II. Technical specifications: Subject of the procurement is procurement of electricity for all broadcasting facilities of the Public Enterprise Macedonian Broadcasting (PEMBC) within a period of 1 year. The table below shows collectively the planned needs of active electricity, by months and in total at annual level, of the PEMBC, expressed in kWh, divided by voltage levels, that is, a way of measurement, regions. As an attachment to this table, there is also a Load profile for a specific group of facilities for measurements performed in 2014, which are used for better defining of the price by the Bidder. The holder of the procurement is obliged to calculate all costs, including the costs for balancing, in the price that he will offer for a kWh, that is, to take over the balance responsibility on behalf of the Holder of the procurement, all discounts, import customs etc. The payment of the consumed electricity will be performed after the conducted measurement for every measuring point, which will be performed by the Operator of the distribution system, and the measuring points according to their title, are provided in the very technical specification. The compensation for the use of the electricity market and the purchase of electricity from Authorized electricity producers should be separated in the delivered monthly invoice. The contracting authority reserves the right to increase the planned quantities of electricity during the realization of the Agreement, according to the accepted price. The contracting authority reserves the right to notify the Holder of the procurement that the planned quantities of electricity may be reduced during the realization of the Agreement. Attachment 1 — planned consumption for 2015 in total and separately according to way of measurement, and measuring points by regions Attachment 2 — Load files for the indicated points measured in 2014. In order to qualify as capable to perform the subject agreement on public procurement in terms of his technical or professional ability, the economic operator should meet the following minimal conditions: — to possess a license for performance of energy-related activity, trade of energy or supply of energy; — to possess an EIC code issued by AD MEPSO — Skopje as a performer of energy-related activity transfer of electricity; — to be a registered participant in the electricity market pursuant to the Rules on an electricity market; — to have signed an agreement for balanced responsibility pursuant to the Rules on an electricity market.

2.2 Personal condition:

2.2.1 The contracting authority will exclude from the procedure for awarding an agreement on public procurement every economic operator:

— that was sentenced with an effective verdict in the past 5 years for participation in a criminal organization, corruption, fraud or money laundering;

— that was sentenced with a minor penalty — prohibition for protection in procedures for public invitation, awarding agreements on public procurement and public-private partnership agreements;

— that was sentenced with minor penalty — temporary or permanent prohibition for performance of a specific activity;

— that is in bankruptcy or insolvency procedure;

— that has unpaid taxes, contributions and other public charges, except if the economic operator has an approval for delayed payment of taxes, contributions or other public charges in accordance with the special regulations and pays the same regularly;

— that was sentenced with a sanctioned offence — prohibition for performance of a vocation, business activity or duty, that is, temporary prohibition for performance of a specific activity and

— that gives false information or does not deliver the information demanded by the contracting authority.

2.2.2 In order to prove its personal condition, the economic operator delivers the following documents:

— statement by the economic operator that in the last 5 years it was not sentenced with an effective verdict for participation in a criminal organization, corruption, fraud or money laundering;

— certificate that no insolvency procedure is open by a competent authority;

— certificate that no liquidation procedure is open by a competent authority;

— certificate for paid taxes, contributions and other public charges by a competent authority from the country where the economic operator is registered;

— certificate from the Register of penalties for performed criminal acts of the legal entities, that it was not sentenced with a minor penalty for participation in procedures for open invitation, awarding agreements on public procurement and public-private partnership agreements;

— certificate by the Register of penalties for performed criminal acts of the legal entities that it was not sentenced with a minor penalty — temporary or permanent prohibition for performance of a specific activity and

— certificate that with an effective verdict it was not sentenced with a sanctioned offence — prohibition for performing vocation, business activity or duty, that is, temporary prohibition for performing a specific activity.

2.2.3 The statement from line 1 subpoint 2.2.2 is prepared and signed by the economic operator and the same does not have to be certified by a competent authority.

2.2.4 The certificates that an insolvency and liquidation procedures have not been open, as well as the certificates from the register of penalties for performed criminal acts from line 5 and 6 of subpoint 2.2.2., are issued by competent authorities in the country where the economic operation is registered. Competent authority for the issuance of these certificates in the Republic of Macedonia is the Central Register of the Republic of Macedonia.

2.2.5 The certificate for paid taxes, contributions and other charges is issued by a competent authority from the country where the economic operator is registered. Competent authority for the issuance of this certificate in the Republic of Macedonia is the Public Revenue Office.

2.2.6 The certificate from line 7 subpoint 2.2.2 is issued by the competent authority in the country where the economic operator is registered. Competent authority for the issuance of this certificate in the Republic of Macedonia is the Central Register of the Republic of Macedonia.

2.2.7 The documents from subpoint 2.2.2 must not be older than 6 months calculated from the final deadline for submitting the bids backwards.

2.2.8 If the country where the economic operator is registered does not issue the documents listed in subpoint 2.2.2 or if they do not include all cases indicated above, the economic operator can deliver a statement certified by a competent authority.

2.3 Ability to perform professional activity

2.3.1 In order to prove the ability to perform a professional activity, the economic operator should deliver a document for registered activity as an evidence that it is registered as a physical person or legal entity for performing the activity related to the subject of the agreement on public procurement or an evidence that it belongs to a respective professional association pursuant to the regulations of the country where it is registered.

— to possess a license for performance of energy-related activity, trade of energy or supply of energy;

— to possess an EIC code issued by AD MEPSO — Skopje as a performer of energy-related activity transfer of electricity;

— to be a registered participant in the electricity market pursuant to the Rules on an electricity market;

— to have signed an agreement for balanced responsibility pursuant to the Rules on an electricity market.

2.3.2 The economic operator is obliged to deliver a valid license for performance of energetic activity, trade or supply of electricity issued by the Energy Regulatory Commission of the Republic of Macedonia, to deliver a valid EIC code issued by AD MEPSO — Skopje, as a performer of energy-related activity transfer of electricity, to deliver a certificate that it is registered for a participant in the electricity market pursuant to the Rules on an electricity market.

4.6 Bid guarantee.

4.6.1 As part of the bid, the economic operator should compulsorily provide a guarantee of the bid (guarantee for participation) in an amount of at least 3 % of the total value of the bid excluding VAT.

4.6.2 The guarantee is in a form of a banking guarantee. All banks are acceptable for the contracting authority.

4.6.3 The guarantee should be submitted in its original form. Copies are not acceptable. The guarantee must have a validity period of at least 20 days (after the day of expiry of the bid validity). Every bid that does not contain a bid guarantee, or contains a bid guarantee which is not in accordance with the conditions in the tender documentation, will be rejected by the contracting authority as unacceptable.

4.6.4 The bid guarantee is returned to the most successful economic operators within a period of 7 days after the conclusion of the agreement with the most favourable economic operator.

4.6.5 The bid guarantee may be charged, if the bidder withdraws its bid prior to the expiry of its validity period, if it does not accept the correction of the arithmetic mistakes by the commission, if it does not sign the agreement on public procurement pursuant to the conditions of the tender documentation and if it does not provide a guarantee for successful performance of the agreement or does not extend the validity of the same at the request of the contracting authority.

4.6.6 The contracting authority reserves the right to ask from the bidder/s to extend the validity of the guarantee of the bid for an additional period, as it will deem necessary.

7.4 Guarantee for quality performance of the agreement.

7.4.1 A condition for signing of the agreement with the most favourable bidder is the provision of a guarantee by the selected most favourable bidder for quality performance of the agreement in an amount of 10 % of the value of the agreement.

7.4.2 The guarantee from point 7.4.1 is delivered in a form of a banking guarantee in writing. The guarantee should be submitted in original. Copies are not acceptable.

7.4.3 The guarantee for quality performance of the agreement will be valid until the agreement is fully realized. The contracting authority after the performed selection of the most favourable bidder, additionally determined the deadline of validity of the guarantee.

7.4.4 The banking guarantee for quality performance of the agreement will be in the currency of the agreement.

7.4.5 The guarantee for quality performance of the agreement should be issued by a bank.

7.4.6 The guarantee for quality performance of the agreement is delivered by the most favourable bidder after the obtained notification regarding the performed selection, and before the conclusion of the agreement within a term specified by the contracting authority with the notification.

7.4.7 The guarantee for quality performance of the agreement is being delivered within the specified period, as follows: by mail or personally to the contact person from point 1.2.2 of the tender documentation.

7.4.8 The guarantee for quality performance of the agreement will be charged if the holder of the procurement does not meet some of the obligations of the public procurement agreement within the due period, for which it will notify the holder of the procurement in writing. If the guarantee for quality performance of the agreement is charged, the contracting authority will publish to the SPPS a negative reference. For the charging of the banking guarantee for quality performance of the agreement and for the publishing of a negative reference at the EPPS, the holder of the procurement may initiate a dispute before the competent court.

7.4.9 If the public procurement agreement is fully realized according to what has been agreed, the banking guarantee for quality performance of the agreement is returned to the holder of the procurement by the contracting authority within 14 days from the complete realization of the agreement.

7.4.10 The contracting authority returns the guarantee for quality performance of the agreement to the holder of the procurement by mail, personally in the seat of the economic operator or personally in the seat of the contracting authority.

7.1 Manner of payment.

7.1.1 The following manner of payment is stipulated: within 30 days from the last day of delivery in the month. The manner of payment is compulsory. Every bid that contains manner of payment different than the one determined in this point, shall be considered unacceptable and as such it will be rejected by the commission on public procurements.
