I. Production of control stamps — labels for marking of flour, for the requirements of the Marketing and Control Department; II. Printing of labels for marking the produced seed and transplanting material for the requirements of the Seed and Planting Material Directorate III. Printing of control stamps — labels for marking of the imported seed and planting materials for the requirements of the Seed and Planting Material Directorate within the Ministry of Agriculture, Forestry and Water Economy”I.

I. Production of control stamps — labels for marking of flour, for the requirements of the Marketing and Control Department;

II. Printing of labels for marking the produced seed and transplanting material for the requirements of the Seed and Planting Material Directorate.

III. Printing of control stamps — labels for marking of the imported seed and planting materials for the requirements of the Seed and Planting Material Directorate within the Ministry of Agriculture, Forestry and Water Economy”.

2.2 Personal condition

2.2.1 The contracting authority shall exclude any economic operator from the proceedings for awarding a public contract in the following cases:

— it has been rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— it has been sentenced with a minor penalty: ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership;

— it has been sentenced with a minor penalty for temporary or permanent prohibition to perform a specific activity;

— it is in bankruptcy or liquidation proceedings;

— it has unpaid taxes and other public charges, unless the economic operator is authorized to make deferred payment of taxes, contributions and other public duties in accordance with relevant regulations and if he is regular payer;

— prohibition sanction to perform professional activity or duty is pronounced to the economic operator, i.e. temporary prohibition for performing professional activity; and

— it provides false information or fails to submit the information requested by the contracting authority.

2.2.2 In order to prove its personal condition, the economic operator shall submit the following documents:

— A declaration by the economic operator that he was not rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering in the last 5 years;

— confirmation that there are no bankruptcy proceedings undertaken by the competent authority;

— confirmation that there is no liquidation procedure undertaken by the competent authority;

— receipt for paid taxes, contributions and other public duties by the competent authority of the country where the economic operator is established;

— certificate from the Registry of penalties for crimes committed by legal persons that minor penalty…

… — ban to participate in public tender procedures, awarding contracts and agreements for public-private partnership — has not been imposed;

… for temporary or permanent prohibition of a specific activity has not been imposed;

— confirmation that the final sentence has not been imposed as a crime sanction that prohibits performing professional activity or duty, i.e. temporary prohibition for performing specific activity.

2.2.3 The statement in indent 1 of subsection 2.2.2 shall be prepared and signed by the economic operator and it does not have to be certified by a competent authority.

2.2.4 The confirmations that there are no bankruptcy proceedings and liquidation proceedings, as well as the certificates from the Register of penalties for criminal acts in indents 5 and 6 of subsection 2.2.2, shall be issued by competent authorities in the country in which the economic operator is established. In the Republic of Macedonia, the body responsible for issuing these certificates is the Central Registry of the Republic of Macedonia.

2.2.5 The receipt for paid taxes, contributions and other charges shall be issued by a competent authority of the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue such certificates is the Public Revenue Office.

2.2.6 The receipt in indent 7 of subsection 2.2.2 shall be issued by the competent authority in the country in which the economic operator is established. In the Republic of Macedonia, the authority to issue this certificate is the Central Registry of the Republic of Macedonia.

2.2.7 The documents referred to in sub- item 2.2.2 must not be older than 6 (six) months from the deadline for submission of bids.

2.2.8 If the country in which the economic operator is registered does not issue the documents referred to in sub-item 2.2.2 or if they do not encompass all the cases mentioned above, the economic operator may submit a statement certified by a competent authority

2.3 Ability to perform professional activity

2.3.1 In order to demonstrate the ability to perform professional activity, the economic operator should submit a document for registered activity, proving that it is registered as a legal entity for conducting activities related to the subject of the contract for public procurement, or proof that it belongs to a professional association in accordance with the regulations of the country in which it is registered.

2.4 Economic and financial condition (for PART I, PART II and PART III)

2.4.1 In order to qualify as capable of performing the contract for procurement from the aspect of its economic and financial situation, the economic operator must meet the following minimum requirements:

— To have a positive financial result (income statement) in the last 3 years.

2.4.2 If the economic operator carries on the business in a period of less than three years, a minimum requirement for establishing the economic and financial condition of the economic operator shall be that it has achieved the turnover of sub-item 2.4.1 in the years for which data are available.

2.4.3 The economic operator shall prove the fulfillment of the minimum requirements stipulated in item 2.4.1 or 2.4.2 by submitting the following:

— Balance sheet certified by a competent authority, i.e. audited balance sheets or extracts from the balance sheets where publication of the balance-sheet is required under the law of the country where the economic operator is established;

— Extract on the total turnover of the company (data from the balance sheet issued by an authorized body, i.e. reviewed balance sheet) and if adequate, on the turnover in the scope that is covered by the contract on public procurements, for the last three financial years at the most, for which such information are available, depending on the establishment and start of the operation of the company and accessibility of such information.

2.4.4 If the balance sheet and income statement have been subject to commercial audit, the economic operator may submit them as a proof that it meets the minimum requirement for establishing the economic and financial situation without being further verified by the competent authority

2.4.5 If the balance sheet and income statement have not been subject to commercial audit, the economic operator shall submit them as certified or issued by a competent authority to prove that it meets the minimum requirement for establishing the economic and financial situation. The competent authority in the Republic of Macedonia is the Central Registry of the Republic of Macedonia.

2.4.6 Economic and financial capacity of the economic operator may be supported by another entity, regardless of the legal relations between the economic operator and the subject, except in the case of data from the income statement. If the economic operator proves its economic and financial capability referring to the support of another entity, it is required to demonstrate that support with valid evidence that the entity will make available the financing to the economic operator. The entity that provides financial support must not be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering.

2.4.7 If economic operators submit a bid as a group of economic operators, the economic and financial situation is proved by taking into account the resources of all group members. If the group of economic operators started with financial support from a third entity, the economic and financial situation is determined according to the above mentioned.

2.4 Economic and financial condition (for PART I, PART II and PART III)

2.4.7 If economic operators submit a bid as a group of economic operators, the economic and financial situation is proved by taking into account the resources of all group members. If the group of economic operators started with financial support from a third entity, the economic and financial situation is determined according to the above mentioned.

2.5 Technical or professional capability (for PART I, PART II and PART 3)

2.5.1 In order to qualify as capable for performing the subjected contract for procurement in terms of its technical or professional capability, the economic operator must meet the following minimum conditions:

— previous experience in realizing the same or similar subject of procurement and minimum 3(three) confirmations for on-time completed deliveries in the past 3 years, in accordance with the subject of the procurement.

— to dispose with minimum five permanently employed employees that shall execute the subject of the procurement (submission of a proof M1/M2 form),

— technical equipping and qualified economic operators with description of the equipment that is going to be used in the execution of the service in accordance with the subject of the procurement, as well as personnel and vehicles for transport of the procurement.

2.5.2. The economic operator proves the fulfilment of the minimum requirements set forth in item 2.5.1 by submitting the following:

— a list of main services of the bidders or candidates, executed in the past three years, stating values, dates, buyers (contracted bodies or economic operators), by providing minimum 3(three) confirmations for on-time completed services that shall be issued by the users of services, or, if such confirmations cannot be provided, a statement of the bidder for the completed services;

— education and professional qualifications of the economic operator or its trained team and especially the presons in charge of extending the specific service (submission of a proof M1/M2 forms);

— statement on the technical equipping and qualification of the economic operator as well as other potentials at its disposal for execution of the specific services and providing quality, especially description of the machines that are going to be used in the execution of services.

2.5.3. The documents stated in item 2.5.2 shall be prepared and signed by the economic operator and they should not be recorded by the authorized body.

2.5.4. The technical and professional capacity of economic operators may be supported by another entity, regardless of the legal relations between the economic operator and the entity, except for the reference list, previously signed contracts and licenses. If the economic operator proves it's technical and professional capability referring to the support of another entity, that entity is required to demonstrate that support with valid evidence that the entity will indeed make available the technical and professional resources to the economic operator. The entity that provides technical and professional support is not allowed to be rendered a verdict for participation in a criminal organization, corruption, fraud or money laundering

2.5.5 If the economic operators submit a bid as a group of economic operators, their technical and professional capacity shall be proved by taking into account the resources of all members of the group. If the group of economic operators participates with technical and professional support of a third entity or third parties, the technical and professional capacity shall be determined according to the above mentioned.
