing activity or duty, i.e. temporary prohibition for performing a particular activity, or

— has presented false information or has failed to submit the information required by the contracting authority.

Each economic operator shall deliver a document for registered activity in order to prove it is registered as a natural person or legal entity to pursue the activity related to the subject matter of the public procurement contract or a proof that it belongs to a professional association in accordance with the regulations of the country where it is registered.

Each economic operator shall deliver Licence A for construction works.

The economic operator shall submit the following documents for the purpose of proving its personal standing:

— a statement by the economic operator that it has not been imposed a legally valid court decision for participation in criminal organization, corruption, fraud or money laundering in the last 5 years;

— certificate by a competent authority that a…

… bankruptcy procedure has not been initiated;

… liquidation procedure has not been initiated;

— certificate by a competent authority from the country where that economic operator is registered for paid taxes, contributions and other public duties;

— certificate by the Register of sentences for committed crimes of legal entities that a secondary sentence…

… prohibition on participation in open call procedures, awarding public procurement contracts and contracts for public private partnership, has not been imposed;

… temporary or permanent prohibition on performing a certain activity, has not been imposed;

— certificate that a misdemeanour sanction resulting in prohibition for practising profession, performing activity or duty, i.e. temporary prohibition for performing a particular activity has not been imposed by a legally valid court decision.

Економска и финансиска состојба:

— Balance sheets certified by the competent authority, i.e. audited balance sheets or extracts from the balance sheets, in cases where publication of balance sheets is required under the law in the country in which the economic operator is established;

— Statement of the total turnover of the enterprise (data from the income statement issued by the competent authority, i.e. audited profit and loss account) for the last 2 (two) years.

*A foreign legal entity shall submit the audit report, which should be positive and issued by a foreign reputable establishment, registered for audit performance containing data on the total economic operations of the foreign bidder in the last 2 years and it must be translated into Macedonian.

Техничка и професионална способност:

Civil Engineering Experience:

List of works performed in the past 5 years with enclosing certificates for satisfactory performance of the works, certificates that include the value, period of time and location of performance of the works and statements whether the works were performed in accordance with the rules of business operations and whether they were properly performed.

Personnel:

— Statement from the economic operator about the number of employees (please submit enclosed to the statement M1/M2 forms or confirmations from the competent institution);

— Statement from the economic operator that it has minimum 3 (three) civil engineers with ‘A’ authorizations for performing 1st category construction (please submit enclosed to the statement M1/M2 forms or confirmations from the competent institution and the relevant construction authorizations);

— Educational and professional qualifications of the economic operator or its managing staff, and particularly the persons responsible for performing the specific works;

— Statement on engaged Key Personnel in charge of performing the works, regardless of the fact whether they are employed with the economic operator, and if the engaged technical personnel is not employed with the economic operator, submit evidence of their availability (please enclose to the Statement CVs for each person from the enclosed Key Personnel in charge of performing the works and the required Authorizations).

Equipment:

— The economic operator needs to prove that it has at its disposal the equipment for performing the specific works that are subject of the contract, and to prove that it has the equipment in its ownership or that, through a Rent Contract, Leasing Contract, Procurement Contract or in another way, has provided the required equipment in full operational condition and the operator has to prove that based on the known engagements the equipment would be available for the entire period of implementation of the contract in question;

— Statement from the economic operator that it has at its disposal the equipment for performing the specific works that are subject of the contract and that such equipment would be included for the entire period of validity of the public procurement contract.

Минимално ниво(а) на стандарди:

Civil Engineering Experience:

The economic operator should have implemented:

— The economic operator should have implemented minimum 2 (two) contracts for construction of road infrastructure in the past 5 (five) years;

— The minimum value of the aforementioned 2 (two) implemented contracts for construction of road infrastructure should have the value of 10 000 000 MKD, VAT included, for each contract individually.

Personnel:

— The economic operator should have an average number of employed personnel in regular labour relation of minimum 20 (twenty) persons (submit M1/M2 forms or confirmations from the competent institution) from which minimum 3 (three) civil engineers with ‘A’ authorizations for performing 1st category construction (submit enclosed the relevant ‘A’ authorizations for performing 1st category construction).

The key personnel in charge of performing the works — the Economic operator should specify the key personnel in charge of performing the works, regardless of the fact whether they are directly employed with the economic operator:

— Position: 1 (one) Construction Manager — civil engineer with university degree and with ‘A’ authorization for performing work in the area of civil engineering with minimum 5 (five) years of experience in civil engineering activities;

— Position: Surveyor — surveyor engineer with university degree and with ‘A’ engineering authorization for performance of work in the area of geodesy and with minimum 5 (five) years of experience in civil engineering activities.

Equipment:

The economic operator should have available the following equipment:

— Minimum 1 (one) excavator;

— Minimum 1 (one) grader;

— Minimum 2 (two) trucks — tippers;

— Minimum 1 (one) finisher;

— Minimum 2 (two) vibratory rammer for trench compression;

— Minimum 1 (one) vibrating roller with steel wheels;

— Minimum 1 (one) roller with rubber wheels;

— Minimum 1 (one) trench digger.

Извршување на договорот
Потребни депозити и гаранции:

Tender guarantee in the form of bank guarantee (3 %).

Guarantee for implementation of the contract in a quality manner in the form of a bank guarantee (15 %).

All other information about the guarantees is determined in the tender documentation.

Правна форма што треба да ја преземе групата економски оператори на која ќе се додели договорот:

Contracting authority will not require from the group of economic operators to associate in a specific legal form for the purpose of executing the contract.
