IV.2) Criteria applied to determine capacity of bidders or candidates.

IV.2.1) To evidence their personal status economic operators shall present the documents as follows:

— statement made by the economic operator that in the last 5 years no final judgement has been rendered to the economic operator for participation in a criminal organization, corruption, fraud or money laundry;

— certificate stating that no bankruptcy procedure has been initiated by a competent authority;

— certificate stating that no liquidation procedure has been initiate by a competent authority;

— certificate of paid taxes, contributions and other public dues issued by the competent authority in the country where the economic operator is registered;

— certificate issued by the Register of penalties for crimes committed by legal persons stating that no secondary penalty…

… for participation in public call procedures, public procurement contract award procedures or public-private partnership contract procedures has been rendered to the legal entity;

… — temporary or permanent interdiction on carrying out particular business activity has been rendered; and

— certificate stating that no criminal sanction has been pronounced under a final judgement—interdiction to activity issued by the competent authority.

IV.2.2) Capacity to perform professional activity of economic operators:

2.4 Technical or professional capacity.

2.4.1 In order to qualify as capable to perform the subject public procurement contract regarding its technical or professional capacity, the economic operator must meet at least the following criteria:

— it must have reinsurance coverage from a reinsurance company having minimum credit rating ‘A’ established by the Standard and Poor's Rating;

— in the last 3 years it shall have insured at least 5 legal entities in a total premium amount of at least 100 000 000 MKD in the period from 2012 to 31.12.2014;

— it shall have hired (under an employment contract) professional personnel qualified for assessment of damages related to the respective public procurement;

General and special insurance terms and conditions:

— it shall have a permit, i.e. a decision for exercising business activity related to the object of procurement issued by the competent authority.

2.4.2 The economic operator proves that it has met the minimum requirements referred to in sub-clause 2.4.1 by submitting:

— reinsurance program which according to the rating of the first 2 re-insurers of Standard & Poor's Rating shall be at least А;

— list of reference of top 5 clients with a total premium amount of at least 100 000 000 MKD in the period from 2012 to 31.12.2014;

— statement that it has employed professional personnel qualified for assessment and acceptance insurance related to the respective public procurement;

— document of the general and special insurance terms and conditions;

— decision for exercising business activity-insurance issued by the competent authority.
