2.2. Personal condition:

2.2.1. The contracting authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership;

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity;

— it is in bankruptcy or liquidation proceedings;

— it has unpaid taxes and other public charges, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer;

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity; and

— it provides false information or fails to submit the information requested by the contracting authority.

2.2.2. In order to prove its personal condition, the economic operator shall submit the following documents:

— a declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority;

— confirmation that there is no liquidation procedure undertaken by the competent authority;

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that minor penalty…

… — ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership — has not been imposed;

… for temporary or permanent prohibition of a specific activity has not been imposed;

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

2.2.3. The statement in indent 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4. The confirmations that there are no bankruptcy proceedings and liquidation proceedings, as well as the certificates from the Register of penalties for criminal acts in indents 5 and 6 of subsection 2.2.2, shall be issued by competent authorities in the country in which the economic operator is established. In the Republic of Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia.

2.2.5. The receipt for paid taxes, contributions and other charges shall be issued by a competent authority of the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue such certificates is the Public Revenue Office.

2.2.6. The receipt in indent 7 of subsection 2.2.2 shall be issued by the competent authority in the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue this certificate is the Central Registry of the Republic of Macedonia.

2.2.7. The documents referred to in sub-item 2.2.2 must not be older than six (6) months from the deadline for submission of bids.

2.2.8. If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2 or if they do not encompass all the cases mentioned above, the economic operator may submit a statement certified by a competent authority.

2.3. Ability to perform professional activity:

2.3.1. In order to qualify as capable for performing the contract for public procurement in terms of carrying out a professional activity, the economic operator should meet the following minimum requirements:

— it should be registered for activities related to the subject of the contract for public procurement;

— it should have a Construction License A, according to the Law on Construction (‘Official Gazette of the Republic of Macedonia’ No 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14, 187/14, 44/15 and 129/15).

2.3.2. In order to prove the capability of doing professional activity, the economic operator shall submit the following documents:

— Documents of registered activity — DRD form — as a proof that it is registered as a legal entity for performing the activity related to the subject of the public procurement contract, or a proof that it belongs to a professional association in accordance with the regulations of the country in which it is registered. In the Republic of Macedonia, the body responsible for issuing the document (DRD form) is the Central Registry of the Republic of Macedonia.

— If the country of registration of the economic operator does not issue such a document, the economic operator may submit another appropriate document certified by a competent institution that will unequivocally prove the capability to perform the contract for public procurement in terms of carrying out a professional activity, and the equivalence of the foreign document with the Macedonian document for registered activity.

— Contruction License A, issued in accordance with the Law on Construction.

A foreign entity is required to obtain a certificate for the activities that are subject to the public procurement, i.e. construction of buildings of the first category, from the body of the state administration that is responsible for the operations in the area of spatial management — Ministry for Transport and Communications according to the Law on Construction.

2.4. Economic and financial condition:

2.4.1 In order to qualify as capable of performing the contract for procurement from the aspect of its economic and financial situation, the economic operator must meet the following minimum requirements:

a) To have a total turnover of at least 6 000 000 EUR for each of the last 3 years; and

b) To have a positive financial result (income statement) in the last three (3) years.

2.4.2. If the economic operator carries on the business in a period of less than 3 years, a minimum requirement for establishing the economic and financial condition of the economic operator shall be that it has achieved the turnover of sub-item 2.4.1 in the years for which data are available.

2.4.3. The economic operator shall prove the fulfilment of the minimum requirements stipulated in item 2.4.1 or 2.4.2 by submitting the following:

— Report on the balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance-sheet is required under the law of the country in which the economic operator is established;

— Statement of the total turnover (data from the income statement issued by a competent authority, i.e. audited income statement) and, where appropriate, of the turnover in the area covered by the contract for public procurement, and the last 3 financial years for which such data are available, depending on the date on which the company was established or started to operate, and depending on the availability of such information.

2.4.4. If the balance sheets and income statements have been subject to commercial audit, the economic operator may submit them as a proof that it meets the minimum requirement for establishing the economic and financial situation without being further verified by the competent authority.

2.4.5. If the balance sheet and income statement have not been subject to commercial audit, the economic operator shall submit them as certified or issued by a competent authority to prove that it meets the minimum requirement for establishing the economic and financial situation. The competent authority in the Republic of Macedonia is the Central Registry of the Republic of Macedonia.

2.4.6. Economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and the subject, except in the case of data from the income statement. If the economic operator proves its economic and financial capability referring to the support of another entity, it is required to demonstrate that support with valid evidence that the entity will make available financing to the economic operator. The entity that provides financial support must not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.4.7. If economic operators submit a bid as a group of economic operators, the economic and financial situation is proved by taking into account the resources of all group members. If the group of economic operators started with financial support from a third entity, the economic and financial situation is determined according to the above mentioned.

2.4. Economic and financial condition.

2.4.1. In order to qualify as capable of performing the contract for procurement from the aspect of its economic and financial situation, the economic operator must meet the following minimum requirements:
