2. ABILITY OF ECONOMIC OPERATORS

2.1 Presenting Evidence of Ability

2.1.1 In addition to the offer, the Economic Operator is obliged to submit accompanying documentation to prove:

— their personal situation

— their ability to perform professional activity

— their economic and financial situation

— their technical ability

— the seriousness of the offer

— the independence of the offer

2.1.2 Required documentation is submitted in its original form or as a copy verified by the Economic Operator with a signature of the person in charge, with confirmation that it is an accurate translation of the original document.

2.1.3 When considering if the documentation is complete and valid in order to establish the ability of the Economic Operator, as well as when assessing the offer, the Commission is obliged to request from the tenderers to clarify or supplement the documents for establishing their ability within no less than 5 working days following the deadline for submitting the offers.

2.1.4 The Economic Operator submits the required explanation in written form within the timeframe determined by the contracting authority, which should not be less than 5 days, as of the day the request has been submitted by the tenderer.

2.1.5 No changes in the offer, except corrections of arithmetical errors, should be requested, offered or allowed by the Commission or the Economic Operator

2.1.6 In case of a group of Economic Operators, all the members of the group individually prove their personal situation and abilities for performing professional activity.

2.2 Personal situation

2.2.1 The contracting authority is obliged to exclude from participation in a contract awarding procedure those Economic Operators that:

— have been convicted by final judgment for participation in a criminal organization, for corruption, fraud or money-laundering in the past 5 years;

— have been given minor penalty prohibiting them to participate in proceedings concerning public calls for bids, awarding contracts for public procurement, as well as contracts for public private partnership;

— have been given temporary or permanent ban to perform a specific activity;

— are the subject of proceedings for a declaration of bankruptcy or liquidation;

— have failed to fulfil obligations relating to the payment of taxes, social security contributions and other public duties, unless the Economic Operator has been granted the right for delayed payment of taxes, social security contributions or other public duties in compliance with the special regulations and it performs those duties on a regular basis;

— have been issued sanctions — ban to perform their profession, activity or duty, i.e. temporary ban to perform a specific activity and

— submit false information or fail to submit information required by the contracting authority.

2.2.2 To prove their personal situation, Economic Operators submit the following documentation:

— statement by the Economic Operator that they have not been convicted by final judgment for participation in a criminal organization, corruption, fraud or money-laundering in the past 5 years;

— evidence that they are not subjects of proceedings for a declaration of…

… bankruptcy by a competent authority;

… liquidation by a competent authority;

— evidence that taxes, social security contributions and other public duties have been paid issued by a competent authority in the state where the Economic Operator has been registered;

— evidence issued by the Registry for penalties for committed crimes to legal entities that they have not been given minor penalty…

… prohibiting them to participate in proceedings concerning public calls for bids, awarding contracts for public procurement, as well as contracts for public private partnership;

… — permanent or temporary ban to perform their specific activity and

— evidence that they have not been issued a final judgment — ban to perform their profession, activity or duty, i.e. temporary ban to perform a specific activity.

2.2.3 The statement from line 1 item 2.2.2 is prepared in electronic form and signed with an electronic signature by the Economic Operator and it does not have to be verified by the competent authority.

2.2.4 Evidence that they are not subjects of proceedings for a declaration of bankruptcy and liquidation, as well as evidence from the Registry for penalties for committed crimes from line 5 and 6 and item 2.2.2 are issued by the competent authority in the state where the Economic Operator has been registered. In the Republic of Macedonia, the competent authority for issuing this evidence is the Central Registry of the Republic of Macedonia

2.2.5 The evidence that taxes, revenues and other public duties have been paid is issued by a competent authority in the state where the Economic Operator has been registered. In the Republic of Macedonia, the competent authority for issuing this evidence is the Administration of Public Revenue.

2.2.6 The evidence referred to in line 7 item 2.2.2 is issued by the competent authority in the state where the Economic Operator has been registered. In the Republic of Macedonia the competent authority for issuing this evidence is the Central Registry of the Republic of Macedonia.

2.2.7 The documents referred to in item 2.2.2 should not be older than six months, starting from the last date for submitting the offers.

The Commission will accept documentation for determining the personal situation issued after the date of the public disclosure of the offers, but not later than the day of choosing the best offer.

2.2.8 If the state where the Economic Operator has been registered does not issue the documentation listed in item 2.2.2 or they do not cover all of the above mentioned cases, the Economic Operator may submit a statement verified by a competent authority.

2.3 Ability to perform professional activity

2.3.1 In order to prove the ability to perform professional activities, the Economic Operator should submit documentation for its registered activity as proof that it has been registered as a physical or legal entity for performing the activity related to the subject of the agreement for public procurement or proof that it is part of a relevant professional association in compliance with the regulations of the state where it has been registered.

2.3.2 When establishing the ability of the Economic Operator to perform professional activity, the contracting authority requires evidence issued by the competent authority that the specific requirements for performing the activity are met in compliance with the regulations related to the subject of the procurement.

The Economic Operator should be in possession of a Certificate/License for performing public transport in the domestic road transport (Ministry of Transport and Communications). Certificate/License for transport of firewood.

2.4.2 In case the Economic Operator has been performing the activity for less than 3 years, the minimal requirement for determining its economic and financial situation is for the Economic Operator to have met the requirement from item 2.4.1 in the years for which data exists.

2.4.3 The Economic Operator provides proof that they meet the minimal requirement from item 2.4.1 or 2.4.2 by submitting (not necessary to delete. May be appropriately described in detail):

— a balance sheet verified by a competent authority, i.e. a revised balance sheet, or extracts from the balance sheet in cases when such disclosure is in compliance with the regulations of the state where the Economic Operator has been registered;

2.4.1 In order to be eligible for performing the relevant contract for public procurement from the perspective of its economic and financial situation, the Economic Operator should meet the following minimal requirements:

— have a positive financial result for the years 2012 and 2013.

2.5 Technical or professional ability (optional)

2.5.1 In order to be eligible for performing the relevant contract for public procurement from the perspective of its technical or professional ability, the Economic Operator should meet the following minimal requirements:

— possess a registered transport vehicle for delivering the required goods.

2.5.2 The Economic Operator provides proof of meeting the minimal requirements from item 2.5.1 by submitting (not necessary to delete. May be appropriately described in detail):

— a copy of a road book

2.5.4 The technical and professional ability of the Economic Operator may be supported by a different entity, irrespective of the legal relations between the Economic Operator and the entity except in the case of the reference list, earlier contracts and licenses. Should the Economic Operator provide proof of its technical and professional ability with reference to a different entity, they are obliged to provide evidence of this support with valid proof that the entity will provide the Economic Operator with the relevant technical and economic resources. The Economic Operator should provide evidence that they have not been convicted by final judgment for participation in a criminal organization, corruption, fraud or money-laundering.
