2.2. Personal Standing

2.2.1 The contracting authority will exclude from the contract award procedure any economic operator:

— That in the last 5 years has had an effective sentence for participation in a criminal organization, corruption, fraud or money laundering;

— That was served with a minor penalty of prohibition for participation in public call procedures, public procurement contract awarding and agreements for public private partnership;

— That was served with a minor penalty of temporary or permanent prohibition of professional capacity;

— That is in bankruptcy or liquidation proceedings;

— that has unpaid taxes and other public charges, unless the economic operator has been granted deferred payment of taxes, contributions or other taxes in accordance with special regulations and pays them regularly;

— That was served with a misdemeanour sanction – ban on performing profession, activity or duty i.e. temporary prohibition on performing specific activity; and

— gives false information or does not submit the data requested by the contracting authority.

2.2.2 In order to prove its personal situation the economic operator submits the following documents:

— Statement by the economic operator that in the past five years they have not been issued with an effective sentence for participation in criminal organization, corruption, fraud or money laundering;

— Certificate that there is no ongoing bankruptcy proceedings;

— Certificate that there is no ongoing liquidation proceedings;

— Certificate for paid taxes, contributions or other public taxes from a competent body in the country where the economic operator is registered;

— Certificate issued by the Registry of Penalties for criminal acts of the legal entities…

… proving that they have not been issued with a minor penalty for prohibition of participation in public call procedures, public procurement contract awarding and agreements for public-private partnerships;

… that they have not been issued with a minor penalty for temporary or permanent prohibition for performance of certain activity;

— Certificate proving that there is no effective misdemeanour sanction – ban on performing profession, activity or duty i.e. temporary prohibition of performing specific activity.

2.2.3 The statement stipulated in indent 1 point 2.2.2 is prepared and executed by the economic operator and should not be notified by a competent body.

2.2.4 The certificates that there are no open proceedings for bankruptcy or liquidation, as well as the certificates issued by the Registry for penalties for criminal acts stipulated in indents 5 and 6 point 2.2.2 are issued by competent bodies in the country where the economic operator is registered. In Republic of Macedonia the competent body for issuance of these certificates is the Central Registry of Republic of Macedonia.

2.2.5 The certificate for paid taxes, contributions and other taxes is issued by a competent body where the economic operator is registered. In Republic of Macedonia the competent body for issuance of this certificate is the Public Revenue Office.

2.2.6 The certificate stipulated in indent 7 of point 2.2.2 is issued by the competent body in the country where the economic operator is registered. In Republic of Macedonia the competent body for issuance of this certificate is the Central Registry of Republic of Macedonia.

2.2.7 The documents stipulated in point 2.2.2 must not be older than 6 (six) months calculated backwards from the deadline for submission of bids.

2.2.8 If the country in which the economic operator is registered does not issue the documents stipulated in item 2.2.2 or if they do not cover all above-mentioned cases, the economic operator may submit a statement certified by a competent authority.

2.4. Economic and financial state

2.4.1 In order to qualify as capable of implementing the subject-matter of the public procurement contract in terms of his economic and financial standing, the economic operator should meet the following minimum requirements:

— The economic operator should have positive account balance for the last three years (2014, 2013 and 2012).

2.4.3 The economic operator proves the fulfilment of the minimal condition stipulated in sub-item 2.4.1 by submitting the following document:

— statement regarding the overall turnover of the enterprise (data on the profit and loss account issued by a competent authority, i.e., audited profit and loss account) and where applicable, from the turnover in the field covered by the public procurement contract, for the last three financial years at the most for which such information is available, depending on the date on which the enterprise has been incorporated or commenced its operation and depending on the availability of such information or,

— balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets, when the announcement of the balance sheet is prescribed by law in the country wherein the economic operator is registered.

2.5 Technical or professional ability

2.4.1 In order to qualify as capable of implementing the public procurement contract in terms of its technical and professional capability, the economic operator shall meet the following minimum requirements:

— It is necessary for the economic operator to have performed at least three services of this kind in the past three years (2014, 2013 and 2012) and

— The economic operator should have the equipment for providing the service.

2.5.2 The economic operator proves the fulfilment of the conditions stipulated in sub-item 2.5.1 by submitting the following documents:

— list of the principal services of the tenderers or candidates conducted in the past three years (2014, 2013 and 2012) containing values, dates, buyers (contracting authorities or economic operators), by providing at least three statements for the services issued by the recipients, or if such statements cannot be provided due to reasons beyond the control of the economic operator, only with its statement regarding the conducted services;

— statement and list of the equipment in its possession for providing the service that is subject-matter of the procurement.
