Statement by the economic operator that it has not been announced, in the last 5 years, effective court decision for participation in criminal organization, corruption, fraud or money laundering:

— Certificate that it is not subject to bankruptcy procedure issued by competent authority;

— Certificate that it is not subject to liquidation procedure issued by competent authority;

— Certificate for paid taxes, contributions and other public duties by the competent authority in the country where that economic operator is established;

— Certificate from the Register of penalties for committed criminal acts of legal entities that a minor penalty…

— License A for designing structures of first category as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14 and 187/14). (In case of tenderers bidding as a group of economic operators (Joint Venture), this condition shall apply to each of the companies (members) comprising the group (JV)).

Економска и финансиска состојба:

— Total revenues of 500 000 EUR, aggregate amount in the last 3 years;

The economic operator shall prove that he meets the requirements for Economic and financial status by furnishing the following:

— Copy of balance sheet report and data on income statements for 2011, 2012 and 2013, certified by a competent authority, i.e. audited balance sheets or abstracts of the report on balance sheets, where balance sheet publication is required under the law of the country where the economic operator is registered.

— For Foreign Tenderer Copies of auditors' reports of the Foreign Tenderer, which shall be positive and shall be issued by a reputable foreign institution registered to provide audit services. Auditor reports should contain data about the overall economic operation of the Foreign Tenderer (for the last 3 years).

Техничка и професионална способност:

Minimum 1 (one) developed, audited and delivered design for construction or reconstruction or rehabilitation of state roads (motorways, expressways, national or regional roads) with a minimum value of 10 000 000 MKD.

— Minimum 5 (five) B.Sc. Engineers employed, of which minimum 3 (three) shall have Authorization A for development of design documents in civil engineering.

— Notification on contract items that the economic operator intends to subcontract to third parties.

Key personnel:

— Chief Design Engineer: Bachelor of Civil Engineering — BS CE possessing an Authorization A for development of design documents in civil engineering, with at least 10 (ten) years of work experience as a design engineer, and 7 (seven) years of work experience as a Road Design Engineer.

— Road Alignment Design Engineer: Bachelor of Civil Engineering — BS CE possessing an Authorization A for development of design documents in civil engineering, with at least 7 (seven) years of work experience as a design engineer, and 4 (four) years of work experience as a Road Design Engineer.

— Design Engineer of Structures (bridges, underpasses, overpasses, retaining walls and viaducts): Bachelor of Civil Engineering — BS CE possessing an Authorization A for development of design documents in civil engineering, with at least 7 (seven) years of work experience as a design engineer, and 4 (four) years of work experience as a Design Engineer of Structures (bridges, underpasses, overpasses, retaining walls and viaducts).

— Design Engineer of Geotechnics: Bachelor of Engineering possessing an authorization A for developing design documents in geotechnics, with at least 5 (five) years of work experience in civil engineering and 3 (three) years as a Design Engineer on projects involving geotechnics.

— Geodetic Engineer possessing an Authorization in Geodesy with minimum 3 years of work experience in civil engineering field.

— Expert in Strategic Environmental Impact Assessment (SEIA)

Required education: Diploma in the field of environmental engineering, ecology, engineering, civil engineering, technical — technological sciences or other appropriate diploma in natural sciences related to the environment protection;

General experience: minimum 5 (five) years of work experience in the field of protection and improvement of the environment and nature;

Specific experience:

(1) Certificate of passed professional exam for obtaining the status of an Expert in Strategic Environmental Impact Assessment of Projects for the entity responsible for the Environment Report, issued by the Ministry of Environment and Physical Planning (MOEPP) of RM, and listed on the List of Experts in SEIA, kept by the MOEPP;

(2) At least 1 developed and approved Strategic Environmental Impact Assessment (SEIA) Study in the transport sector (transport plans, programs, strategies, infrastructural projects for state roads or railway) in the last 5 years, on which the expert worked as an Expert in SEIA.

Note: In case a foreign expert is proposed, either a confirmation/certificate from expert's home country shall be submitted, or a statement that this matter in his/her home country is regulated in a different manner. Also, for foreign physical and legal entities, provisions apply of the Construction Law (Official Gazette of RM no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14 and 115/14, and all its amendments to date) and of the Environment Protection Law (Official Gazette of Republic of Macedonia no. 53/05, 81/05, 24/07, 159/08, 83/09, 48/10, 124/10, 51/11, 124/10, 51/11, 123/12, 93/13, 187/13 and 42/14, and all its amendments to date).

— Environment Protection Expert:

(1) Certificate of passed professional exam for obtaining the status of an Expert in Environmental Impact Assessment of Projects, issued by the Ministry of Environment and Physical Planning (MOEPP) of RM, and listed on the List of Experts in EIA of projects, kept by the MOEPP;

(2) At least 1 (one) developed and approved Study or Report on Environmental Impact Assessment (EIA) in the transport sector (state roads or railway) in the last 5 years, on which the expert worked as an Expert in EIA.

(3) Developed an ESIA — Environmental and Social Impact Assessment study or an Environmental Management Plan, or a Habitats and Biodiversity Plan, or other similar document in the field of environment protection and social aspects according to policies and procedures of the European Bank of Reconstruction and Development or other international financial institution(s) (IFIs).

— Note: In case a foreign expert is proposed, either a confirmation/certificate from expert's home country shall be submitted, or a statement that this matter in his/her home country is regulated in a different manner. Also, for foreign physical and legal entities, provisions apply of the Construction Law (Official Gazette of RM no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 70/13, 79/13, 163/13, 27/14, 28/14, 115/14, and all its amendments to date) and of the Environment Protection Law (Official Gazette of Republic of Macedonia no. 53/05, 81/05, 24/07, 159/08, 83/09, 48/10, 124/10, 51/11, 123/12, 93/13, 187/13, 42/14, and all its amendments to date).

The economic operator can offer a person who possesses both a Certificate of an Expert in Strategic Environmental Impact Assessment and a Certificate of an Expert in Environmental Impact Assessment issued by the Ministry of Environment and Physical Planning (MOEPP) of RM, and is listed on the List of Experts in SEIA and EIA of projects, kept by the MOEPP. In such cases, the cumulative conditions of the specific experience for both experts listed above with the stated proofs shall apply for the proposed expert. The required education and general experience shall remain the same.

— Expert in Social Aspects Assessment:

Required education: Diploma in the field of social sciences, sociology, social work and policy, or an appropriate diploma related to social aspects assessment (social impacts) of project implementation;

General experience: Minimum 2 (two) years of experience in the field of social aspects (social impacts) related to projects, communications and public opinion surveys;

At least 1 (one) completed project in the last 5 (five) years on which he/she worked as an Expert for social aspects (impacts) assessment (Resettlement Policy Framework, or Resettlement/Expropriation Action Plan, or Stakeholder Engagement Plan, etc.), according to policies and procedures of the European Bank of Reconstruction and Development (EBRD) or other international financial institution(s) (IFIs).

Equipment:

— Adequate technical equipment with hardware and software required for development of the design documents in an electronic form.

— Geodetic instruments and equipment (appropriate equipment for surveying, double frequency GPS unit, 1 (one) total station, off-road vehicle).

The economic operator shall prove that he meets the requirements for Technical and professional competence by furnishing the following:

— Copy of the Contract and a proof that the project was completed and audited, as well as written confirmation by recipients of the service performed.

— Copy of M1/M2 employment forms and copies of diplomas, and copy of authorization A for developing design documents in civil engineering.

— For Chief Design Engineer: copies of the diploma and of authorization A for developing design documents in civil engineering issued by competent national authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14 and 187/14), M1/M2 employment form, and completed short biography forms (provided in tender documents) for the proposed experts.

— For Road Alignment Design Engineer: copies of the diploma and of authorization A for developing design documents in civil engineering issued by competent national authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14 and 187/14), M1/M2 employment form, and completed short biography forms (provided in tender documents) for the proposed experts.

— For Design Engineer of Structures (bridges, underpasses, overpasses, retaining walls and viaducts): copies of the diploma and of authorization A for developing design documents in civil engineering issued by competent national authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14 and 187/14), M1/M2 employment form, and completed short biography forms (provided in tender documents) for the proposed experts.

— For Design Engineer of Geotechnics: copies of the diploma and of authorization A for developing design documents in geotechnics issued by competent national authorities, as per the Construction Law in force (Official Gazette of Republic of Macedonia no. 130/09, 124/10, 18/11, 36/11, 54/11, 13/12, 144/12, 25/13, 79/13, 137/13, 163/13, 27/14, 28/14, 42/14, 115/14, 149/14 and 187/14), M1/M2 employment form, and completed short biography forms (provided in tender documents) for the proposed experts.

— For Geodetic Engineer: copies of the diploma and of authorization in geodesy, M1/M2 employment form, and completed short biography forms (provided in tender documents) for the proposed experts.

— For Expert in Strategic Environmental Impact Assessment (SEIA)

— Copy/ies of the diploma/s

— Copies of M1/M2 employment forms and filled out and signed biography form/s for proposed expert/s (provided in tender documents);

— Copy of the Certificate of an Expert in Strategic Environmental Impact Assessment issued by the Ministry of Environment and Physical Planning (MOEPP) of RM

— Copy of the List of Experts (only of the section where the expert's name is printed) kept by the Ministry of Environment and Physical Planning (MOEPP) of RM;

— Copy of a confirmation/reference that the proposed professional had been engaged as an expert on strategic assessment or opinion, issued by the authority competent in approving the document.

— For Environment Protection Expert:

— Copy of the Certificate of an Expert in Environmental Impact Assessment issued by the Ministry of Environment and Physical Planning (MOEPP) of RM

— Copy of the List of Experts (only of the section where the expert's name is printed) kept by the MOEPP;

— Copy of a confirmation about being engaged as an expert in developing an Environmental Impact Assessment (EIA) Study or Report, or copy of a Certificate approving the Study or Report by the authority competent for (a) specified project(s);

— Copy of a confirmation/reference that the expert had been engaged in EIA of (a) project(s), i.e. on developing the listed document(s) according to policies and procedures of the European Bank of Reconstruction and Development (EBRD) or other international financial institution(s) (IFIs);

For Expert in Social Aspects Assessment:

— Copy of a confirmation/reference that the expert had been engaged in assessment of social aspects of (a) project(s), i.e. on developing the listed document(s) according to policies and procedures of the European Bank of Reconstruction and Development (EBRD) or other international financial institution(s) (IFIs);

— Statement about the technical equipment.

Quality System Standards:

To qualify as capable of implementing the respective public procurement contract in terms of quality system standards, the economic operator must meet the following requirements:

— Quality System Standards ISO 9001:2008.

— Standard for Occupational Health and Safety OHSAS 18001:2007.

The economic operator shall prove meeting the standards of quality systems by submitting the following:

— Copy of valid Quality System Standards ISO 9001:2008 Certificate;

— Copy of valid Certificate for Occupational Health and Safety OHSAS 18001:2007.

In case of tenderers bidding as a group of economic operators (Joint Venture), this condition shall apply to each of the companies (members) comprising the group (JV).

Environmental Management Standards

To qualify as capable of implementing the respective public procurement contract in terms of environmental management standards, the economic operator must meet the following requirements:

— Environmental Management Standards ISO 14001:2004.

The economic operator shall prove meeting the environmental management standards by submitting the following:

— Copy of valid Environmental Management ISO 14001:2004 Certificate.
